FISHY’S FRIENDS RESCUE – FOSTER AGREEMENT & LEGAL ADDENDUM

Effective June 2026

ARTICLE I

Purpose of this Agreement

This Foster Care Agreement ("Agreement") establishes the responsibilities, expectations, and legal relationship between Fishy's Friends Rescue ("FFR") and the individual serving as a foster caregiver ("Foster").

Fishy's Friends Rescue is a private, nonprofit, foster-based animal rescue organization. Because FFR does not operate a physical shelter, foster homes are essential to its lifesaving mission. Every foster home allows additional homeless animals to be rescued, rehabilitated, and placed into permanent adoptive homes.

By accepting a foster animal, the Foster agrees to provide temporary care in accordance with this Agreement, the Fishy's Friends Rescue Foster Handbook, Foster HQ App, Foster Academy, and any additional written policies or procedures adopted by Fishy's Friends Rescue. These resources are incorporated into this Agreement by reference and are considered part of the Foster's responsibilities.

This Agreement exists to establish clear expectations, promote effective communication, protect the welfare of every foster animal, and ensure that Fishy's Friends Rescue can continue operating safely and responsibly for the benefit of the animals in its care.

Ownership of Foster Animals

All foster animals remain the sole and exclusive property of Fishy's Friends Rescue unless and until a formal adoption has been completed and approved by Fishy's Friends Rescue.

Nothing in this Agreement grants the Foster any ownership interest, breeding rights, transfer rights, or authority to make permanent placement decisions regarding any foster animal.

The Foster agrees that they will not:

• Sell, transfer, rehome, abandon, surrender, or give away any foster animal.

• Represent themselves as the owner of any foster animal.

• Authorize medical treatment without approval except as directed by Fishy's Friends Rescue during an approved emergency.

• Promise, advertise, or guarantee adoption of any foster animal without written authorization from Fishy's Friends Rescue.

Fishy's Friends Rescue retains sole authority regarding all decisions involving medical care, behavioral management, placement, transfer, adoption, or removal of any foster animal.

Nature of the Foster Relationship

The Foster acknowledges that fostering is a voluntary partnership intended to provide temporary care until the animal is adopted or otherwise transferred by Fishy's Friends Rescue.

The Foster agrees to act in good faith, maintain open communication, follow rescue policies and procedures, and work collaboratively with Fishy's Friends Rescue throughout the duration of each foster placement.

Fishy's Friends Rescue likewise agrees to provide reasonable support through veterinary care, supplies when applicable, educational resources, behavioral guidance, and rescue leadership to assist the Foster in successfully caring for the animal.

Both parties acknowledge that successful fostering depends upon communication, cooperation, and shared commitment to the best interests of the animal.

Rescue Authority

Fishy's Friends Rescue reserves the exclusive right to determine all matters involving foster animals in its care, including but not limited to:

• Placement and relocation

• Veterinary care

• Behavioral plans

• Adoption approval

• Transfer to another foster

• Emergency decisions

• Return to rescue custody

The Foster agrees to cooperate with all reasonable directives issued by Fishy's Friends Rescue regarding the care and placement of foster animals.

Entire Agreement

This Agreement, together with the Fishy's Friends Rescue Foster Handbook, Foster HQ App, Foster Academy, and any written policies adopted by Fishy's Friends Rescue, constitutes the complete agreement between the parties regarding the foster relationship. Fishy's Friends Rescue reserves the right to revise policies and procedures as operational needs, legal requirements, or animal welfare standards evolve. Updated policies will become effective upon written notice to participating fosters.

ARTICLE II

Foster Care Responsibilities

By accepting a foster animal from Fishy's Friends Rescue ("FFR"), I agree to provide safe, compassionate, and responsible temporary care until the animal is adopted or otherwise transferred by Fishy's Friends Rescue.

I understand that while Fishy's Friends Rescue assumes responsibility for approved veterinary care and adoption placement, I am responsible for the animal's daily care, supervision, and overall well-being while the animal is in my custody.

Daily Care

I agree to provide my foster animal with:

• Continuous access to clean, fresh drinking water.

• Appropriate food provided or approved by Fishy's Friends Rescue.

• Safe, clean, climate-appropriate shelter within my home unless otherwise approved by FFR.

• Daily exercise, mental enrichment, socialization, and age-appropriate activity.

• Routine sanitation, including waste removal and maintaining a clean living environment.

• Daily observation for changes in appetite, behavior, mobility, or overall health.

Safety & Humane Care

I agree to exercise reasonable care to protect the safety and welfare of my foster animal at all times.

I will not:

• Leave the animal unattended in unsafe environments.

• Leave the animal outdoors without appropriate supervision unless specifically approved by Fishy's Friends Rescue.

• Tether the animal as a primary means of confinement.

• Use physical punishment, intimidation, neglect, or abusive training methods.

• Lift, drag, strike, or otherwise handle the animal in a manner that could cause pain or injury.

• Permit intentional breeding or contact with intact animals when restricted by Fishy's Friends Rescue or veterinary recommendations.

I understand that my foster animal must remain safely contained through the use of secure fencing, appropriate leashes, crates, gates, or other approved methods to minimize the risk of escape or injury.

Supervision & General Welfare

I agree to make every reasonable effort to ensure my foster animal's physical and emotional well-being throughout the foster period.

This includes:

• Providing a stable and low-stress environment.

• Introducing new people, animals, and environments responsibly and safely.

• Monitoring interactions with children and other pets.

• Following any behavioral or management plans provided by Fishy's Friends Rescue.

• Reporting any significant behavioral or medical concerns promptly.

Transportation Responsibilities

Because Fishy's Friends Rescue is a foster-based organization, transportation is an important part of fostering.

Unless alternative arrangements have been approved by Fishy's Friends Rescue, I agree to:

• Transport my foster animal to scheduled veterinary appointments.

• Transport my foster animal to adoption events, meet-and-greets, or approved adoption appointments.

• Notify Fishy's Friends Rescue as soon as possible if transportation assistance is needed so reasonable accommodations can be coordinated.

General Foster Standards

While fostering through Fishy's Friends Rescue, I agree to:

• Treat every foster animal with kindness, patience, and respect.

• Act in the best interest of the animal at all times.

• Follow all policies contained within this Agreement, the Foster Handbook, Foster HQ App, Foster Academy, and any written procedures issued by Fishy's Friends Rescue.

• Maintain a safe environment that promotes successful rehabilitation and adoption.

I understand that my role as a foster caregiver is one of temporary stewardship. My commitment directly impacts the health, emotional well-being, and adoptability of the animal, and ultimately helps Fishy's Friends Rescue continue its lifesaving mission.

ARTICLE III

Veterinary Care, Medical Authority & Preventive Care

Fishy's Friends Rescue is committed to providing appropriate veterinary care for every foster animal. To ensure consistency, quality of care, and accurate medical records, all veterinary treatment is coordinated and authorized exclusively by Fishy's Friends Rescue.

Veterinary Authority

I understand that Fishy's Friends Rescue retains sole authority over all veterinary care, medical decisions, diagnostics, medications, procedures, treatment plans, specialist referrals, and follow-up care involving foster animals.

Unless specifically authorized by Fishy's Friends Rescue or during an approved emergency, I will not independently:

• Schedule veterinary appointments.

• Seek medical treatment.

• Authorize diagnostics or procedures.

• Purchase prescription medications.

• Approve euthanasia or other permanent medical decisions.

• Transfer medical responsibility to another individual or organization.

I understand that all veterinary services must be coordinated through Fishy's Friends Rescue unless otherwise instructed.

Medical Reporting & Internal Triage

I agree to promptly report all medical concerns, injuries, illnesses, behavioral changes, or emergencies through the communication methods established by Fishy's Friends Rescue.

This includes concerns involving, but is not limited to:

• Illness or injury.

• Vomiting or diarrhea.

• Loss of appetite.

• Coughing or respiratory concerns.

• Lameness or mobility changes.

• Behavioral changes that may indicate illness or pain.

• Medication concerns.

• Surgical complications.

• Any situation in which I believe veterinary care may be needed.

Fishy's Friends Rescue will evaluate each concern through its internal medical triage process and determine the most appropriate course of action.

I understand that prompt communication is essential to providing timely medical care and protecting the health of the foster animal.

Emergency Veterinary Care

If I believe my foster animal is experiencing a life-threatening emergency outside normal operating hours, I will make every reasonable effort to immediately contact Fishy's Friends Rescue using the designated emergency communication procedures provided during onboarding.

If emergency treatment must be initiated before communication is possible to prevent the imminent loss of life or serious suffering, I will notify Fishy's Friends Rescue as soon as reasonably possible so further medical decisions may be coordinated.

Veterinary Records

I acknowledge that all veterinary records belong to Fishy's Friends Rescue.

I agree that:

• All veterinary records shall remain under the name of Fishy's Friends Rescue.

• I will not establish medical records under my personal name or account for any foster animal.

• I will verify that veterinary providers identify Fishy's Friends Rescue as the responsible rescue organization whenever applicable.

• I will ensure that all examination notes, invoices, laboratory reports, prescriptions, surgical records, and medical documentation are provided directly to Fishy's Friends Rescue.

Medications & Preventive Care

I agree to administer all medications, supplements, and preventive products exactly as instructed by Fishy's Friends Rescue or the attending veterinarian.

This includes, but is not limited to:

• Flea and tick prevention.

• Heartworm prevention.

• Deworming medications.

• Prescription medications.

• Post-operative medications.

• Medical bathing or topical treatments when prescribed.

I will administer medications on schedule, maintain accurate administration dates when requested, and promptly notify Fishy's Friends Rescue if a dose is missed, refused, vomited, or otherwise not successfully administered.

Medical Supplies

Fishy's Friends Rescue will provide or authorize medically necessary supplies whenever applicable.

I agree to:

• Request supplies through the approved Fishy's Friends Rescue process.

• Pick up supplies within reasonable timeframes when notified.

• Use supplies only for the foster animal assigned to my care.

• Notify Fishy's Friends Rescue before supplies are exhausted whenever possible.

Post-Operative Care

If my foster animal undergoes surgery or another medical procedure, I agree to carefully follow all discharge instructions provided by Fishy's Friends Rescue and the attending veterinarian.

This includes activity restrictions, medication schedules, incision monitoring, follow-up appointments, and any additional recovery instructions necessary to ensure proper healing.

Shared Commitment to Medical Care

I understand that prompt communication, accurate reporting, and following medical instructions are essential to the health and safety of every foster animal.

By working collaboratively with Fishy's Friends Rescue and its veterinary partners, I help ensure each foster animal receives consistent, appropriate, and timely medical care throughout its journey to adoption.

ARTICLE IV

Communication, Training & Rescue Protocols

Successful fostering depends upon consistent communication, teamwork, and following established rescue procedures. Fishy's Friends Rescue provides every foster with educational resources, communication platforms, and operational protocols designed to promote the health, safety, and successful placement of every foster animal.

By accepting a foster placement, I agree to actively participate in these communication systems and follow the procedures established by Fishy's Friends Rescue throughout my time as a foster.

Foster Academy & Onboarding

Prior to independently fostering animals, I agree to complete all onboarding requirements established by Fishy's Friends Rescue, including:

• Reviewing the Foster Handbook.

• Completing the Foster Academy and all required learning modules.

• Successfully completing any required quizzes or certifications.

• Completing all required forms, agreements, and onboarding documents.

• Downloading and utilizing the designated Foster HQ resources as instructed.

I understand that Fishy's Friends Rescue may require refresher training, updated educational modules, or revised onboarding requirements as rescue policies, veterinary standards, or operational procedures evolve.

Communication Expectations

I agree to maintain timely and professional communication with Fishy's Friends Rescue throughout the duration of every foster placement.

This includes:

• Promptly reporting medical, behavioral, or safety concerns.

• Responding to reasonable requests for information or updates.

• Keeping Fishy's Friends Rescue informed of any significant changes involving my foster animal.

• Communicating scheduling conflicts that may affect veterinary appointments, adoption events, or transportation.

• Working collaboratively with rescue leadership to develop solutions when challenges arise.

I understand that early communication allows Fishy's Friends Rescue to provide support before concerns become emergencies.

Foster Records & Reporting

I agree to accurately maintain any required foster records requested by Fishy's Friends Rescue, including when applicable:

• Behavioral observations.

• Medical updates.

• Medication administration.

• Weight or growth tracking.

• Adoption notes.

• Required forms or questionnaires.

I understand these records assist Fishy's Friends Rescue in making informed medical, behavioral, and adoption decisions.

Chain of Command

To promote efficient communication and consistent decision-making, I agree to follow the Chain of Command established by Fishy's Friends Rescue.

Unless an emergency requires immediate action, I will:

Step 1: Review the Foster Handbook and download/follow Foster HQ  App resources.

Step 2: Contact the appropriate Operations Director or designated leadership representative.

Step 3: If additional guidance is necessary, Fishy's Friends Rescue leadership will determine whether Executive Board review or additional organizational involvement is appropriate.

I understand that following the established Chain of Command allows concerns to be resolved efficiently while minimizing confusion and duplicate communication.

Adoption Participation

Fishy's Friends Rescue maintains sole authority over all adoption decisions.

As a foster caregiver, I agree to actively support the adoption process by:

• Providing honest observations regarding my foster animal's personality, behavior, routines, and needs.

• Participating in meet-and-greet appointments and adoption events whenever reasonably possible.

• Assisting with photographs, videos, biographies, or updates that help showcase my foster animal.

• Helping promote my foster animal through approved networking or social media when requested.

I understand that my observations are valuable in helping Fishy's Friends Rescue identify the most appropriate adoptive home for each animal.

Partnership & Shared Responsibility

Fishy's Friends Rescue is committed to supporting every foster through education, communication, veterinary guidance, behavioral resources, and organizational leadership.

Likewise, I understand that successful fostering requires active participation, timely communication, cooperation, and adherence to established rescue procedures.

By working together as a team, we improve the health, safety, and adoptability of every foster animal while allowing Fishy's Friends Rescue to continue its lifesaving mission.

ARTICLE V

Placement Stability, Finder Commitment & Return of Foster Animals

Fishy's Friends Rescue is a 100% foster-based rescue and does not operate a physical shelter. Because every available foster home directly affects the number of lives that can be saved, placement stability is essential to the welfare of each foster animal and the continued operation of the rescue.

By accepting a foster placement, I understand that I am making a commitment to provide temporary care until the animal is adopted or until Fishy's Friends Rescue approves an alternate placement.

Commitment to Placement Stability

I understand that adjustment periods, house training, crate training, behavioral concerns, personality differences, schedule changes, and compassion fatigue can occur during fostering.

When challenges arise that do not present an immediate safety risk, I agree to promptly communicate with Fishy's Friends Rescue and make a good-faith effort to work collaboratively toward a solution before requesting removal of the foster animal.

Fishy's Friends Rescue may recommend behavioral guidance, training resources, environmental modifications, enrichment activities, temporary management plans, veterinary evaluations, or other reasonable solutions designed to help the foster placement succeed.

Finder Foster Commitment

If I am the individual who located, found, rescued, or requested assistance for a canine entering Fishy's Friends Rescue, I understand that I am expected to serve as that animal's foster caregiver through adoption whenever reasonably possible.

I acknowledge that finder fosters play an important role in reducing unnecessary placement changes and preserving limited foster homes for additional emergency rescue cases.

Return of a Foster Animal

If I become unable to continue fostering for reasons that do not involve an immediate emergency or safety concern, I agree to notify Fishy's Friends Rescue as soon as reasonably possible.

I understand that Fishy's Friends Rescue cannot create foster homes on demand and that locating an appropriate placement may require time for networking, transportation, scheduling, home approvals, or behavioral planning.

Unless otherwise directed by Fishy's Friends Rescue, I agree to continue providing safe and appropriate care for the foster animal until another approved placement has been secured.

If requested, I also agree to assist with reasonable transition efforts, including transportation, meet-and-greets, photographs, updates, or other placement activities that may help expedite the transfer.

Emergency Boarding Responsibility

Because Fishy's Friends Rescue does not maintain a shelter facility, avoidable last-minute placement changes may require the rescue to utilize emergency paid boarding.

If I create an avoidable emergency placement by:

• Failing to provide reasonable notice;

• Refusing to communicate with Fishy's Friends Rescue;

• Refusing to participate in reasonable transition planning;

• Refusing to follow established rescue procedures without good cause;

• Refusing reasonable behavioral or training recommendations when no immediate safety concern exists; or

• Demanding immediate removal of a foster animal that can safely remain in my care,

I understand that Fishy's Friends Rescue may have no reasonable alternative but to place the animal into emergency boarding while another foster home is secured.

Under these circumstances, I understand and agree that I may be held financially responsible for reasonable emergency boarding expenses that are directly incurred as a result of my failure to provide reasonable notice or cooperate with placement planning.

Fishy's Friends Rescue reserves the sole discretion to determine whether boarding was reasonably necessary under the circumstances.

Exceptions to Boarding Responsibility

Boarding reimbursement shall not apply when immediate removal becomes necessary because of circumstances beyond the foster's reasonable control, including but not limited to:

• Death of an immediate family member;

• Serious illness or hospitalization;

• Fire, flood, tornado, or other natural disaster;

• Domestic violence or other household emergency;

• The home becoming unsafe or uninhabitable;

• Veterinary emergencies involving the foster animal;

• Newly developed aggression or other legitimate safety risks involving people or animals;

• Any other circumstance that Fishy's Friends Rescue reasonably determines could not have been anticipated or prevented.

Fishy's Friends Rescue will make every reasonable effort to assist fosters experiencing these situations and will work collaboratively to determine the safest solution for both the foster family and the animal.

Shared Responsibility

Fishy's Friends Rescue is committed to supporting foster families through communication, education, medical guidance, behavioral resources, and placement assistance.

In return, I agree to communicate honestly, plan ahead whenever reasonably possible, follow established rescue procedures, and work cooperatively with Fishy's Friends Rescue to promote placement stability and minimize unnecessary disruptions.

I acknowledge that successful fostering is a partnership built on communication, preparation, flexibility, and mutual respect. By working together, we improve outcomes for every foster animal while allowing Fishy's Friends Rescue to continue its lifesaving mission.

ARTICLE VI

Rescue Authority, Compliance & Termination

Fishy's Friends Rescue is entrusted with the care, protection, and placement of every animal accepted into its program. To fulfill this responsibility, Fishy's Friends Rescue retains the authority to make decisions that protect the health, safety, welfare, and best interests of its foster animals, volunteers, and organization.

Rescue Authority

I understand that Fishy's Friends Rescue retains sole discretion regarding all matters involving foster animals in its care, including but not limited to:

• Foster placement and relocation.

• Veterinary care and treatment decisions.

• Behavioral management plans.

• Adoption approvals and placement decisions.

• Emergency medical or behavioral interventions.

• Temporary boarding or transfer.

• Removal of a foster animal from my care.

• Closure or suspension of a foster placement.

I agree to cooperate fully with all reasonable directives issued by Fishy's Friends Rescue regarding any foster animal placed in my care.

Compliance with Rescue Policies

I understand that my participation as a foster caregiver requires compliance with:

• This Foster Care Agreement.

• The Fishy's Friends Rescue Foster Handbook.

• Foster HQ resources and required forms.

• Foster Academy training requirements.

• Written policies, procedures, and operational guidelines adopted by Fishy's Friends Rescue.

Failure to comply with these requirements may result in temporary suspension, termination of foster privileges, or removal of foster animals from my care.

Rescue Withdrawal & Removal of Foster Animals

Fishy's Friends Rescue reserves the right to remove any foster animal or terminate any foster placement whenever it reasonably determines that doing so is in the best interest of the animal or the organization.

Circumstances that may result in rescue withdrawal or termination include, but are not limited to:

• Failure to comply with this Agreement or established rescue policies.

• Failure to maintain appropriate communication.

• Failure to provide adequate care.

• Unauthorized veterinary treatment or placement decisions.

• Conduct that jeopardizes the health, safety, or welfare of a foster animal.

• Repeated failure to follow medical, behavioral, or operational instructions.

• Misrepresentation of information relating to the foster animal or the foster placement.

• Conduct that negatively impacts the mission, reputation, or operations of Fishy's Friends Rescue.

If a foster placement is terminated, I agree to peacefully surrender the foster animal, along with any rescue-owned equipment, records, medications, supplies, identification tags, crates, or other property belonging to Fishy's Friends Rescue upon request.

Rescue Property

I acknowledge that all foster animals, veterinary records, medications, equipment, supplies, identification tags, crates, collars, leashes, documents, and other materials provided by Fishy's Friends Rescue remain the property of Fishy's Friends Rescue unless otherwise authorized in writing.

Upon request or termination of the foster relationship, I agree to promptly return all rescue property in my possession.

Cooperative Resolution

Fishy's Friends Rescue values respectful communication and believes that most concerns can be resolved through cooperation and planning.

Whenever reasonably possible, Fishy's Friends Rescue will attempt to work collaboratively with foster caregivers to address concerns before terminating a foster placement. However, nothing in this Agreement limits the rescue's authority to immediately remove a foster animal whenever it reasonably determines that immediate action is necessary to protect the welfare of the animal or the interests of the organization.

Continuing Obligations

Termination of my foster relationship does not relieve me of any responsibilities or obligations that arose before termination, including the return of rescue property, confidentiality obligations, reimbursement obligations established under this Agreement, or cooperation in resolving outstanding matters related to the foster placement.

I understand that my ability to foster with Fishy's Friends Rescue is a privilege extended by the organization and not a right. Fishy's Friends Rescue reserves the authority to approve, suspend, deny, or terminate foster participation whenever it determines such action is appropriate to fulfill its charitable mission and protect the animals entrusted to its care.

ARTICLE VII

Professional Conduct, Confidentiality & Organizational Protection

As a volunteer foster caregiver, I understand that I represent Fishy's Friends Rescue within the community. I agree to conduct myself professionally, respectfully, and honestly while participating in the Fishy's Friends Rescue Foster Program.

Professional Conduct

I agree to treat fellow volunteers, board members, staff, adopters, donors, veterinary partners, applicants, and members of the public with courtesy and respect. Concerns or disagreements should be addressed through Fishy's Friends Rescue's Chain of Command whenever reasonably possible so they may be resolved constructively.

Confidentiality

During my participation with Fishy's Friends Rescue, I may have access to confidential or non-public information. I agree to protect and not disclose, copy, distribute, or use confidential information outside my responsibilities as a foster caregiver.

Confidential information includes, but is not limited to:

• Foster, adopter, volunteer, applicant, and donor information.

• Veterinary records and medical information.

• Internal communications.

• Rescue procedures, forms, policies, and operational documents.

• Financial or fundraising information.

• Behavioral evaluations and adoption information.

• Any information designated by Fishy's Friends Rescue as confidential.

This confidentiality obligation continues after my foster relationship has ended.

Representation of Fishy's Friends Rescue

I understand that only individuals specifically authorized by Fishy's Friends Rescue may officially represent the organization.

Unless authorized in writing, I will not:

• Represent myself as an officer, spokesperson, or authorized representative of Fishy's Friends Rescue.

• Enter into agreements or obligations on behalf of the rescue.

• Approve adoptions or placements.

• Independently transfer, surrender, rehome, or place foster animals.

• Collect donations or solicit funds on behalf of Fishy's Friends Rescue without authorization.

Organizational Protection

I agree that I will not knowingly engage in conduct intended to harm or interfere with Fishy's Friends Rescue, its animals, volunteers, board members, adopters, donors, veterinary partners, or charitable mission.

This includes, but is not limited to:

• Knowingly making false or defamatory statements.

• Online harassment, cyberbullying, intimidation, or targeted harassment.

• Encouraging or coordinating others to harass, threaten, or interfere with Fishy's Friends Rescue or individuals associated with the organization.

• Impersonating Fishy's Friends Rescue or falsely claiming authority to act on its behalf.

• Intentionally interfering with adoptions, foster placements, veterinary relationships, fundraising efforts, rescue operations, or contractual relationships.

• Publishing or distributing confidential information without authorization.

Fishy's Friends Rescue reserves the right to immediately terminate foster privileges, remove foster animals, place individuals on its Do Not Foster/Do Not Adopt list when appropriate, and pursue any legal or equitable remedies available under applicable law to protect its animals, volunteers, confidential information, reputation, and charitable mission.

Nothing in this Agreement is intended to prohibit truthful statements, lawful reporting to governmental authorities, or any activity protected by applicable law.

Non-Solicitation

During my participation with Fishy's Friends Rescue and for six (6) months following my final foster placement, I agree not to knowingly use confidential information obtained through Fishy's Friends Rescue to solicit or recruit its adopters, fosters, volunteers, donors, applicants, or veterinary partners for the benefit of another rescue organization.

Continuing Obligations

The responsibilities contained within this Article survive the termination of my foster relationship with Fishy's Friends Rescue and remain in effect until otherwise released in writing by the organization.

Legal Terms, Liability & Acknowledgment

Assumption of Risk & Release of Liability

I understand that fostering animals involves inherent and unpredictable risks, including but not limited to bites, scratches, illness, property damage, escape, injury, or other unforeseen incidents.

To the fullest extent permitted by law, I voluntarily assume these risks and agree to release, hold harmless, and indemnify Fishy's Friends Rescue, its Board of Directors, officers, volunteers, members, veterinary partners, affiliates, and representatives from claims, damages, losses, liabilities, costs, or expenses arising from my participation as a foster caregiver, except where prohibited by applicable law or resulting from gross negligence or willful misconduct.

Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Oklahoma. Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located within the State of Oklahoma unless otherwise required by law.

Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

The failure of Fishy's Friends Rescue to enforce any provision of this Agreement shall not constitute a waiver of its right to enforce that provision or any other provision in the future.

Entire Agreement

This Agreement, together with the Fishy's Friends Rescue Foster Handbook, Foster HQ resources, Foster Academy, and any written policies or procedures adopted by Fishy's Friends Rescue, constitutes the complete agreement between the parties regarding the foster relationship and supersedes any prior verbal or written understandings.

Binding Agreement

By signing below, I acknowledge that I have carefully read this Foster Care Agreement in its entirety and understand that it is a legally binding agreement.

I acknowledge that I have reviewed and understand each Article of this Agreement, including Article V regarding Placement Stability, Finder Commitments, Return of Foster Animals, and Emergency Boarding Responsibility, and I have had the opportunity to ask questions before signing.

I understand that the Fishy's Friends Rescue Foster Handbook, Foster HQ resources, Foster Academy, and written rescue policies are incorporated into and form part of this Agreement. I agree to comply with all current and future policies adopted by Fishy's Friends Rescue during my participation in the foster program.

By signing this Agreement, I voluntarily accept the responsibilities of serving as a foster caregiver for Fishy's Friends Rescue and agree to be legally bound by all terms, conditions, responsibilities, and obligations contained herein.
