Use Curiosity to Encourage Payment
Have you tried everything to get paid—emails, phone calls, statements, firm reminders, texts, and even physical letters? Frustrated with no response or payment? Try leveraging curiosity:
Step One
Contact your lawyers for approval to cc them on an email to the debtor. If they agree, ask them to refrain from opening a file or taking action; you're using their contact as a strategic reminder for this particular debtor. Clarify that while legal action may not be planned, you would appreciate their support if it becomes necessary. Many lawyers will be fine with this, as it may lead to future work for them.
Step Two
Send your payment request email to the debtor, including your lawyer in the cc field.
(If you use email tracking, remember it won’t indicate whether the debtor or lawyer opened the email.)
What’s Likely to Happen?
The debtor will likely look up the cc’d contact, discover it’s a legal firm, and be more inclined to respond. After all, if you saw a law firm cc’d on an email to you, wouldn’t it get your attention?
