When you consult and or contract with ConsumerEquity LLC, including any of its sponsored licensees or affiliates, to find, buy, rent, or sell your home, pursue financing or connect to any real estate professional, we know you’re trusting us with your data. We also know we have a responsibility to respect your privacy, and we work hard to do just that. This Privacy Policy explains what personal data we collect, why we use it, who we share it with, and how we protect it, along with providing information to manage your privacy. We periodically revise this Policy to reflect new and evolving laws that govern privacy. This Privacy Policy is not a contract and does not create any legal rights or obligations.
A. Who We Are: ConsumerEquity LLC is a Real Estate Brokerage licensed in the states of Illinois, Iowa, Nebraska and Wisconsin. We market and represent Buyers, Sellers, investors, entities, estate executors, banks, etc. in real estate transactions providing services including, but not limited to, Multiple Listing and sales service, contract/document preparation, closing coordination, and advertising and marketing programs at industry disruptive low rates, fees and, from time to time, complimentary, to save the hard-earned equity when consummating a wide range of real estate transactions.
We carefully evaluate how we use data to make sure that we're using your information to provide value for you. On this page, we aim to explain everything you need to know about your privacy with us. 1. ConsumerEquity LLC’s Role. We may assist you in performing any one or all of the various tasks in a real estate transaction. However, unless explicitly specified by the terms of the Agency Agreement (between the Brokerage and Client) THE SERVICES ARE NOT INTENDED TO provide you with any financial, real estate, or related advice of any kind. You understand and agree that our services may include advertisements and referrals. To help make advertisements and referrals relevant and useful to you, ConsumerEquity LLC may serve advertisements and refer you based on the information we collect through our online and in person services.
2. ConsumerEquity, LLC has a Real Estate Broker License in Illinois, Iowa, Nebraska and Wisconsin. However, unless provided for in your Agency Agreement, ConsumerEquity LLC assumes no responsibility for any result or consequence related directly or indirectly to any action or inaction that you or any consumer takes based on our services or any other information available through or in connection with our company.
B. Collection and Use of Personal Data: The term “personal data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual or household. It does not include aggregated or de-identified information that is maintained in a form that is not capable of being associated with or reasonably linked to an individual.
1. Information You Provide Us. When you use our services and website we collect personal information from you. We might also collect personal data about you from our business partners, payment processors, licensees, service providers, and other third parties who collect personal data on our behalf. Whether a client, customer, or user of our brokerage services and marketing, we collect personal data and use this information to create and administer your file, provide you with the relevant services and information, communicate with you regarding your account and your use of our services, for customer support purposes, and to send you communications by email, push notification, or by text message, in accordance with your preferences.
2. Customer Service and Communication. To best manage your account, provide relevant information and exceptional customer services, we collect and manage data including name, address, email, customer service requests, account history and the contents of requests and correspondence with us (including recordings of phone calls, where permitted by law). If you submit an inquiry, review, feedback or other comments, we collect the content and any other personal data you choose to provide in your message. We use this information to investigate and respond to your inquiries, to facilitate communication with us, to provide you with requested information, to enhance the services we offer, and to manage, market and grow our business.
3. Payment Information: Along with our third-party service providers, we collect information relating to your transaction(s) with us, including payment details. We use third-party payment tools to process and store payment information like credit card numbers or bank account information. We don’t store this information ourselves.
4. Affiliates and Company Representatives. We may receive information about you collected by our affiliates and licensees and the information you provide may be used by us to exceptionally serve and communicate with you. Our business partners, such as our licensed agents, agent partners, lending partners, builders, property managers, and other real estate professionals collect personal data in connection with their services and often share some or all of this information with us. For example, we receive information about transactions you complete with partners with whom we’ve connected you through our services.
5. Office, Event and Real Estate Showing Visitors. We collect personal data about visitors to our physical offices, events, and showings which may include: a) Contact Information including full name, email address, mailing address, and telephone number; b) Professional Information including job title, job function, company name, professional background, and nature of the relationship with us; c) Visit Information including the purpose of the visit and any restrictions or preferences while on premise; d) Security Information including a copy of a government ID (when applicable), a record of the visitor’s access to our office, event, or home, and images or video recordings of the visitor while on premises (where permitted by law and when applicable).
6. Service Providers, such as payment processors and marketing providers, collect personal data and often share some or all of this information with us. For example, we receive personal data from payment processors to confirm that an individual’s payment for the services was accepted. We use this information to comply with our legal obligations to monitor activity and prevent fraud. We also use this information to identify and provide individuals with promotions, listings, updated listing information, marketing activity and campaign information. This data management helps to protect our rights and the rights of others, while providing exceptional client management and service.
7. Information Providers. We may, from time to time, obtain information from third-party information providers to correct or supplement personal data we collect. For example, we may obtain updated contact information from a third-party data provider to reconnect with or provide market updates to you.
8. Publicly Available Information. We may collect personal data from publicly available sources, such as information you publicly post or tag us in on social media sites or other online resources and information contained in public records databases, such as government records or public review websites, to supplement the personal data identified above. We will use this information to conduct market research, verify your identity, prevent fraud, and improve our services.
C. Compliance and Legal Use of Personal Data: In addition to the uses identified above, we use the personal information we collect to maintain state and federal license and compliance laws and protect the interests of our clients, customers and users.
1. Legal Protection. The data we collect is used to prevent, investigate, and defend against fraud and unlawful or criminal activity. We strictly adhere to policies to prevent unauthorized access to or use of personal data and our data system services.
2. Dispute Resolution. We use collected data to enforce, investigate, and resolve disputes and security issues and assure adherence to our Terms of Service and any other contracts and binding agreements with our clients and affiliates.
3. Compliance. We comply with legal and licensed obligations and other governmental demands and use necessary personal information and records to maintain compliance.
4. Personal information is used for any other lawful and legitimate business purpose.
D. Affiliated Business Relationship Notice: ConsumerEquity LLC (which operates ConsumerEquity.co and promotes The Backdoor BuyerRebate and other commission reducing programs), Consumer Title Company LLC and 2Millions, LLC doing business as FSBOHOMES.COM Chicagoland are affiliated businesses and have common or partially shared ownership interests. Because of these relationships, the referral of a customer or client by any of the aforementioned companies to another may provide the referring company, its affiliates, and or/their employees and agents with a financial or other benefit, pursuant to state and federal laws. In addition, while ConsumerEquity LLC is not affiliated with the following companies, it does maintain advertising, service, or rental agreements at fixed fees with: Advisors Title Network LLC; American Home Shield Corporation; FSBOHOMES.COM Cedar Falls; FSBOHOMES.COM Cedar Rapids; FSBOHOMES.COM Iowa City; FSBOHOMES.COM Des Moines; FSBOHOMES.COM Dubuque; FSBOHOMES.COM Omaha; FSBOHOMES.COM Quad Cities; Home Warranty Inc.; Kuehl Realty Services, LLC; The Law Offices of Ryan Schaefges, PC; Neighborhood Loans; The Brickkicker Inspection Services and True Footage Inc. Any customer, client or user is not required to use any referred or contracted service partners as a condition of entering into an agency agreement or business relationship with ConsumerEquity LLC or its affiliates.
E. Sharing of Personal Information: We do not share, sell or disclose your personal information or mobile opt-in data to third parties without your explicit consent, except where required by law. Your information is kept confidential and used solely for the purposes you have agreed to. The following categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties. Text messaging opt-in data is not being shared with third parties. We may disclose personal information in the instances described below:
1. Among ConsumerEquity LLC, its affiliates and their respective employees and agents. ConsumerEquity LLC may share an individual’s personal data to its internal staff and its affiliates for purposes and uses that are consistent with this Privacy Policy and applicable law. For example, ConsumerEquity LLC might share your personal information with its licensed agents and transaction coordinators to allow the appropriate personnel have access to required information to ensure a successful transaction.
2. Business Partners: At the client’s expressed direction we may share personal data with our business partners in order to provide the client options for products and services beyond the scope of our licenses. For example, at your request, we may share contact information with a mortgage lender or attorney to provide a referral or introduction.
3. Marketing Partners: We may share aggregated demographic information with third party marketing providers to assist them in understanding the audience and message we deliver to market and attract users, customers, and clients to our business model. This information is not designed to identify any specific individual.
4. Service Providers: We share information with third party vendors and service providers that perform services for or on our behalf, which may include identifying and serving targeted advertisements, providing mailing or email services, tax and accounting services, customer service, product fulfillment, payments processing, photo sharing, data processing and enhancement services, fraud prevention, web hosting, analytic services, or other online functionality, subject to appropriate contractual terms protecting the confidentiality and use of such data. We never allow service providers to use your personal data for their own purposes.
5. Business Transaction or Reorganization: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose personal data to a third party during negotiation of, in connection with, or as an asset in such a corporate business transaction. Personal data may also be disclosed in the event of insolvency, bankruptcy, or receivership.
6. Legal Obligations and Rights: We may disclose personal data to third parties, such as legal advisors and law enforcement: In connection with the establishment, exercise, or defense of legal claims; To comply with laws and regulations or to respond to lawful requests and legal process; To protect our rights and property and the rights and property of our agents, customers, and others, including to enforce our agreements, policies, and terms of use; To detect, suppress, or prevent fraud; To reduce credit risk and collect debts owed to us; To protect the health and safety of us, our customers, or any person; Or as otherwise required by applicable law.
7. Otherwise with Consent or At Your Direction: We may disclose your personal data to certain other third parties or publicly with your consent or direction. If you post a comment or review on our social media sites or other public facing websites and search engines, the information you provide may be displayed publicly online for others to view.

H. Third Party Websites: Our websites and online services may include links to or redirect to third party websites, listings and applications, including social media services where users may connect with us. Third party websites may also reference or link to our websites and online services. Except where we post, link to, or expressly adopt or refer to this Privacy Policy, this Privacy Policy does not apply to, and we are not responsible for, any personal data practices of third party websites and online services or the practices of other third parties.
