You have the right to question or refuse any counseling or diagnostic procedures.
Confidentiality is respected, with legal exceptions:
Risk of harm to self or others.
Suspected child abuse or neglect.
Court subpoenas.
You can discuss the therapeutic fit and request referrals if this therapeutic relationship is not a good fit.
You have the right to access your treatment records with appropriate procedures and under ethical guidelines. While there may be reasonable fees associated with obtaining copies, records can be reviewed/clarified during session with the therapist without additional charges. Access by third parties requires patient consent, ensuring that clients maintain control over their confidential information.
Privacy and Sharing of Information
Personal and medical information is confidential and shared only with your permission.
Audio/video recording of sessions is prohibited without consent from all parties.
Release of Information
A “Consent for Release of Confidential Information” form may be required to discuss your treatment with others.
You can limit the time or scope of the release.
Your Health Information Rights
You have the right to:
Read and ask questions about this notice.
Request restrictions on certain uses of your information.
Access your protected health information.
Request changes to your health information.
Receive a list of disclosures of your health information.
TELEHEALTH AND ELECTRONIC MESSAGING CONSENT
1. Telephone Communication
Landline & Cell Phones: Conversations may not be secure. Calls may be monitored or intercepted, and billing details can reveal call information.
Usage: Telephone calls will typically be used for appointment scheduling. Any other phone conversations over 5 minutes will be billed at the therapist's hourly rate.
2. Text Messaging
Security: Text messaging is not secure and should not include therapeutic content. We use encrypted HIPAA compliant software for appointment confirmations, changes or reminders, billing payment reminders, to answer any quick questions from clients.
Clients can OPT-OUT of the secure messaging at any time;
Your phone contact information WILL NOT be shared to any third party vendors for marketing purposes.
3. Email Communication
Security: Email is not secure and is used strictly for appointment confirmations. Please schedule a call or session for any confidential discussion and avoid email communication.
4. Social Media
Policy: We do not accept friend requests or personal messages on personal social media accounts to maintain confidentiality. You may follow our professional accounts but be mindful of privacy.
5. Video Conferencing (Telehealth)
Platform: We utilize Jane App for secure, HIPAA-compliant video sessions.
Responsibility: You must ensure you are in a secure environment and initiate connections for telehealth sessions. Therapist will not engage in session while the client is driving or present in a confidentiality compromising environment. It is the responsibility of the client to ensure private and confidential space prior to the session.
6. Client Portal
Security: Access to the client portal is provided through a secure, encrypted platform. Use only secure devices when accessing the portal.
7. Emergency Procedures
If you have a mental health emergency, we encourage you not to wait for communication back from your therapist but to do one or more of the following:

8. Confidentiality and Client Responsibilities
You agree to communicate only through secure devices and in a secure location. You must inform your therapist of your location and nearest mental health facility during telehealth sessions.
9. Financial Policies
Billing: The structure and cost for telehealth sessions are the same as in-person sessions. Late cancellation policy is same as in person sessions. You are responsible for any insurance claims.
10. Limitations of Tele Health
Be aware that communication may lack visual/auditory cues, which can lead to misunderstandings.
11. Identification for New Telehealth only Clients
During your first session, you will be required to show a valid picture ID and another form of identity verification.
12. Modes of Communication
Various communication modes will be used as agreed upon. You may withdraw consent for specific methods at any time by notifying us in writing.

Except where prohibited by law, by using this Site you indemnify and hold harmless Asher Haven Counseling Inc and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the State of Tennessee.
Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Asher Haven Counseling Inc are unable to resolve any dispute through informal discussion, then you and Asher Haven Counseling Inc agree to submit the issue before a mediator. The decision of the mediator will not be binding. Any mediator must be a neutral party acceptable to both you and Asher Haven Counseling Inc. The costs of any mediation will be paid by the unsuccessful party.
Notwithstanding any other provision in these Terms and Conditions, you and Asher Haven Counseling Inc agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
