In order to facilitate development of the 330 Cole Avenue site, propose to transfer the site for applicable costs and fees, not to exceed $10,000. This is a change from the original agreement. Counsel reviewed to determine that this was still appropriate given previous procurement issues.

When the amendment is considered by the Board of Selectmen, the record of proceedings should reflect the points listed below. When the Board votes, the motion could be in the following form: “I move that the Board approve and sign the First Amendment to Option Agreement for Transfer of Real Property between the Town and Berkshire Fund, Inc. for the reasons stated in the Town Manager’s memorandum dated December 12, 2016, and presented at this meeting.”
