Procedures for Disciplinary Hearing

  • All requests for a disciplinary hearing must originate with the NHS Adviser

If the adviser learns of an alleged infraction, the matter must be brought to the principal before scheduling a hearing.

  • Until a hearing is held, members of the Council are not allowed to discuss the alleged incident and must refrain from forming a judgment about the matter

If a member of the Council learns of an alleged infraction by a member of the NHS, the matter must be brought to the attention of the adviser.

  • At no time are members of the Council allowed to discuss any allegations of misconduct with the other members of the Council.

  • After receiving a report of an alleged infraction, the adviser cannot discuss the alleged infraction with other members of the Council.

  • If a member of the faculty learns of an alleged infraction involving a member of the NHS, they must report this to the non-voting adviser or school administration.

  • If an administrator learns of an alleged infraction involving a member of the NHS, they must discuss this with the non-voting adviser.

  • All incidents of alleged infraction will be handled in a non-public hearing of the Council.

a. Any teacher or faculty member with knowledge of the alleged incident will be invited to attend the present the facts of the incident. If there are members of the broader school community with knowledge of the incident, they will also be invited to attend. Written statements are also permitted as long as they are read to the Council in their entirety.

b. The student(s) involved in the alleged incident will be invited to attend the hearing to speak to the incident. If they choose not to attend, they may submit a written statement of the matter, which must be read to the Council in its entirety. The student(s) has the right to bring witnesses to the incident who are allowed to speak to the specifics of the incident.

c. The parents of the involved student(s) will be welcome to attend. Any comments made by the parents must be relevant to the incident. Other character witnesses are not permitted.
