In New York State, everyone who turns 18 years of age is automatically assumed to be legally competent to make decisions. Guardianship is a process by which someone is appointed by the Surrogate Court to make decisions for a person, who is unable to make decisions for themselves. Guardianship allows a parent to continue making some decisions they have made before the age of 18.
