NEW Background Screening Requirements - Changes in law passed during the 2012 legislative session significantly modify background screening for many service providers regulated by a variety of state agencies, including health care providers licensed by the Agency for Health Care Administration (Agency) under Chapter 408, Part II, Florida Statutes (F.S.). The new law created a Care Provider Background Screening Clearinghouse” or Clearinghouse.” The purpose of the Clearinghouse is to provide a single data source for background screening results of persons required to be screened by law for employment in positions that provide services to children, the elderly, and disabled individuals. In a progressive move to reduce duplicative screening, the Florida Care Provider Background Screening Clearinghouse (Clearinghouse) was established by law in 2012 to be a single data source for background screening results of persons required by law to undergo screening for employment in positions that provide services to vulnerable populations. (1) The Agency for Health Care Administration in consultation with the Department of Law Enforcement shall create a secure web-based system, which shall be known as the Care Provider Background Screening Clearinghouse” or clearinghouse,” and which shall be implemented to the full extent practicable no later than September 30, 2013, subject to the specified agencies being funded and equipped to participate in such program. FSU was required to begin utilizing the statewide care provider background screening "Clearinghouse" database for Summer Camp Background Checks in the summer of 2016. Regulations require that individuals who provide direct services to Vocational Rehabilitation (VR) customers must register with the Agency for Health Care Administration (AHCA) Care Provider Background Screening Clearinghouse (CLH) and submit to and pass a level 2 background screening. Level 2 Screenings must be initiated through the Florida Department of Children and Families (DCF) Clearinghouse before an applicant goes to a compliant background screening vendor to submit fingerprints and have photo taken.
