A G R E E M E N T,

between Gerritt Resident ("Owner")

and those who rent Estate areas in Second Life,

effective 28th day of December, 2012:

PLEASE READ THIS BEFORE YOU RENT!

Welcome!  Those of us who live here wish to exist in a peaceful, aesthetically pleasing, and generally friendly environment.  As such, kindly abide by the conditions set forth in this Agreement.  Guidelines also apply to your visitors. 

Claims as to ignorance of the guidelines set forth are not grounds for grievance, as notice of any changes to this Agreement are always provided to anyone who lives here.  If any Resident wishes to discuss these Guidelines, simply IM Gerritt Resident, who will be happy to consider your thoughts.  Final decisions will rest solely with the Land Owner, Gerritt Resident.

IMPORTANT NOTICES TO TENANTS & AND VISITORS:

NO "AGE PLAY" WILL BE TOLERATED.  THERE ARE NO EXCEPTIONS.  Age play is any roleplay in which one or more avatars pretend to be minors (defined within the Second Life Terms of Service as anyone under the age of 18) engaging in any type of erotic act with any avatar who bears an adult appearance.  It does not matter what the age of the real-life roleplayer is: THE ACTIVITY IS EXPRESSLY FORBIDDEN.  Any sign of age play on this rental land will result in 1) eject; 2) ban; 3) reclamation of land without refund.

Any simulation of lethal violence and/or graphic depictions of violence. as outlined in the Linden Lab Terms of Service, will also result in eject and ban if a warning from any island resident is not heeded within several minutes.  If the behaviors continue, then the land will be reclaimed with no refund.

Harassment of any Resident or Visitor makes one subject to eject and ban.  Examples include: solicitation of victims for vampire bites or of clients for prostitutes.  Coming to the land and standing on anyone else’s home land without being invited is also ground for eject and ban, since it appears to be stalking behavior.

If any tenant believes they have been falsely accused of objectionable behavior then they have the right to appeal a notice of land reclamation within three (3) days of such reclamation.  The Owner reserves the right to consult with neighbors and tenants regarding any and all perceived violations of this Agreement.  The Owner will make all final decisions with respect to ejections, banning, and reclamation.

WELCOME!

By renting a parcel, you agree that you have read, understand, and agree with these guidelines as they have been presented here and that you WILL be held to this Agreement. Further because this is a themed sim, your build is expected to fit with the general sim theme.  You're not expected to roleplay but you are WELCOME to.

Residents will owe rental fees solely to the Estate Owner, Gerritt Resident.  There will be no sub-leasing - nor reselling of land - by Renters.

 

Payment of rent must be performed before you begin to place any Objects on the land you plan to occupy.  Your payment indicates your agreement to the terms explained herein.

A PREMIUM ACCOUNT WITH SECOND LIFE IS NOT NEEDED TO RENT LAND HERE.

Land is provided "as is" to residents.   We cannot guarantee a certain look, theme, frame rate, telehub location, location of the sim on the map or any other specific sim settings except for it being a mature-rated sim.

Parcel rentals are NOT restricted based on color, creed, race, gender, religion, nationality, physical limitations, or species.   Please be sure to review the very important behavioral guidelines set forth at the beginning of this Agreement. 

ZONING RULES:

We wish to create a safe & comfortable environment here.  Except with the express consent of Gerritt Resident on a case-by-case basis, there will be no listing of a parcel as a "gathering place" or "hangout".  'Escort Services', or solicitation for such services, are forbidden.  Homes that are deemed to be unattractive by the Owner will need replacement or modification.  No commercial areas can exist without the approval of the Owner, and must be pleasant, not packed with open-air or sidewalk stalls, nor garish signs.

If you live on land with perimeter waters, do not block off the waterway.   If there is a waterway between you and the parcel next to yours then you must keep the waterway there.  You cannot raise your land so that the waterway is impeded by your land.  You may not block the waterways with anything that would make it impossible for someone to pass from the sim to the waterways.

Skyboxes are permitted but must be raised to a minimum of 700m in the air and should NOT be placed at eye-level with sky structures that belong to other Residents.  If there are any problems with this then please IM Gerritt Resident.

Please use common sense when it comes to land borders that of your neighbors.   You are required to use tasteful landscaping, and prohibited from building a  structure within 10m of the borders.

If you wish to place structures or building(s) on your rental land then the following building guidelines must be followed to prevent overcrowding and encroachment.  Guidelines are as follows:

If you have a parcel equal to 4,096m2, you may not build higher than 25 meters.

Parcels over 4,096m2, but less than 8,192m2 may build 30m high.

Parcels equal to - or greater than - 8,192m2 can build 40 meters high. 

No matter where you live, you must make sure that your building is not so close to the neighbors’ parcels that chat would be seen by your neighbors.  Therefore, buildings and other structures must be set back at least 10m from your neighbor's borders to avoid chat being heard between neighbor's homes, as well as an overcrowded look that could result.

Adult-oriented activity should not impede the enjoyment of other Renter's parcels, so please be considerate.   We wish this sim to have a high quality of life, and that all will be respectful to everyone here. 

Please limit your use of scripts to help reduce lag.  Things like rotation scripts, particles, etc., can overload sim resources.  Also, please try to shut off animated furniture when you're not around :)

SL can be a great place for everyone if we are all committed to a fine quality of life!

Please respect everyone's privacy!  Failure to do so will result in an Abuse Report to LL.  Recording or transmiting chat, spying on residents' movements/activities are prohibited.  This includes sending avatar or sim information to an external database, unless the objects for which data is being transmitted are owned by you, or you ask written permission of the avatar or object owner before transmitting.  "Alt avatar" detectors and IP detectors are expressly forbidden.

If you use particle systems, please be sure the particles do not generate an excessive amount of particles, and that these remain confined to your parcel.  (For example, chimneys or flames.)

THE USE OF BAN LINES ("No Entry" Fences) IS NEVER PERMITTED.  

Security scripts are welcome and encouraged, but must take action ONLY on those who are ON your rental land.  Your security system scripts must give at LEAST a ten (10) second warning before taking action on anyone who is on your rental parcel.  You must add the Sim Owner's name to the "White List" on your security system.  Trust that your privacy is important to the Owner and will not be violated.  It is also a matter of common courtesy to add the names of friendly names to your white list, since they could easily fly over your parcel by mistake.

If you are being harrassed/griefed by a visitor or another resident here, then forward the name and a brief description of what they are doing to the Owner so that the individual(s) in question can be banned from all his lands.

o No harassment or stalking

o No sexual harassment

o No littering of Objects on other residents' land

o No garish lighting systems nor weather that could disturb your neighbors

EVENT RESTRICTIONS: please ask the Owner 48 hours in advance.

Commercial billboards and rotating or blinking signage will not be permitted.

This land is rated 'Adult'.   Please respect other residents private space and do not fly up to their private rooms.  Kindly familiarize yourself with the Linden Lab Terms of Service so you will understand the differences between PG/General, Moderate/Mature, and Adult sims.

Failure to pay your rent within 72 hours (3 days) of the due date will result in the parcel being reclaimed, (subject to reasonable accommodations made in advance between Renter and Owner), and all Objects on the parcel will be returned to you. If you are unable to make your payment, other arrangements will be considered on a case-by-case basis.  In the event this happens, contact the Owner - VIA IM AND NOTECARD - as soon as you know your payment will not be on time and the Owner will try to work with you if at all possible.  No guarantees should be assumed about the ability of the Owner to wait for rental payments, since sim tier to Linden Lab doesn‘t take a vacation: please be mindful of this.

The Owner does NOT EVER wish to reclaim anyone's land!  Therefore, if you know you will have trouble paying your rent on time, kindly contact Gerritt Resident BEFORE the reclamation can occur.   Remember, once reclamation occurs, you have lost your land and your objects will be back in your Lost & Found.  The Owner does not want this to happen, so please communicate if you have a payment problem.

Owner reserves the right to reclaim without notice any parcel held by someone who is deemed to be causing annoyance(s), "griefing", harrassing, or stalking any other renter or visitors here.  Please keep the place friendly!  You are also held liable for the actions of your "alts", friends, and guests while they are here. 

If you believe your parcel has been reclaimed without just cause (except in the case of non-payment) then you have the right to dispute the reclamation by contacting the Owner within 3 days; he will listen to your explanation, but cannot make any assurance that your rental will continue.

The Owner reserves the right to ban anyone who is considered to be annoying or "griefing" other parcel holders or visitors of the island.

Neither the Owner, nor the Estate Manager(s), may be held responsible for the loss of any content/objects. Sim server software mishaps must be taken up with Linden Lab directly.  You are responsible for any loss caused or brought about by anyone having the ability to return/sell/delete objects owned by you or your Group. 

Refunds are by negotiation and on a case by case basis. The Owner reserves the right to issue refunds at his/her disgression.

If you lose any inventory then contact the Owner, who will provide you with some helpful info about how to get back things that can go missing in SL.

This Covenant is subject to change.  Notice of any changes made will be transmitted to all Renters in the form of a Revised Agreement. 

By renting your parcel, you agree that you have read, understand, and agree with these guidelines.
