Voicebank and Synthesized Speech End-User License Agreement

Tl; dr, just use common sense and courtesy. Like crediting me (a.k.a., ZaneChihuahua) for the voicebank. I don't like making this just as much as you don't like reading this. So, I tried to make this as short as possible. Either way, I would appreciate it a lot if you read everything.
Article 1 |Definitions|
"Vocal Synthesis:" An artificial production of the human voice.
"Voicebank:" A virtual folder full of audio recordings, oto.ing parameters, text files, and other miscellaneous voice data that can be used to operate a vocal synthesis program. This End-User License Agreement (henceforth known as "EULA") will pertain to the official voicebanks made by the creator, ZaneChihuahua, and the derivative voicebanks made by users.
"Creator, ZaneChihuahua:" The original real person, or estate that holds the copyright of the character, ZaneChihuahua, Kaleo Mele and their respective voicebanks.
"Character, ZaneChihuahua:" The abstract concept that is represented by the name "ZaneChihuahua," the synthesized speech that is produced because of the utilization of the "ZaneChihuahua" voicebanks, and an appearance that is based on the icon and profile picture made by the creator, ZaneChihuahua.
"Characters:" The aggregate of the visual and characteristic qualities of the abstract concepts that are represented by the name "ZaneChihuahua," "Kaleo Mele," and characterized as the synthesized singing, image, name, personality, etc.
"Synthesized singing:" The audio that is generated from a program that specializes in vocal synthesis. Some common forms of synthesized speech are talking, rapping, and singing.
"Derivative:" A person's work that is based on another person's work.
"User:" An individual, commercial, or legal entity who utilizes all or part of the creator, ZaneChihuahua's character voicebanks or its synthesized singing.
Article 2 |About the Voicebank and Synthesized Speech End-User License Agreement|
THIS END-USER LICENSE AGREEMENT (EULA) IS A LEGAL AGREEMENT BETWEEN THE USER AND THE CREATOR, ZANECHIHUAHUA. BY INSTALLING, COPYING, OR USING THESE VOICEBANKS, IT WILL BE DEEMED THAT YOU AGREE TO ALL OF THE TERMS AND CONDITIONS WRITTEN IN THE EULA, BE BOUND TO IT, AND SHALL FOR NOW ON BE RESPONSIBLE FOR UPHOLDING THEM REGARDLESS OF WHETHER OR NOT YOU KNEW ABOUT THE EULA EXISTING. IT WILL BE CONSIDERED "IN USE" WHEN THE VOICEBANK OR ANY PART OF IT IS STORED IN THE TEMPORARY MEMORY OR INSTALLED IN THE PERMANENT MEMORY OF A DEVICE. IF YOU DO NOT AGREE WITH ANYTHING ON HERE OR YOU DO NOT BELIEVE YOU CAN UPHOLD TO THE TERMS AND CONDITIONS, PLEASE DO NOT USE AND DELETE THIS VOICEBANK.
Furthermore, by using these voicebanks with the UTAU program, OpenUTAU program, or any other program that can use these voicebanks, you are also bound to uphold the separate Terms and Conditions, EULA's, and other legal information of those programs as well.
The most updated EULA of the official voicebanks and synthesized singing shall be valid until the end of time and it will be valid everywhere in the entire universe. Any updates to the EULA may be subject to change without prior notice. Any out-of-date copy of this EULA within the user's possession shall be void. If you are young and have trouble understanding these EULA's, then please have a parent, guardian, or other responsible adult read them for you.
If anyone wishes to use this EULA as a TEMPLATE for their own, then they are free to do so. Copying this EULA verbatim is a breach of copyright. This EULA will not serve as legal advice for those who wish to use it as a template. If a translated copy of this EULA is made, then it can only be used as a reference and the original English version shall prevail.
Article 3 |Voicebank Permissions and Restrictions|
A copy of this EULA will inform and grant the user the following permissions and restrictions for the use of all of the creator, ZaneChihuahua's voicebanks regardless of whether or not the user is represented as an individual or as a corporation:
YOU MAY:
(1) make an infinite amount of free and personal copies of any official and authorized voicebank and use them to create synthesized singing on an infinite number of computer devices.
(2) modify, translate, redistribute, and make unofficial derivatives of the official voicebanks under the following conditions: The most up-to-date license and copyright proclamations from the OFFICIAL voicebanks are present in the modified voicebanks and you receive authorization from the creator, ZaneChihuahua to release them first. For example, changing the oto.ing parameters to better fit an UTAU Sequence Text (UST) or to make a "Friday Night Funkin'" derivative to use for mods of the game. You may also directly alter the voicebank for the sake of increasing the quality and accessibility.
(3) directly change the configuration files of the voicebank like oto.ni files and .frq files.
(4) directly alter the audio files that are provided in the official voicebanks which may not normally be possible to do in a Vocal Synthesizer. For example, using audio editing software to clean the audio files.
(5) redistribute only the derivative voicebanks. If the official voicebanks are discontinued, then those voicebanks may be redistributed as well.
YOU MAY NOT:
(1) redistribute, sell as an individual product or part of a bundle, lend, lease, or rent any type of voicebank in whole or in part.
(2) use unauthorized ZaneChihuahua voicebank derivatives.
(3) falsely distribute the derivative voicebanks of the creator, ZaneChihuahua's characters as an official voicebank of any individual including the creator, ZaneChihuahua, you, the user, or any other third party. Only the creator, ZaneChihuahua can make official derivatives of the creator, ZaneChihuahua's character voicebanks.
(4) redistribute the derivatives of the voicebanks anywhere without referencing the creator, ZaneChihuahua's character voicebanks as the derivative's source.
(5) include any type of voicebank or any part of them in any software made by you or another third party.
(6) turn the voicebanks and anything inside of the voicebanks into Non-Fungible Tokens (NFT's) and other types of cryptocurrencies.
(7) use the voicebanks to create AI models and to be used for databases designed to train AI models. Only the creator, ZaneChihuahua has the right do so.
(8) modify, remove, or make it illegible the license and copyright proclamation of any type of the creator, ZaneChihuahua's character voicebank unless it is to update the voicebank and synthesized speech EULA to its most recent update.
(9) add and modify any files inside any type of voicebank to accommodate malware of any type.
(10) make a derivative voicebank that does not use the creator, ZaneChihuahua's characters.
(11) break any of the Terms and Conditions.
To ensure the integrity of all the official voicebanks, they are provided by the creator, ZaneChihuahua, on approved websites that can be found using his "linktree" link which can be found at the bottom of this document. They will not contain derivative voicebanks made by users or any other third party. The creator, ZaneChihuahua, reserves the right to refuse and revoke the use and creation of all official and derivative voicebanks to anyone at the creator, ZaneChihuahua's discretion at any time for no apparent reason.
Article 4 |Synthesized Speech Permissions and Restrictions|
A copy of this EULA will inform or grant the user the following permissions and restrictions for the use of all of the creator, ZaneChihuahua's synthesized singing regardless of whether or not the user is represented as an individual or as a corporation:
YOU MAY:
(1) create synthesized singing using official and derivative ZaneChihuahua voicebanks and use them to your legal right while abiding by this EULA. For example, utilizing synthesized speech to make original songs, talking media, and making covers of songs with the permission of the original artist of the song you wish to cover.
(2) modify the synthesized singing as long as they come from approved official and derivative character voicebanks.
(3) use the synthesized speech to represent a character besides the character a voicebank is based on as long as you clearly state that the synthesized speech was made using an official or derivative voicebank.
(4) redistribute synthesized speech that comes from an officially authorized voicebank for free.
YOU MAY NOT:
(1) redistribute, sell, lend, lease, offer the synthesized speech to be included in a bundle to be sold or distributed, and rent a copy of the synthesized singing.
(2) include the synthesized singing or any part of it in any software made by you or another third party.
(3) falsely distribute the derivative synthesized speech of the creator, ZaneChihuahua's characters as the official synthesized speech of any individual including the creator, ZaneChihuahua, you the user, or any other third party.
(4) use synthesized speech that was made from an unauthorized voicebank. Only the creator, ZaneChihuahua can make official derivatives of a voicebank's synthesized speech.
(5) redistribute the derivatives of the synthesized speech anywhere without referencing the creator ZaneChihuahua's character voicebanks as the derivative source.
(6) use the creator, ZaneChihuahua's character voicebanks or synthesized speech without referencing either the character voicebank or the creator, ZaneChihuahua.
(7) use the synthesized speech of the "ZaneChihuahua" voicebanks to make audio that can be bought with Non-Fungible Tokens (NFT's) and other types of cryptocurrencies.
(8) use the sythesized singing to create AI models and to be used for databases designed to train AI models. Only the creator, ZaneChihuahua has the right do so.
(9) add or modify any files inside any type of voicebank to accommodate malware of any type.
(10) make synthesized speech that is illegal and can be understood as extremely violent, hateful, dishonest, misleading, solicit, and pornographic.
(11) use the synthesized speech to make sentences and lyrics that will violate public policy and the publicity and personal rights of any third party including the creator, ZaneChihuahua.
(12) make synthesized speech to solicit and promote political ideologies and religious practices. The only exception to this is for singing hymns.
(13) use the synthesized speech for making covers and voiceovers of copyrighted material that you do not have permission to use.
(14) reconfigure the synthesized singing to function in a vocal synthesis program that is neither UTAU nor OpenUTAU.
(15) break any of the Terms and Conditions.
Furthermore, if you wish to use the synthesized singing of the creator, ZaneChihuahua's character voicebanks for commercial purposes, for example, but not limited to, albums, singles, CD's/DVD's, concerts, venues, commercials, ads, TV shows, radio promotions, karaoke services, ringtones, a built-in voice for hardware and software, and featured films, etc., then you must contact the creator, ZaneChihuahua, for permission to do so and to be subjected to a contract not listed here. The creator, ZaneChihuahua, reserves the right to refuse and revoke the creation of all official and derivative synthesized singing to anyone at the creator, ZaneChihuahua's discretion at any time for no apparent reason.
Article 5 |International Copyright Proclamation for Voicebanks and Synthesized Speech.|
I, the creator, ZaneChihuahua, hereby license these voicebanks, which include, but are not limited to, the .wav, .txt, prefix.map, oto.ni, yaml source file, .frq, TCL, SETPARAM-SCACHE files, and the synthesized speech created using these voicebanks under "CC BY-NC-SA 4.0" You are free to Share — copy and redistribute the material in any medium or format. Adapt — remix, transform, and build upon the material. The licensor cannot revoke these freedoms as long as you follow the license terms. Attribution — You must give appropriate credit, provide a link to the license, [the CC BY-NC-SA 4.0. part] and indicate if changes were made. NonCommercial — You may not use the material for commercial purposes. The exception to this rule is if you ask the creator, ZaneChihuahua for permission to do otherwise and the creator agrees. ShareAlike — If you remix, transform, or build upon the material, you must distribute your contributions under the same license as the original. You may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.
Article 6 |Property Rights of Voicebanks, Derivatives, and Synthesized Singing.|
The official Voicebanks, official derivatives, synthesized singing of individiual linguistic characters, words, parts of words, and sound effects, belongs to the creator, ZaneChihuahua, including the ones you download and make a copy of. This EULA grants you permission to download and use the official voicebanks, official derivatives, and authorized unofficial derivatives of the voicebanks but does not grant you ownership of the voicebanks and synthesized singing themselves. If you make synthesized singing that contains a succession of linguistic characters, words, and parts of words, then that is yours. For example, if you only make synthesized singing that is represented as the Japanese character "あ" thanks to the utilization of the ZaneChihuahua voicebanks, then that belongs to the creator, ZaneChihuahua. If you use the synthesized singing to make the national anthem of Cambodia while singing in Klingon two octaves higher than normal, then that's yours. You also agree that any and all of the rights, titles, and interests in all types of Voicebanks and synthesized singing, including all copyrights and other intellectual property rights, remain solely and exclusively with the creator ZaneChihuahua and protected by relevant copyright laws until the end of time and shall be active everywhere in the entire universe. Any terms, usages, and provisions that are not stated in this document are determined by the creator, ZaneChihuahua.
Article 7 |Disclaimer|
The creator, ZaneChihuahua, is not responsible for any damages of property, revenue, profit, data, and damages that may come upon, you, the user, or your organization because of the voicebanks, synthesized singing, and their contents except when the creator, ZaneChihuahua has intentional or gross negligence. For example, if a voicebank decides to go out of a device and choke you to death, or you end up causing a mob to destroy your house because the synthesized singing told people to do so, then that's not the creator, ZaneChihuahua's, fault. Also, the creator, ZaneChihuahua is not responsible for any claims, suits, and other damages that may come upon you because you failed to comply with this license or you failed to comply with the distributions of your music, derivatives, and art that infringe or cause damage to the rights of others. THESE VOICEBANKS AND THE UPDATES WITH THEM ARE PROVIDED TO YOU "AS IS" AND DO NOT INCLUDE ANY KIND OF WARRANTY. THIS MEANS THE CREATOR, ZANECHIHUAHUA WILL NOT MAKE PROMISES ABOUT THE QUALITY OF THE VOICEBANKS OR THAT THE VOICEBANKS WILL BE ERROR-FREE. USE IT AT YOUR OWN RISK!
Article 8 |Termination of License|
The creator, ZaneChihuahua has the right to terminate your license for any legal reason. As long as you follow the copyright policies and the EULA, the creator, ZaneChihuahua, cannot terminate your rights. Otherwise, your license will automatically end if you do not follow the EULA or you receive a notification of termination from the creator, ZaneChihuahua. If you do not follow the EULA, then the creator, ZaneChihuahua reserves the right to take any legal action necessary to make any claim for damages. This EULA will automatically end and enter the public domain the moment the copyright protection period ends which is the life of the creator, ZaneChihuahua, plus 70 years after the death of the creator, ZaneChihuahua. You also have the option to terminate those rights yourself. By destroying the License of the voicebanks from your device, you also terminate the rights you have for using the voicebanks unless you download the License again. You still have your rights to the synthesized singing you made with the voicebanks even after termination.
Article 9 |Governing Law|
The official EULA for these voicebanks shall be in accordance with the laws of the United States of America and international copyright law. If any provision in this EULA is found to be illegal, void, or unenforceable, then those provisions shall be amended in a way that will best serve the purpose of that provision to the fullest extent permitted by law. Any provisions that have been unchanged shall remain intact.
Article 10 |Juristiction|
Any dispute that becomes acknowledged shall be taken place at a state or federal court in the state of Arizona. If you live in the United States, the dispute may go to arbitration instead.
Artilce 11 |Revision of the EULA|
Any updates to the EULA may be subject to change without prior notice and you agree to uphold the most recent update by either updating the EULA in the readme.txt file of the voicebanks or by continuing to use the official voicebanks knowing the revised version of the EULA in mind. Authorized derivatives of the official voicebanks must be updated to the most recent version of the EULA. Any changes to the EULA will be announced on the official "ZaneChihuahuaUTAU" Twitter account.
Article 12 |Feedback & Suggestions|
You are more than welcome to leave feedback and suggestions about the voicebanks, website, and anything else related to those to the creator, ZaneChihuahua. However, keep in mind that those suggestions will be made for free and the creator, ZaneChihuahua will have no obligation to accept or decline those suggestions and may use those at their discretion regardless of giving credit to you or not.

BY USING THE CREATOR, ZANECHIHUAHUA'S CHARACTERS, MAKING DERIVATIVES OF THE CHARACTERS, AND USING OFFICIAL IMAGES OF THE CHARACTERS, IT WILL BE DEEMED THAT YOU AGREE WITH THE LICENSE AND SHALL FOR NOW ON BE RESPONSIBLE FOR UPHOLDING THEM REGARDLESS OF WHETHER OR NOT YOU KNEW ABOUT THE CDL. IT WILL BE CONSIDERED "IN USE" WHEN YOU EITHER INSTALL THE VOICEBANK OR ANY PART OF IT IS STORED IN THE TEMPORARY MEMORY OR INSTALLED IN THE PERMANENT MEMORY OF A DEVICE OR USE ANY PART OF THE CHARACTER IN GENERAL. Furthermore, by using the character, ZaneChihuahua or any of its derivatives on the world wide web, the UTAU program or any other program, you are also bound to uphold the separate Terms and Conditions, EULA's, and other legal information of the official artists, programs and websites as well. The most updated CDL of the creator, ZaneChihuahua's characters shall be valid until the end of time and it will be valid everywhere in the entire universe. Any updates to the CDL may be subject to change without prior notice. Any out-of-date copy of this CDL within the user's possession shall be void. If you are young and have trouble understanding the CDL, then please have a parent, guardian, or other responsible adult read it for you. YOU MAY:
(1) obtain an infinite amount of free and personal copies of the official images of the creator, ZaneChihuahua's characters on an infinite amount of computer devices.
(2) modify, and make unofficial derivatives of the creator, ZaneChihuahua's characters to make unofficial derivative voicebanks and characters for non-commercial purposes. The most up-to-date license and copyright proclamations from the OFFICIAL voicebanks are present in the modified voicebanks and art and you receive authorization from the creator, ZaneChihuahua to release them first.
(3) modify, redistribute, and make unofficial derivatives of the official art of the creator, ZaneChihuahua's characters. For example, making fan art that anyone can obtain without payment and making a 3D model of ZaneChihuahua that anyone can download and changing the art style of a character to be used in a video and to make a "Friday Night Funkin'" derivative to use for mods of the game.
(4) directly alter the art for the sake of increasing the quality and accessibility.
(5) You can make your own copyright licenses for the new material you contributed to a derivative. The underlying work of the creator ZaneChihuahua's character's will not transer over to a user.
(6) use the name, "ZaneChihuahua" or a variant of it in the titles of your derivatives.
(7) use the character, ZaneChihuahua for noncommercial purposes. For example, using the character by changing the art style of a character to be used in a video, fanfiction, visual media that is open to the public, making fan art that is open to the public, and making a 3D model of ZaneChihuahua that anyone can download.
YOU MAY NOT:
(1) redistribute, sell, lend, lease, offer the creator, ZaneChihuahua's characters, and the official images to be included in a bundle to be sold or distributed, and rent a copy of the official images of the characters when they are made.
(2) make derivatives of the character, ZaneChihuahua to be used for unauthorized derivative voicebanks.
(3) falsely distribute the derivative character of the creator, ZaneChihuahua's characters as an official character of any individual including the creator, ZaneChihuahua, you, the user, or any other third party. Only the creator, ZaneChihuahua can make official derivatives of the creator, ZaneChihuahua's characters.
(4) use the derivatives of the creator, ZaneChihuahua's characters anywhere without referencing the original characters as the derivative's source.
(5) include the creator, ZaneChihuahua's characters, the derivatives, the official images, or any part of them in any software made by you or another third party.
(6) use either the creator, ZaneChihuahua's characters, or its derivatives to make anything that can be bought with Non-Fungible Tokens (NFT's) and other types of cryptocurrencies.
(7) modify, remove, or make it illegible the license and copyright proclamation of any type of voicebank unless it is to update the official CDL to its most recent update.
(8) use the creator, ZaneChihauhua's characters and any derivatives of the aforementioned to create AI models and to be used for databases designed to train AI models. Only the creator, ZaneChihuahua has the right do so.
(9) add or modify any image file inside any type of voicebank to accommodate malware of any type.
(10) alter or remove the CDL and copyright proclamation of the official images inside of the official voicebanks and the derivatives of those voicebanks.
(11) use the character, ZaneChihuahua to inflict the rights of a person, company, or any other third party.
(12) use the creator, ZaneChihuahua's characters in illegal content and to be used to depict, or be depicted in an extremely violent, hateful, and pornographic manner. Seriously. ZaneChihuahua is a Chihuahua.

The creator, ZaneChihuahua, reserves the right to refuse and revoke the use of the creator, ZaneChihuahua's characters to anyone at the creator's discretion at any time for no apparent reason.

The creator, ZaneChihuahua's characters, which includes, but is not limited to, the .BMP files in the voicebanks, name, and image is licensed under "CC BY-NC-SA 4.0" You are free to Share — copy and redistribute the material in any medium or format. Adapt — remix, transform, and build upon the material. The licensor cannot revoke these freedoms as long as you follow the license terms. Attribution — You must give appropriate credit, provide a link to the license, [the CC BY-NC-SA 4.0. part] and indicate if changes were made. Article 5 |Property Rights of the Creator, ZaneChihuahua's Characters, Official Art, and Derivatives|
The creator, ZaneChihuahua's characters and the official art of the aforementioned belongs to the creator, ZaneChihuahua. The official images of the creator ZaneChihuahua's characters found in the voicebanks belong to their respective photographers and artists, including the ones you download and make a copy of. This CDL grants you permission to download and use the official images but does not grant you ownership of the official images themselves. If you yourself make images of the character, ZaneChihuahua, then the image is yours. This includes fan art, 3D modules, and other mediums.
Article 6 |Disclaimer|
The creator, ZaneChihuahua, is not responsible for any damages of property, revenue, profit, data, and damages that may come upon you, the user, or your organization because of the creator, ZaneChihuahua's characters and their contents except when the creator, ZaneChihuahua has intentional or gross negligence. For example, if an image decides to go out of a device and choke you to death, then that's not the creator, ZaneChihuahua's, fault. The creator, ZaneChihuahua, is not responsible for any claims, suits, and other damages that may come upon you because you failed to comply with this license or you failed to comply with the distributions of your images and derivatives that infringe or cause damage to the rights of others. THE CREATER, ZANECHIHUAHUA DOES NOT GUARANTEE THE NONINFRINGEMENT OF OTHER THIRD PARTY PROTECTED COPYRIGHTS. USE IT AT YOUR OWN RISK!
Article 7 |Termination of License|
The creator, ZaneChihuahua has the right to terminate your CDL for any legal reason. As long as you follow the Copyright policies and the CDL, the creator, ZaneChihuahua, cannot terminate your rights. Otherwise, your license will automatically end if you do not follow the CDL or you receive a notification of termination from the creator, ZaneChihuahua. If you do not follow the CDL, then the creator, ZaneChihuahua reserves the right to take any legal action necessary to make any claim for damages. This CDL will automatically end and enter the public domain the moment the copyright protection period ends which is the life of the creator, ZaneChihuahua, plus 70 years after the death of the creator, ZaneChihuahua. You also have the option to terminate those rights yourself. By deleting the License of the voicebanks from your device, you also terminate the rights you have for using the official images and making derivatives of the creator, ZaneChihuahua's characters unless you download the License again. You still have your rights to the derivatives you made with the character, ZaneChihuahua even after termination.
Article 8 |Governing Law|
The official CDL for the creator ZaneChihuahua's characters shall be in accordance with the laws of the United States of America and international copyright law. If any provision in this CDL is found to be illegal, void, or unenforceable, then those provisions shall be amended in a way that will best serve the purpose of that provision to the fullest extent permitted by law. Any provisions that have been unchanged shall remain intact.
Article 9 |Jurisdiction|
Any dispute that becomes acknowledged shall be taken place at a state or federal court in the state of Arizona. If you live in the United States, the dispute may go to arbitration instead.
Article 10 |Revision of the CDL|
Any updates to the CDL may be subject to change without prior notice and you agree to uphold the most recent update by either updating the CDL in the readme.txt file and continuing to use the creator, ZaneChihuahua's characters knowing the revised version of the CDL in mind. Authorized derivatives of the official voicebanks must be updated to the most recent version of the CDL. Any changes to the CDL will be announced on the official "ZaneChihuahuaUTAU" Twitter account.
Article 11 |Feedback & Suggestions|
You are more than welcome to leave feedback and suggestions about the creator, ZaneChihuahua's characters, website, and anything else related to those. However, keep in mind that those suggestions will be made for free and the creator, ZaneChihuahua will have no obligation to accept or decline those suggestions and may use those at their discretion regardless of giving credit to you or not.
