# Terms and Conditions for XML Viewer

These terms govern your use of the XML Viewer mobile application ("the app"),

published by MD Developer Studio ("we", "us", "our"). By installing or using

the app, you agree to them. If you do not agree, please do not use the app.

## 1. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to

install and use the app on devices you own or control, for personal or

commercial purposes.

You may not:

- sell, rent, sub-licence or redistribute the app;

- copy, modify, translate or create derivative works from it;

- reverse engineer, decompile or disassemble it, except where that right cannot

  lawfully be excluded;

- remove or obscure any notice of ownership within it.

The app, its name, its icon and its design remain our property. This licence

does not transfer ownership of anything.

## 2. Your files remain yours

The app is a tool for reading and editing files that you already have.

- **You retain all rights to every document you open.** We claim no ownership,

  licence or interest in your content.

- Your files are processed entirely on your device. We never receive them.

  (See the Privacy Policy for the detail.)

- **You are responsible for your files.** That includes having the right to open

  and edit them, and keeping your own backups.

## 3. Editing and saving — please keep backups

The app can modify and overwrite files on your device. It takes real care over

this: output is checked for validity before anything is written, saves are

performed atomically, and a backup copy of the previous version is kept.

Even so, **software can fail**, and storage, permissions and devices vary.

Before editing anything important or irreplaceable, keep an independent copy.

We are not liable for lost or corrupted data.

## 4. Advertising

The app is provided free of charge and is supported by advertisements served

by Google AdMob.

- Ad content comes from Google and its advertising partners, not from us. We do

  not select, endorse or vouch for any advertised product, service or website.

- Any dealings you have with an advertiser are solely between you and them.

- You must not interfere with, block, automate or artificially interact with

  the ads shown in the app.

## 5. Internet connection

The app requires a working internet connection to start. We do not guarantee

uninterrupted availability, and connectivity depends on your device, your

network and your provider.

## 6. Acceptable use

You agree not to use the app to:

- break any law, or infringe anyone's rights;

- open, edit or distribute content you have no right to;

- attempt to disrupt, damage or gain unauthorised access to the app or to any

  system;

- circumvent any limitation, security measure or advertising in the app.

## 7. Third-party services

The app makes use of services operated by Google — Google Play (for updates and

reviews) and Google AdMob (for advertising). Your use of those services is

governed by Google's own terms and privacy policy. We are not responsible for

them, and cannot control how they behave.

The app can also open links to Google Play. We are not responsible for the

content of any external site or store listing.

## 8. Updates and changes to the app

We may release updates that add, change or remove features. Some updates may be

required for the app to keep working. We may also discontinue the app at any

time without liability.

## 9. No warranty

**The app is provided "as is" and "as available", without warranty of any

kind**, express or implied, including any implied warranties of

merchantability, fitness for a particular purpose, accuracy, or

non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or that it

will correctly parse, display, convert or preserve every possible file. XML is

a broad standard and files vary enormously; some files may not open, may

display imperfectly, or may not convert as you expect.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of

this section may not apply to you.

## 10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect,

incidental, special, consequential or exemplary damages, nor for any loss of

data, profits, revenue, business or goodwill, arising out of or relating to

your use of the app — whether or not we were advised of the possibility.

Where liability cannot lawfully be excluded, our total liability to you is

limited to the greater of the amount you paid us for the app (which, for the

free version, is nothing) or the equivalent of USD 10.

## 11. Indemnity

You agree to indemnify and hold us harmless from any claim or demand, including

reasonable legal fees, arising from your misuse of the app, your breach of

these terms, or your infringement of anyone else's rights.

## 12. Termination

This licence continues until terminated. It ends automatically if you breach

these terms. You may end it at any time by uninstalling the app. Sections 2, 9,

10 and 11 survive termination.

## 13. Governing law

These terms are governed by the laws of [COUNTRY/STATE], without regard to its

conflict-of-law rules. Any dispute will be subject to the exclusive

jurisdiction of the courts of [COUNTRY/STATE], unless the law where you live

gives you the right to bring proceedings elsewhere.

## 14. Changes to these terms

We may revise these terms from time to time. The "Last updated" date above will

change when we do. Continuing to use the app after a revision means you accept

the revised terms.
