1. ACCEPTANCE OF TERMS

• These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "User," or "you") and Zion Studios ("we," "us," or "our") governing your use of the GuardMe mobile application and any related services (collectively, the "Service").

PLEASE READ THESE TERMS CAREFULLY. By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy [Insert Link to Your Privacy Policy Here], which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you may not use the Service.

2. MODIFICATION OF TERMS

• We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice, such as by posting the updated Terms within the App or on our website. The "Last Updated" date at the top indicates when changes were made. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes. You are responsible for regularly reviewing these Terms.

3. THE SERVICE

GuardMe is designed to help users monitor potential unauthorized access to their mobile device. Key features include:

• Unauthorized Access Detection & Logging: When enabled and configured by you, the Service can capture photographic or video evidence ("Log Media") and associated device location data ("Log Location") upon certain device events (e.g., screen activation when guarding is active). It also records timestamps for these events ("Log Timestamps"). Collectively, Log Media, Log Location, and Log Timestamps are referred to as "Log Data."

• Secure Vault: Allows you to store media files ("Vault Content") locally within a protected area of the App.

• Premium Features: Access to enhanced functionalities like video recording, location logging, sound alerts, and others may require an active subscription.

IMPORTANT: All Log Data and Vault Content collected and generated by the Service are stored locally on your device's internal storage. We do not automatically collect, transmit, or store this sensitive data on our servers.

4. LICENSE GRANT AND RESTRICTIONS

License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service solely for your personal, non-commercial use on a compatible mobile device that you own or control.

• Restrictions: You agree not to:

• Use the Service for any illegal, unethical, or unauthorized purpose, including monitoring or collecting data from a device without the explicit consent of its owner or authorized user.

• Violate the privacy rights of any third party. Copy, modify, distribute, sell, lease, or create derivative works of the Service. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service. Attempt to gain unauthorized access to the Service or its related systems or networks. Use the Service in any manner that could damage, disable, overburden, or impair the Service (though primary functionality is local). Remove, obscure, or alter any proprietary notices (including copyright and trademark notices) on the Service.

5. USER RESPONSIBILITIES

• Lawful Use: You are solely responsible for ensuring that your use of the Service complies with all applicable local, state, national, and international laws and regulations.

• Device Security: You are responsible for maintaining the security of your device, including setting a strong device passcode or utilizing biometric authentication. GuardMe relies on these underlying security measures. The security of your Log Data and Vault Content depends significantly on the overall security of your device.

• Data Management: You are responsible for managing the Log Data and Vault Content stored locally on your device, including backing it up if desired (using device backup methods or future App features) and deleting it when necessary.

6. PRIVACY AND DATA

• Our practices regarding the collection and use of information are detailed in our Privacy Policy [Insert Link to Your Privacy Policy Here]. As highlighted:

• Local Storage: Log Data and Vault Content are stored locally on your device.

• No Server Collection: We do not collect or transmit your Log Data or Vault Content to our servers.

• Subscription Management: We use a third-party service (RevenueCat) to manage subscriptions. This involves sharing anonymized identifiers and purchase data with them as described in our Privacy Policy.

• Analytics: We may collect anonymized, aggregated usage data to improve the App, as detailed in the Privacy Policy.

7. SUBSCRIPTIONS AND PAYMENT

• GuardMe may offer optional auto-renewable subscription plans ("Premium Plans") providing access to premium features.

• Plans: Available plans (e.g., Weekly, Monthly, Yearly, Lifetime) and their corresponding features and fees will be displayed within the App.

• Payment: Payment will be charged to your Apple App Store account upon confirmation of purchase.

• Auto-Renewal: Weekly, Monthly, and Yearly subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

• Managing Subscriptions: You can manage your subscriptions and turn off auto-renewal by going to your App Store Account Settings after purchase.

• Free Trials: If a free trial is offered, any unused portion will be forfeited when you purchase a subscription.

• Pricing: Prices are subject to change. Any price changes will apply to subsequent subscription periods.

• Refunds: Refund requests are handled by Apple according to their App Store policies. We do not issue refunds directly.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR VIRUS-FREE; (C) THE RESULTS OBTAINED FROM THE USE OF THE SERVICE (INCLUDING UNAUTHORIZED ACCESS DETECTION) WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR OUR AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZION STUDIOS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SERVICE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

10. TERMINATION

• By You: You may terminate these Terms at any time by uninstalling the Service from your device. Uninstalling the app will result in the deletion of all locally stored Log Data and Vault Content associated with the App on that device.

• By Us: We may, in our sole discretion, suspend or terminate your access to and use of the Service, with or without notice, for any reason, including, without limitation, if we believe you have violated these Terms.

• Effect of Termination: Upon termination, your license to use the Service will cease immediately. Sections pertaining to disclaimers, limitations of liability, user responsibilities, intellectual property, governing law, and miscellaneous provisions shall survive termination.

11. GOVERNING LAW

• These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Zion Studios is established, without regard to its conflict of law principles.
