Welcome to Worth Scan! By downloading, installing, or using our mobile application (the "Service" or "App"), you agree to comply with and be bound by the following terms and conditions (“Terms of Service” or “Terms”). Please read them carefully.
1. Acceptance of Terms By using Worth Scan, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree to these Terms, do not install, access, or use the App.
2. Eligibility The App is intended for users aged 18 and older. By using the App, you confirm that you meet this age requirement. If you are under the age of 18, you are not permitted to use the App.
3. Account Registration & Google Sign-In To access the features of the App, you must authenticate using a valid Google Account.
Account Security: You are responsible for maintaining the confidentiality and security of your Google login credentials. Worth Scan is not liable for any unauthorized access to your scan history resulting from a compromised Google account.
Accurate Information: By authenticating, you agree that the profile information provided by Google (such as your email address) is accurate and belongs to you.
4. Description of Service and Acceptable Use Worth Scan is an informational tool designed to help users analyze food products using crowdsourced registries, public data networks, and artificial intelligence processing.
Personal Use: The Service is granted to you under a limited, non-exclusive, non-transferable license for personal, non-commercial use only.
Prohibited Conduct: You agree not to misuse the App. Prohibited actions include, but are not limited to: reverse-engineering or scraping the App; attempting to disrupt or overload our centralized cloud infrastructure (Google Firebase); manipulating barcode scanning data; or utilizing automated scripts to query our backend services.
5. Nutritional and Medical Disclaimer
Informational Purposes Only: Worth Scan provides automated product evaluations, goal-tailored analysis, and ingredient flagging for informational and educational purposes only. It does not constitute medical, nutritional, or health advice.
Verify Physical Packaging: Because data retrieved from public registries (such as the Open Food Facts database) or compiled via third-party artificial intelligence engines (such as the Groq API and the Gemini API) may occasionally contain inaccuracies, omissions, or errors, you must always read the physical packaging, ingredients, and allergen warnings printed directly on the product before consumption.
User Responsibility: You assume all risks associated with your dietary choices. If you have severe food allergies, medical conditions, or specific health concerns, you should consult a qualified healthcare provider or registered dietitian.
6. Data Processing and Crowdsourced Content
Standard Processing (Crowdsourced): When utilizing our standard analysis features, the barcode digits and the resulting analysis (processed via the Groq API) are transmitted to and permanently stored in our centralized cloud registry to assist future users scanning the same item.
Premium Processing: If you access our Premium tier, product analyses are generated dynamically via the Gemini API. To comply with third-party service agreements, analyses generated through the Premium tier are processed in real-time and are not cached, aggregated, or shared within the centralized public registry.
License Grant: By performing standard scans within the App, you grant Worth Scan a worldwide, royalty-free, irrevocable, perpetual license to host, display, aggregate, and utilize this objective product data.
De-Identified Data: As outlined in our Privacy Policy, your specific contributions to the global product database are de-identified and not publicly linked to your Google account profile.
7. Third-Party Advertisements and Services To keep the App free and functional, Worth Scan displays third-party advertisements provided by Google AdMob.
Rewarded Ads: You may be offered the option to view video advertisements in exchange for additional features or allowances (such as extra daily scans).
Third-Party Content: We do not endorse, control, or guarantee the products, services, or content featured in these advertisements. Any interaction, purchase, or engagement with advertisers found through the App is solely between you and the advertiser.
External Links: Ads may contain links to third-party websites or services that are not owned or controlled by Worth Scan. We assume no responsibility for the content, privacy policies, or practices of any third-party websites.
8. Intellectual Property All application code, software architecture, user interface designs, branding, logos, graphics, within the App are the exclusive property of Worth Scan or its licensors. Unauthorized copying, modification, or distribution of our proprietary assets is strictly prohibited.
9. App Availability and Termination
"As-Is" Basis: The App is provided on an “as-is” and “as-available” basis. We do not warrant that service will be uninterrupted, secure, or free of technical bugs or network latency.
Modifications: We reserve the right to modify, suspend, or discontinue the App, its centralized database access, or any specific analysis feature at any time without notice or liability.
Termination: You may terminate this agreement at any time by navigating to Settings and deleting your account, followed by uninstalling the App from your mobile device.
10. Limitation of Liability To the maximum extent permitted by applicable law, Worth Scan, its developer, or its infrastructure partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, any health complications, allergic reactions, adverse dietary outcomes, loss of data, or network interruptions resulting from your use of or inability to use the App.
11. Changes to These Terms We reserve the right to update or modify these Terms at any time. Any changes will be posted within the App or on this legal page with an updated "Last updated" date. Your continued use of the App following the posting of modifications indicates your formal acceptance of the updated Terms.
12. Governing Law These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles. Any legal actions or disputes arising from the use of this App must be handled individually within the appropriate jurisdiction of the State of New Jersey.
