Service Description
Wink AI is a mobile application that lets users upload photos or videos and apply AI-powered transformations — such as face-swap, appearance modification, stylized effects, and creative video generation — according to user selection (“Services”).
Eligibility
You must be at least 18 years old (or the minimum legal age in your jurisdiction) and legally capable of entering binding agreements.
By using the App, you confirm that you own or have obtained all necessary rights, permissions, or consents for the media you upload (e.g. photos, videos), including rights to any recognizable persons depicted.
Acceptable Use & Prohibited Content
You agree not to use the App for any of the following:
Content that is pornographic, sexually explicit, or intended for adult only use.
Non-consensual deepfakes, impersonations, defamation, harassment, hate speech, or any unlawful activities.
Any content that violates intellectual property rights, privacy rights, publicity rights, or other rights of third parties.
Use that violates any applicable local, national or international law or regulation.
We reserve the right to refuse, remove, or block access to any user content or account that violates these provisions.
Ownership & Rights
Your Uploaded Content: You retain ownership of all original media (photos, videos) you upload to the App.
Generated Content: You own the transformed media produced by the App (subject to the rights of any individuals appearing in the output).
Our App & Services: We (Wink AI) retain all rights, title, and interest (including intellectual property rights) in the App, its codebase, AI models/algorithms, design, and backend infrastructure.
You may not reverse engineer, decompile, copy, distribute or create derivative works based on the App or backend system.
Disclaimers & Limitation of Liability
The App and Services are provided “as is”, without warranties of any kind (express or implied). We do not guarantee that the output will meet your expectations, look realistic, or be free from errors.
To the fullest extent permitted by law, we disclaim liability for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, or inability to use the App resulting from using the App or generated content.
You bear full responsibility for how you use, share, or publish any generated content.
Termination and Suspension
We reserve the right to suspend or terminate your access to the App (or certain features) at any time, particularly if we believe you violated these Terms or engaged in prohibited behavior.
Changes to Terms
We may update these Terms from time to time. The “Last Updated” date will indicate when changes were made. Continued use of the App after such changes constitutes your acceptance of the new Terms.
Governing Law & Dispute Resolution
