Term of Use

These terms of use (“Terms”) apply to persons anywhere in the world (each such person, a “User” or “You”) who install, access or use the mobile application (“App”) published by Nuconcepts Holdings LLC (“WiFi Warden”,”Us” ,”Our” or “We”). PLEASE READ THESE TERMS CAREFULLY, AS THEY ARE A LEGAL AGREEMENT BETWEEN YOU AND WiFi Warden.

PLEASE READ THIS TERM OF USE CAREFULLY. BY USING, ACCESSING OR DOWNLOADING THE APP, YOU ACCEPT AND AGREE TO THE PRACTICES DESCRIBED IN THIS POLICY, ON BEHALF OF YOURSELF AND ALL PERSONS AND BUSINESSES FOR WHOM YOU ARE REPRESENTING.

Rights and Obligations of the User

• Connection using WPS in this application has been developed for totally Testing and Educational purposes. Use it (with Your own responsibility) only for Your own network or networks that you have permission to use this tool on. The developer will not accept any responsibility in case of misusing this app.

• If you are not the owner of a hotspot, or you have not been authorized by the owner to upload the password and share it through WiFi Warden, you must not upload the password through our app and make it available to us and others.

• Before connecting to any Wi-Fi network, you must obtain permission from the network owner. If a hotspot has been shared through WiFi Warden, you have to assume that the owner is not satisfied with someone connecting to his/her Wi-Fi without gaining permission. You are solely responsible for abuse and unauthorized connection; the developer will not accept any responsibility in case of misusing this app.

When You share Your own Wi-Fi network with others, it is Your responsibility to make sure this action is not in violation with the terms and conditions of Your contract with Your Internet service provider (ISP) or a violation of any third party’s rights to the Wi-Fi network. If You can access a Wi-Fi network not owned by You, You may only share this network with others through WiFi Warden if You have got the owner’s permission for doing so and informed the owner of the WiFi Warden Terms. You and/or the owner must also make sure the owner’s contract with the ISP is not violated by Your sharing of the network. WiFi Warden does not in any way assume responsibility for Your or another users’ compliance with ISP terms and conditions. 

When You connect to the Internet through WiFi Warden and Wi-Fi networks that Our users have shared, You agree and warrant that you will not, and will not permit any third party to, consume excessive amounts of bandwidth, be it for uploading or downloading. You also agree and warrant that you will not, and will not permit any third party to, use WiFi Warden to access or distribute any illegal content. Further, You agree and warrant that you will not, and will not permit any third party to, invade other WiFi Warden users’ privacy, or attempt to gain unlawful access to other users’ networks and routers.

You are not allowed to attempt to gain unauthorized access to Our servers, computers, passwords, other Users’ accounts, User passwords, User data, or any other part or the whole of the Service.

You are also liable to us for any damages caused to us, or any third party, due to Your breach of these Terms of Service, including but not limited to the misuse of the Service. Furthermore, you agree to indemnify us in relation to any claims, costs (including reasonable legal costs) damages, expenses, liabilities and losses incurred by us arising in any manner in relation to Your breach of these Terms of Service.

Your Content

When you submit, upload, transmit or display any data, information, media or other content in connection with your use of WiFi Warden (“Your Content”), you understand and agree that:

• You will continue to own and be responsible for Your Content;

• You are giving us and our affiliate companies a perpetual, non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use Your Content (with no fees or charges payable by us to you) for the purposes of providing, promoting, developing and trying to improve WiFi Warden and our other services, including new services that we may provide in the future. All such use will, to the extent Your Content contains Personal Information, be in accordance with our WiFi Warden Privacy Policy. As part of this licence, we and our affiliate companies may, subject to the our WiFi Warden Privacy Policy, copy, reproduce, host, store, process, adapt, modify, translate, perform, distribute and publish Your Content worldwide in all media and by all distribution methods, including those that are developed in the future;

• You grant other WiFi Warden users a non-exclusive licence to access and use Your Content within WiFi Warden, in accordance with these Terms and WiFi Warden's functionalities;

• We may share Your Content with third parties that we work with to help provide, promote, develop and improve WiFi Warden in accordance with the WiFi Warden Privacy Policy;

• We may use the name that you submit in connection with Your Content (whether that be your account name, real name or otherwise); and

• You will comply with these Terms in your submission of Your Content.

In addition, you agree that we and our affiliate companies (subject to these Terms, our WiFi Warden Privacy Policy and applicable laws and regulations):

• are allowed to retain and continue to use Your Content after you stop using WiFi Warden;

• may be required to retain or disclose Your Content: (a) in order to comply with applicable laws or regulations; (b) in order to comply with a court order, subpoena or other legal process; (c) in order to respond to a lawful request by a government authority, law enforcement agency or similar body (whether situated in your jurisdiction or elsewhere); or (d) where we believe it is reasonably necessary to comply with applicable laws or regulations, in each case whether such applicable law or regulation, legal process or government body is of your jurisdiction or elsewhere;

• may be required to retain or disclose Your Content in order to enforce these Terms or to protect any rights, property or safety of ours, our affiliate companies or other users of WiFi Warden.

Removal Request

If you find Your own hotspot vulnerable to abuse, or you want to remove it from WiFi Warden online database, you can submit your removal request to wifiwarden@outlook.com. Please send your email with subject "Removal Request" and the MAC address (BSSID) and the name (SSID) of your hotspot in the body of your email. More information may be required after you send the email.  Not following the instructions will result in not removing your hotspot.

Advertising Content on WiFi Warden

WiFi Warden may include advertising or commercial content. You agree that: (a) we may integrate, display and otherwise communicate advertising or commercial content in WiFi Warden and that (where reasonably practicable) we will identify such advertising or commercial content; and (b) as explained in more detail in our WiFi Warden Privacy Policy, we may use targeted advertising to try to make advertising more relevant and valuable to you.

Ability to Accept Terms of Service

The App is intended for general audiences and is NOT directed to children.  If you are not old enough to have authority to agree to our Terms in your country, your parent or guardian must agree to these Terms (both for themselves and on your behalf) before you can use our services. 

Disclaimer of Warranty

Our services are provided "as is" and with all faults, and WiFi Warden disclaims all warranties, whether express, implied, statutory or otherwise, including without limitation, implied warranties of merchantability and fitness for a particular purpose. In addition, there is no warranty of accuracy of information, functionality, services and/or availability or lack thereof for the testing services and/or utilized pursuant to this agreement. There may be situations when the Service will not be accessible, including but not limited to necessary maintenance and circumstances outside our control, for which we shall never be liable.

Subscription and Refund Policy

Subscription

1. Subscription Plans: WiFi Warden offers various subscription plans, including monthly, bi-annual, and lifetime options. The details of these plans, including pricing and duration, will be presented to you before purchase.

2. Free Trial: If you start a subscription with a free trial, you will be charged at the end of the free trial period unless you cancel the subscription at least 24 hours before the trial period ends. The trial period duration and subsequent subscription pricing will be detailed at the time of sign-up.

3. Auto-Renewal: All subscriptions are automatically renewed at the end of their respective terms unless you turn off auto-renewal at least 24 hours before the end of the current subscription period. You can manage or turn off auto-renewal in your account settings.

Payment

1. Billing: Payments for subscriptions will be charged to your payment method at confirmation of purchase. For auto-renewing subscriptions, your account will be charged within 24 hours prior to the end of the current period.

2. Price Changes: We reserve the right to adjust pricing for our services or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes will take effect following notice to you.

Refunds

1. Refund Policy: Except as required by law, all subscription fees are non-refundable. There will be no refunds or credits for partial subscription periods, unless otherwise stated in the specific terms of a particular subscription.

2. Cancellation: You can cancel your subscription at any time. Your cancellation will take effect at the end of the current subscription period. You will not receive a refund for the current billing period, and you will continue to have access to the service through the end of your current subscription period.

3. Exception: If you believe you have been charged in error, please contact our customer support at wifiwarden@outlook.com within 30 days of the charge to request a review. We will review your request and determine, in our sole discretion, if a refund is warranted.

Termination

1. Termination by User: You may terminate your subscription at any time, and termination will be effective immediately. Upon termination, you will lose access to the features and content of the service for which you subscribed.

2. Termination by Us: We reserve the right to terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Updating These Terms

We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service or our social media accounts) at least 30 days before we make changes to these Terms and give you an opportunity to review them before they go into effect. Then, if you continue to use the Service, you will be bound by the updated Terms. If you do not want to agree to these or any updated Terms, you must stop using our services.
