Term of Use

These terms of use (“Terms”) apply to persons anywhere in the world (each such person, a “User” or “You”) who install, access or use the mobile application (“App”) published by Nuconcepts Holdings LLC (“WiFi Warden”,”Us” ,”Our” or “We”). PLEASE READ THESE TERMS CAREFULLY, AS THEY ARE A LEGAL AGREEMENT BETWEEN YOU AND WiFi Warden.

 

PLEASE READ THIS TERM OF USE CAREFULLY. BY USING, ACCESSING OR DOWNLOADING THE APP, YOU ACCEPT AND AGREE TO THE PRACTICES DESCRIBED IN THIS POLICY, ON BEHALF OF YOURSELF AND ALL PERSONS AND BUSINESSES FOR WHOM YOU ARE REPRESENTING.

 

Rights and Obligations of the User

When You share Your own Wi-Fi network with others, it is Your responsibility to make sure this action is not in violation with the terms and conditions of Your contract with Your Internet service provider (ISP) or a violation of any third party’s rights to the Wi-Fi network. If You can access a Wi-Fi network not owned by You, You may only share this network with others through WiFi Warden if You have got the owner’s permission for doing so and informed the owner of the WiFi Warden Terms. You and/or the owner must also make sure the owner’s contract with the ISP is not violated by Your sharing of the network. WiFi Warden does not in any way assume responsibility for Your or another users’ compliance with ISP terms and conditions. 

When You connect to the Internet through WiFi Warden and Wi-Fi networks that Our users have shared, You agree and warrant that you will not, and will not permit any third party to, consume excessive amounts of bandwidth, be it for uploading or downloading. You also agree and warrant that you will not, and will not permit any third party to, use WiFi Warden to access or distribute any illegal content. Further, You agree and warrant that you will not, and will not permit any third party to, invade other WiFi Warden users’ privacy, or attempt to gain unlawful access to other users’ networks and routers.

You are not allowed to attempt to gain unauthorized access to Our servers, computers, passwords, other Users’ accounts, User passwords, User data, or any other part or the whole of the Service.

You are also liable to us for any damages caused to us, or any third party, due to Your breach of these Terms of Service, including but not limited to the misuse of the Service. Furthermore, you agree to indemnify us in relation to any claims, costs (including reasonable legal costs) damages, expenses, liabilities and losses incurred by us arising in any manner in relation to Your breach of these Terms of Service.

Your Content

When you submit, upload, transmit or display any data, information, media or other content in connection with your use of WiFi Warden (“Your Content”), you understand and agree that:

Removal Request

If you find Your own hotspot vulnerable to abuse, or you want to remove it from WiFi Warden online database, you can submit your removal request to wifiwarden@outlook.com. Please send your email with subject "Removal Request" and the MAC address (BSSID) and the name (SSID) of your hotspot in the body of your email. More information may be required after you send the email.  Not following the instructions will result in not removing your hotspot.

Advertising Content on WiFi Warden

WiFi Warden may include advertising or commercial content. You agree that: (a) we may integrate, display and otherwise communicate advertising or commercial content in WiFi Warden and that (where reasonably practicable) we will identify such advertising or commercial content; and (b) as explained in more detail in our WiFi Warden Privacy Policy, we may use targeted advertising to try to make advertising more relevant and valuable to you.

Ability to Accept Terms of Service

The App is intended for general audiences and is NOT directed to children.  If you are not old enough to have authority to agree to our Terms in your country, your parent or guardian must agree to these Terms (both for themselves and on your behalf) before you can use our services. 

Disclaimer of Warranty

Our services are provided "as is" and with all faults, and WiFi Warden disclaims all warranties, whether express, implied, statutory or otherwise, including without limitation, implied warranties of merchantability and fitness for a particular purpose. In addition, there is no warranty of accuracy of information, functionality, services and/or availability or lack thereof for the testing services and/or utilized pursuant to this agreement. There may be situations when the Service will not be accessible, including but not limited to necessary maintenance and circumstances outside our control, for which we shall never be liable.

Updating These Terms

We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service or our social media accounts) at least 30 days before we make changes to these Terms and give you an opportunity to review them before they go into effect. Then, if you continue to use the Service, you will be bound by the updated Terms. If you do not want to agree to these or any updated Terms, you must stop using our services.
