These Terms of Service ("Terms") cover your use of Whoosh AI: Instant AI Video Maker ("Whoosh AI", "we", "us", or "our") and everything that comes with it (the "Service").
By using the Service, you accept these Terms, our Privacy Policy, and — if you buy a subscription or credits — our Subscription Terms. If you don't agree, please don't use the Service.
1. Who Can Use Whoosh AI
You must be at least 13 years old. If you're under the age of majority where you live, you may use the Service only with a parent's or guardian's involvement and consent.
2. What Whoosh AI Does
Whoosh AI is an AI tool for making short videos. It gives you three ways to create:
- Image to Video — turn a photo into a moving clip
- Text to Video — generate a clip from a written prompt
- Template Videos — start from a preset style
We may add, change, pause, or retire features at any time.
3. Your Content
3.1 You own it
You keep ownership of anything you upload or create ("User Content").
3.2 The permission you give us
You grant us a limited, non-exclusive, non-transferable license to process your User Content for one purpose only: to run the Service and deliver the output you request.
3.3 What we don't do with it
We do not use your User Content to train AI models. Processing is temporary and tied to the specific request you make.
3.4 You're responsible for it
You confirm you have the rights to the content you upload, and that it doesn't break the law or these Terms.
4. Rules of Use
Don't use Whoosh AI to create, upload, or share:
- Anything illegal
- Sexual or pornographic content
- Violent, abusive, or hateful content
- Content that involves minors inappropriately
- Content that infringes someone else's rights
- Misleading, fraudulent, or deceptive content
We may suspend or terminate accounts that break these rules.
5. Your Account
You're responsible for your account and for what happens under it. We may suspend an account for security risks, policy violations, or fraud.
6. Subscriptions, Credits & Payments
Some features need a paid subscription or credits.
- Payments are handled by Google Play.
- Subscriptions renew automatically unless you cancel.
- You can cancel anytime in your Google Play account settings; it takes effect at the end of the current billing period.
- Refunds follow Google Play's policies — we don't process payments directly.

7. Our Intellectual Property
Everything in the Service except your User Content — software, design, and the underlying AI systems — belongs to Whoosh AI or its licensors. You may not copy, modify, distribute, reverse engineer, or try to extract the source code.
8. Third-Party Services
The Service uses third-party providers such as cloud hosting, advertising SDKs, and analytics tools. We're not responsible for their services or their terms.
9. Ending Access
We may suspend or end your access if you break these Terms, if the law requires it, or if it's needed for security. You can stop using the Service whenever you want.
10. Disclaimers
The Service is provided "as is" and "as available." We don't guarantee that AI output will be accurate, or that the Service will always be uninterrupted or error-free. You use it at your own risk.
11. Limitation of Liability
To the maximum extent the law allows:
- We're not liable for indirect or consequential damages.
- Our total liability is limited to the amount you paid us, if any.
Nothing here removes rights that can't be excluded under applicable law.
12. Using the Service Abroad
You're responsible for following your local laws when you use the Service.
13. Changes to These Terms
We may update these Terms. If you keep using the Service after an update, that counts as accepting the new version.
14. Disputes & Governing Law
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING REQUIRING ARBITRATION AND WAIVING CLASS ACTIONS.
14.1 Governing law
These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules.
14.2 Talk to us first (30 days)
Before starting any formal claim, you agree to try to resolve it informally by emailing feedback@whoosh9.com. We'll try to resolve it with you within thirty (30) days.
14.3 Binding arbitration
If it isn't resolved within 30 days, any dispute arising out of or relating to these Terms or the Service will be settled by binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under its rules then in force. The seat of arbitration is Hong Kong. Either party may still bring a qualifying claim in small claims court.
14.4 No class actions
You and Whoosh AI agree that disputes will be handled only on an individual basis — not in a class, consolidated, or representative action.
