# Terms of Service for Weynilo

## 1. Agreement to Terms
By accessing or using the Weynilo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
*Weynilo* is a language learning application that provides lessons, exercises, and practice tools for learning Tigrinya and Amharic languages.
## 2. Eligibility
### Age Requirements
- *Users under 13*: Must have parental or guardian consent to use the App
- *Users 13-17*: May use the App but should have parental guidance
- *Users 18+*: May use the App independently
By using the App, you represent that you meet these age requirements or have obtained necessary parental consent.
## 3. Account Registration
### Creating an Account
- You must provide accurate, complete, and current information
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized access to your account
### Account Security
- Choose a strong password and keep it secure
- Do not share your account credentials with others
- We are not liable for losses caused by unauthorized use of your account
### Account Termination
- You may delete your account at any time through the app settings
- We may suspend or terminate your account if you violate these Terms
- Upon termination, all your data will be deleted within 30 days
## 4. User Conduct
You agree NOT to:
- Use the App for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the App's functionality
- Upload or transmit viruses, malware, or other malicious code
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Collect or harvest information about other users
- Use automated tools (bots, scrapers) to access the App
- Reverse engineer, decompile, or disassemble the App
- Remove or modify any copyright or proprietary notices
Violation of these rules may result in immediate account termination.
## 5. Content and Intellectual Property
### Our Content
All content in the App, including:
- Lessons, exercises, and learning materials
- Text, graphics, images, audio files, and mascot characters
- Software code, user interface, and design
- Trademarks, logos, and branding
is owned by Weynilo or our licensors and is protected by copyright, trademark, and other intellectual property laws.
### License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the App for personal, non-commercial educational purposes
- Download content temporarily for offline learning within the App
You may NOT:
- Copy, reproduce, or distribute our content outside the App
- Create derivative works based on our content
- Use our content for commercial purposes
- Remove copyright or attribution notices
### User Content
By submitting content to the App (progress data, feedback, etc.):
- You retain ownership of your content
- You grant us a worldwide, royalty-free license to use, store, and display your content to provide the service
- You represent that you have the right to submit such content
## 6. Subscription and Payments
### Free Tier
- Access to basic lessons and features
- Advertisements may be displayed
- Limited access to premium content
### Premium Subscription
*Monthly Subscription*: €4.99/month
*Yearly Subscription*: €39.88/year (save 33%)
Premium benefits include:
- Ad-free experience
- Access to all lessons and premium content
- Unlimited practice exercises
- Priority support
### Payment Terms
- Subscriptions are processed through Google Play
- Prices are in Euros (EUR) and may vary by region
- Payment is charged to your Google Play account upon purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage or cancel your subscription through Google Play settings
### Refund Policy
- Payments are handled by Google Play according to their refund policies
- Generally, refunds are available within 48 hours of purchase if no content has been consumed
- Contact Google Play support for refund requests

### Cancellation
- You can cancel your subscription at any time through Google Play
- Cancellation takes effect at the end of the current billing period
- You will retain premium access until the end of the paid period
- No partial refunds for unused subscription time
### Price Changes
- We may change subscription prices with 30 days' notice
- Price changes apply to new subscriptions and renewals after the notice period
- You can cancel before the price change takes effect
## 7. Free Trial (if applicable)
If we offer a free trial:
- Duration and terms will be clearly stated in the offer
- You may cancel before the trial ends to avoid charges
- If not canceled, you will be charged the subscription price when the trial ends
- Free trials are limited to one per user
## 8. Advertisements
### For Free Users
- The App displays advertisements from Google AdMob
- Ads are child-directed and G-rated (suitable for all ages)
- We do not use personalized advertising
- Ad revenue helps us maintain and improve the App
### Ad-Free Experience
- Premium subscribers do not see advertisements
- Upgrade to Premium to remove all ads
## 9. Privacy and Data Protection
Your privacy is important to us. Our data practices are governed by our [Privacy Policy](./PRIVACY_POLICY.md), which is incorporated into these Terms by reference.
Key points:
- We collect minimal personal information necessary to provide the service
- Your data is stored securely and encrypted
- We comply with GDPR, COPPA, and other privacy regulations
- You can request data deletion at any time
- We do not sell your personal information to third parties
## 10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- *Accuracy*: We strive for accuracy but do not guarantee error-free content
- *Availability*: We do not guarantee uninterrupted or error-free service
- *Language Proficiency*: Results may vary; we do not guarantee language mastery
- *Third-Party Content*: We are not responsible for third-party services or content
USE THE APP AT YOUR OWN RISK.
## 11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- *Direct Damages*: Our liability is limited to the amount you paid for the subscription in the past 12 months
- *Indirect Damages*: We are not liable for indirect, incidental, consequential, or punitive damages
- *Data Loss*: We are not liable for loss of data, profits, or opportunities
- *Service Interruption*: We are not liable for temporary service outages or disruptions
Some jurisdictions do not allow limitations on warranties or liability, so these limitations may not apply to you.
## 12. Indemnification
You agree to indemnify, defend, and hold harmless Weynilo and its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of any applicable laws
## 13. Changes to the Service
We reserve the right to:
- Modify, suspend, or discontinue any feature of the App at any time
- Update learning content and lesson materials
- Change or remove features with or without notice
- Terminate the service entirely (with 30 days' notice to paid subscribers)
Significant changes will be communicated through in-app notifications or email.
## 14. Changes to Terms
We may update these Terms from time to time. We will notify you by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date at the top
- Sending an in-app notification for material changes
Your continued use of the App after changes constitutes acceptance of the new Terms.
### Dispute Resolution
*Informal Resolution*: Before filing a claim, please contact us at weynilodev@outlook.com to attempt to resolve the dispute informally.
*Arbitration*: If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.
*Exceptions*: You may bring claims in small claims court if they qualify.
### Class Action Waiver
You agree to resolve disputes on an individual basis only, not as part of any class or representative action.
## 16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
## 17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Weynilo regarding the App and supersede all prior agreements.
## 18. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
## 19. Assignment
You may not assign or transfer these Terms or your account. We may assign these Terms to any successor entity.

If you download the App from Google Play:
- You acknowledge that these Terms are between you and Weynilo, not Google
- Google has no obligation to provide support or maintenance
- Google is not responsible for the App or its content
- Google is a third-party beneficiary of these Terms regarding your use of the App
## 22. Export Controls
You agree to comply with all applicable export and import laws and regulations. You may not use or export the App in violation of any laws.
## 23. Survival
Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, and limitations of liability) will survive termination of these Terms.
