These Terms of Use (“Terms”) govern your access to and use of the WatchOut mobile application (“WatchOut,” the “App,” “we,” “us,” or “our”).
By downloading, accessing, purchasing a subscription to, or using WatchOut, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you should not use the App.
WatchOut is an informational safety and incident-awareness application designed to help users discover incidents and public safety activity in their area.
Features may include:
nearby safety and incident alerts;
police, fire, and emergency-related incident information;
live public safety radio and scanner feeds;
maps showing nearby incidents;
incident details and reports;
notifications about relevant incidents;
audio, transcripts, or summaries associated with certain incidents; and
sharing functionality for incidents or radio stations.
Features and availability may vary depending on your location, device, data availability, and third-party services.
WatchOut is provided for informational and situational-awareness purposes only.
WatchOut is not an emergency service, law-enforcement service, fire department, emergency dispatch system, or replacement for official emergency communications.
Information displayed in the App may be delayed, incomplete, inaccurate, incorrectly categorized, unavailable, or outdated.
You should never rely solely on WatchOut when making decisions involving your personal safety or the safety of others.
If you are experiencing an emergency or believe someone is in immediate danger, contact 911 or the appropriate local emergency service directly.
WatchOut does not guarantee that every police, fire, crime, emergency, or public safety incident occurring in your area will appear in the App.
WatchOut obtains or processes incident and public safety information from third-party sources and services, which may include Incident Source, Broadcastify, RadioReference, public safety radio feeds, and other available data sources.
Certain information obtained from these sources may be processed and stored through WatchOut's backend infrastructure in order to provide the App's functionality.
WatchOut does not control all information originating from third-party sources and cannot guarantee its accuracy, completeness, availability, or timeliness.
An incident appearing in WatchOut should not automatically be interpreted as an official determination by police, fire departments, emergency services, or other authorities.
Third-party services may also be subject to their own terms, licenses, restrictions, and privacy policies.
WatchOut may provide access to live or near-live public police, fire, emergency, and public safety scanner feeds where such feeds are lawfully available.
Scanner feeds may originate from third-party providers and publicly available sources.
Feeds may experience delays, interruptions, inaccuracies, poor audio quality, missing transmissions, or temporary unavailability.
Radio communications may contain incomplete, preliminary, sensitive, disturbing, or rapidly changing information. Statements heard through a scanner feed should not be considered confirmed facts.
Users are responsible for complying with applicable laws concerning the use of scanner or public safety radio information.
WatchOut may request access to your device's location while you are using the App.
Your location is used to determine your approximate position on the map and to identify incidents relevant to your surrounding area.
WatchOut does not store your precise device location on our backend as part of this functionality.
Location access is intended to occur while you are actively using the App. You can control location permission through your device settings.
Disabling location access may prevent or limit nearby incident and map functionality.
WatchOut may send push notifications regarding incidents, safety information, product updates, or other relevant activity.
Notifications may be delayed, incomplete, or not delivered due to circumstances outside our control, including device settings, network connectivity, operating system restrictions, or third-party services.
Push notifications must not be relied upon as an emergency warning system.
You may manage notification permissions through your device settings.
WatchOut does not require a traditional account with an email address and password.
The App may generate or use a unique device or installation identifier to operate the Service, manage access, maintain application functionality, associate subscription-related information, prevent abuse, and provide relevant features.
The exact technical identifiers processed may depend on the device, operating system, and third-party services used by the App.
WatchOut uses third-party services to operate and improve the App. These may include:
Firebase;
Firebase Crashlytics;
Adapty;
Adjust;
Incident Source;
Broadcastify; and
RadioReference.
These services may process information according to their respective terms and privacy policies.
Firebase and Firebase Crashlytics may be used for analytics, diagnostics, crash reporting, and application performance.
Adapty may be used for subscription management, paywalls, and related analytics.
Adjust may be used for attribution, measurement, and analytics.
WatchOut may offer premium features through automatically renewing subscriptions.

Prices are displayed in the App before purchase and may vary by country, currency, taxes, or App Store pricing.
Payment will be charged to your Apple ID account upon confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. Your account may be charged for renewal within 24 hours before the end of the current period.
You can manage or cancel your subscription through your Apple ID subscription settings.
Deleting WatchOut does not automatically cancel an active subscription.
Any free trial or promotional offer, if available, will be subject to the conditions displayed at the time the offer is presented.
Purchases made through Apple's App Store are processed by Apple and are subject to Apple's applicable billing and refund policies.
WatchOut does not directly process or store your complete payment card information for App Store purchases.
Refund requests for App Store transactions are handled according to Apple's applicable refund procedures.
Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.
WatchOut may provide functionality allowing users to share links relating to incidents, radio stations, or other App content through services outside WatchOut.
The availability of this functionality may vary and certain sharing features may not yet be available in all versions of the App.
When you share content through a third-party application or service, your use of that service is governed by the third party's applicable terms and privacy practices.
You agree to use WatchOut only for lawful purposes.
You must not use information obtained through WatchOut to:
interfere with police, firefighters, emergency personnel, or emergency operations;
facilitate or conceal criminal activity;
harass, stalk, threaten, or endanger another person;
evade law enforcement;
misuse public safety communications;
attempt unauthorized access to WatchOut or its infrastructure; or
violate applicable local, state, federal, or international law.
We may restrict or terminate access where we reasonably believe the App is being abused, compromised, or used unlawfully.
WatchOut is provided on an “AS IS” and “AS AVAILABLE” basis to the maximum extent permitted by applicable law.
We do not guarantee that:
incidents will be reported in real time;
every nearby incident will be detected or displayed;
incident locations will always be exact;
scanner feeds will always be available;
transcripts or summaries will always be accurate;
notifications will always arrive on time; or
information obtained from third parties will always be correct.
WatchOut should be treated as a supplemental informational resource rather than an authoritative source of emergency information.
To the maximum extent permitted by applicable law, WatchOut and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from your use of or reliance upon the App.
This includes losses resulting from inaccurate, delayed, unavailable, or incomplete incident information, scanner feeds, notifications, locations, transcripts, or other information provided through WatchOut.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
Your use of WatchOut is also subject to our Privacy Policy.
The Privacy Policy describes how information associated with the App, including device identifiers, analytics and diagnostic information, subscription information, and location-related functionality, is handled.
We may update, modify, add, suspend, or discontinue features of WatchOut from time to time.
Some features depend on third-party data providers, public safety feeds, operating system capabilities, or other services outside our control. Consequently, a particular feed, incident source, location, or feature may become unavailable without notice.
We may also update these Terms from time to time. The “Last Updated” date will indicate the most recent revision.
You may stop using WatchOut at any time.
We may suspend or terminate access to the Service where reasonably necessary due to misuse, violation of these Terms, security concerns, legal requirements, or conduct that may harm WatchOut, its users, or third parties.
Deleting the App or terminating access does not automatically cancel an active App Store subscription.
If you obtain WatchOut through the Apple App Store, you acknowledge that these Terms are between you and WatchOut, not Apple Inc.
Your use of WatchOut must comply with applicable App Store terms and policies.
Where applicable, your use of the App is also subject to Apple's Standard Licensed Application End User License Agreement.

Apple and its subsidiaries may be third-party beneficiaries of these Terms to the extent applicable to the App distributed through the Apple App Store.
These Terms are governed by applicable laws of the United States, subject to any mandatory consumer protection laws or other rights applicable in your jurisdiction.
Nothing in these Terms is intended to waive rights that cannot legally be waived.
