The App provides AI-powered image analysis services, allowing users to analyze and interpret visual content.

3. User Registration

You may be required to create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account information and are solely responsible for all activities that occur under your account.

4. In-App Purchases

a. Subscription Plans: The App offers in-app subscription plans with various features and benefits. By subscribing to a plan through the app store (e.g., Apple App Store, Google Play Store), you agree to pay the applicable fees and abide by the terms specified for that plan.

b. Billing and Payments: When you subscribe through the app store, you authorize the respective app store provider to charge the specified subscription fees to your associated account. Subscription fees are billed in advance and are subject to the terms and conditions of the app store.

c. Automatic Renewal: Unless you cancel your subscription through the app store before the end of the current billing period, your subscription will automatically renew, and you will be charged the applicable fees for the next billing period.

d. Cancellation: You may cancel your subscription through the app store at any time. The cancellation will take effect at the end of the current billing period.

5. User Conduct

You agree not to:

a. Violate any applicable laws or regulations;

b. Infringe upon the rights of others;

c. Use the App for any illegal or unauthorized purpose;

d. Attempt to access, interfere with, or disrupt the App's servers or networks;

e. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

6. Intellectual Property

The App and its content, features, and functionality are owned by 'Visionly AI' and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on the App without our express written consent.

7. User Content

By using the App, you grant Visionly AI a non-exclusive, royalty-free, worldwide, transferable license to use, display, and analyze any content you submit through the App for the sole purpose of providing the services.

8. Privacy

Your privacy is important to us. Please refer to our Privacy Policy to understand how we collect, use, and disclose information about you.

9. Termination

We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice, for any reason, including violation of these Terms.

10. Disclaimer of Warranty

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be error-free, uninterrupted, secure, or meet your requirements.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Visionly AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands and international law.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. The date of the latest revision will be indicated at the top of these Terms.

By continuing to use the App after any modifications, you agree to be bound by the revised Terms.
