STUDENT and PARENT / GUARDIAN TERMS OF SERVICE - DOCUMENT 1

Disclaimer

Virtual Study Coach does not record sessions. We rely upon the Study Coaches to fulfill their responsibilities and duties as outlined in the Study Coaches Contract and to abide by applicable laws and the policies on this page. If we determine a Study Coach has violated our policies, the Study Coach will be removed from our program. We do not guarantee educational results.

Liability

I agree to waive and relinquish all current and unknown future claims against Virtual Study Coach and its officers, agents, employees, and Study Coaches. I agree to indemnify Virtual Study Coach and its officers, agents, employees, and Study Coaches and hold them harmless from any and all claims whether incurred directly or indirectly, resulting from participation with Virtual Study Coach and its services.

Agreement

Participants, students, parents and legal guardians agree to comply with all Virtual Study Coach policies. In the event, I or my child breaks any policy of Virtual Study Coach, I or my child will be removed from the program. In signing this form, I waive all legal liability. Other terms and conditions include and are not limited to the following:

• Students under the age of 18 can only participate in Virtual Study Coach with the consent of their parent or guardian.

• Students consent to participate in Virtual Study Coach services conducted over video.

• Students will not request nor meet in person with their Study Coaches at any point.

• Students will not request that their study session(s) be recorded nor will any study sessions be recorded.

• Students may be asked to provide feedback on their study session and should report in good faith on their experiences.

• Students understand that bullying will result in their immediate dismissal from Virtual Study Coach activities. Our definition of bullying includes but is not limited to:

Posting, typing, saying, or writing things that are aggressive, harmful, humiliating, or repetitive and unwanted. Bullying includes but is not limited to: Teasing, Name-calling, Inappropriate sexual comments, Taunting, Threatening to cause harm.

• Students understand that the views and opinions expressed during Virtual Study Coach services reflect only the views and opinions of the speaker. They do not purport to reflect the views and opinions of Virtual Study Coach or its officials.

• In signing the Student and Parent Contract (Form A), I release Virtual Study Coach and any of its officials and Study Coaches from all liability, costs, and damages of any kind or nature whatsoever that may arise from or in any way relate to my or my child’s participation in Virtual Study Coach.

PRIVACY POLICY - DOCUMENT 2

Virtual Study Coach is committed to protecting your right to privacy and safeguarding your personal information. This privacy policy applies to information collected from parents and students: Enrollment Form Data, Post-Game reports, Emails, Study Coaches Feedback, Social Media Engagement, etc.

Any information we collect is used solely to provide the best Virtual Study Coach experience. Further communication may be needed to allow for Virtual Study Coach officials to request feedback, improve delivery and enforce terms and conditions. We will not knowingly share your information with third parties. In the event aggregate data is shared with third parties, no individual and identifiable information will be shared. Our current online coach is Google LLC.

STUDY PARTNER CONTRACT - DOCUMENT 3

Those fulfilling the position of "Study Coach" serve in the capacity of a Virtual Study Coach employee. Failure to comply with the Study Coaches Contract may result in dismissal from Virtual Study Coach. Study Coaches assume total liability for any consequences of their actions. Study Coaches are assigned based on their availability and decisions of Virtual Study Coach assignments are final. The Virtual Study Coach Contract contains the following stipulations:

1. Study Coaches will not meet in person with their students at any point in the Virtual Study Coach program.

2. Study Coaches will not record any study hall session.

3. Study Coaches must be forthright with Virtual Study Coach regarding their resume, credentials, qualifications, and degrees.

4. Study Coaches will be interviewed by Virtual Study Coach officials prior to their initial assignment.

5. Study Coaches may not share content with students that is unwanted, contains vulgarity, sexual images, graphic violence, threats, hate speech, or incitements to violence.

6. Study Coaches will communicate student concerns to Virtual Study Coach officials in a timely manner.

7. Study Coaches may be dismissed at any time if found in violation of any given policy of Virtual Study Coach.

8. Study Coaches may be current college students, or those enrolled in accredited degree-granting programs. Those who have completed a higher educational degree are preferred. Preference will be given to those with educational credentials and experience.

I also acknowledge that I have read, understand, and agree to the Study Coaches Contract and the legal terms and conditions, as written on the Virtual Study Coach website.

VIRTUAL STUDY HALL RELEASE AND WAIVER OF LIABILITY- DOCUMENT 4

I release from any and all liability, waive and discharge and agree not to sue Virtual Study Coach, and any of its officers, agents, employees, Study Coaches, and students (the “releasees”) for any liability, claim and/or cause of action arising out of, related to, or perceived to be related to any loss, damage or injury, including death, or outcome arising out of or resulting from my or my child’s/children’s participation in Virtual Study Coach.

I assume full responsibility for any risk, property damage, or personal injury that may be sustained by me or my child/children's participation in Virtual Study Coach. I further agree to indemnify and hold harmless the releasees whether injury is caused by my or my child’s/children’s negligence, the negligence of the releasees or the negligence of any third party.

This release and waiver of liability, assumption of risk, and indemnification shall be construed in accordance with the laws of the State of New York. By electronically signing the Virtual Study Coach Student and Parent Contract (FORM A), I state that I have read, understand, and agree to the conditions set forth herein and that I sign this form freely and voluntarily. Virtual Study Coach Student and Parent Contract (Form A) is signed on behalf of myself and my child or children.

Note: Both student and parent or legal guardian will need to agree to these terms in order to participate in Virtual Study Coach if the student is below the age of 18.
