The surrogacy cost in India can vary widely depending on several factors, including the chosen surrogacy clinic or agency, medical procedures, legal fees, and additional expenses. On average, the total cost of a surrogacy journey in India can range from $20,000 to $40,000.

For hopeful parents in India, grappling with fertility challenges was not only emotionally taxing but also compounded by the absence of state support for surrogacy solutions. This persisted until April 2020, marked by the enactment of The Child-Parent Security Act: Gestational Surrogacy. This legislation mandates and ensures:

1.      Legal Parental Link: The child is legally connected to its parents from birth.

2.      Surrogate Criteria: All surrogates must be at least 21 years old and emotionally and physically capable.

3.      Autonomy for Surrogates: Surrogate mothers retain full control over their health decisions during pregnancy.

4.      Financial Responsibilities: Intended parents cover fees for surrogate lawyers and health insurance costs throughout pregnancy and for one year post-birth.

5.      Psychiatric Care: Prospective parents bear expenses for any needed psychiatric care for the surrogate.

6.      Life Insurance: A life insurance policy, funded by intended parents, covers the surrogate until treatment initiation and one year post-delivery.

7.      Right to Terminate: Surrogate mothers can withdraw from the agreement until actual pregnancy.

8.      Legal Protections: Children born under this arrangement are legally safeguarded for financial and general care.

The Act is inclusive, extending family formation facilitation to LGBT couples. Even if a partner lacks a genetic link to the child, the child automatically belongs to the couple, regardless of marital status. This provision is particularly liberating for gay couples, enabling parenthood without resorting to adoption. Sperm donation regulations also secure single mothers, legally binding their child from birth.
