Terms of Service — VineGuide | Taste

These Terms of Service ("Terms") govern your use of WineGuide | Taste ("the App"), developed and operated by Kello Solutions ("we", "our", or "us").

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree with these Terms, please do not use the App.

1. About VineGuide | Taste

WineGuide | Taste is a wine discovery and educational application designed to help users:

• Identify wines from bottle labels

• Explore wine information

• Discover food and wine pairings

• Ask questions through the Sommelier feature

• Save wines to a personal wine list

• Learn about wine through educational content

• Discover daily wine combinations and wine facts

The App does not require a user account.

2. Wine Information Is for General Information Only

Information provided by WineGuide | Taste is intended for general educational and entertainment purposes.

Wine descriptions, tasting notes, pairing suggestions, serving recommendations, regional information, and other content may be generated or assisted by automated systems and third-party services.

Although we aim to provide useful and accurate information, we do not guarantee that information provided by the App is complete, accurate, current, or error-free.

You should use your own judgment when selecting, purchasing, serving, or consuming wine.

3. AI-Powered Features

Certain App features may use artificial intelligence and third-party AI services to analyze wine labels, answer questions, generate wine descriptions, and provide recommendations.

AI-generated information may sometimes be incorrect, incomplete, or misleading.

You should not rely on AI-generated information as the sole source for decisions involving:

• Alcohol consumption

• Allergies or dietary restrictions

• Medical conditions

• Medication interactions

• Pregnancy

• Driving or operating machinery

• Other health or safety matters

Always verify important information through appropriate professional or authoritative sources.

4. Alcohol and Responsible Use

WineGuide | Taste does not encourage excessive or irresponsible alcohol consumption.

The App does not sell or supply alcohol.

You are solely responsible for complying with the laws applicable to you regarding the purchase, possession, and consumption of alcohol.

Do not drink and drive or operate machinery while impaired.

If you are under the legal drinking age in your jurisdiction, you must not use the App for the purpose of purchasing or consuming alcoholic beverages.

5. Camera and Wine Scanning

The App may allow you to photograph or upload wine labels for identification and analysis.

Wine recognition results are provided for informational purposes only.

We do not guarantee that every bottle, label, vintage, winery, grape variety, region, or other wine characteristic will be correctly identified.

Factors such as image quality, lighting, label design, vintage changes, and incomplete information may affect results.

6. My Wine List

The App may allow you to save wines and maintain a personal wine list.

This information may be stored locally on your device.

You are responsible for maintaining appropriate backups if you want to preserve this information.

We are not responsible for the loss of locally stored wine-list information caused by device failure, deletion of the App, operating-system changes, device replacement, or other circumstances outside our control.

7. Sommelier Feature

The Sommelier feature provides automated wine-related answers and recommendations.

It does not constitute professional advice from a certified sommelier, nutritionist, doctor, or other professional.

Recommendations may not account for your personal circumstances, allergies, dietary restrictions, health conditions, medications, or other individual factors.

Always verify information that may affect your health or safety.

8. Subscriptions and In-App Purchases

WineGuide | Taste may offer optional premium subscriptions or other in-app purchases.

Subscriptions are purchased through Apple's App Store.

Prices, billing periods, and available plans are displayed before purchase.

Unless otherwise stated, subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period.

Your Apple ID account will be charged according to Apple's applicable billing terms.

You can manage or cancel subscriptions through your Apple App Store account settings.

Deleting the App does not necessarily cancel an active subscription.

Refunds are handled according to Apple's applicable policies.

9. Free and Premium Features

Certain features may be available only to premium subscribers.

We reserve the right to modify, add, remove, or change free and premium features at any time.

Changes to features do not automatically entitle users to refunds unless required by applicable law.

10. Acceptable Use

You agree not to:

• Use the App for unlawful purposes

• Attempt to interfere with or disrupt the App

• Reverse engineer or attempt to extract source code from the App

• Circumvent subscription or access controls

• Use automated systems to abuse the App

• Attempt to gain unauthorized access to systems or services connected to the App

• Use the App to violate the rights of others

• Upload malicious or harmful content

• Misuse third-party AI functionality

We may restrict or terminate access to features if we reasonably believe the App is being misused.

11. Intellectual Property

The App, including its software, interface, branding, design, graphics, text, logos, and original content, is owned by or licensed to Kello Solutions and is protected by applicable intellectual property laws.

You may use the App for personal, lawful purposes.

You may not copy, reproduce, modify, distribute, sell, lease, sublicense, or commercially exploit the App or its content without our prior written permission, except where permitted by law.

12. User-Provided Content

If you submit photos, questions, notes, or other content through the App, you represent that you have the right to submit that content.

You remain responsible for the content you provide.

You should not upload content that infringes another person's intellectual property, privacy, or other legal rights.

13. Third-Party Services

The App may rely on third-party services, including AI providers, analytics services, subscription-management services, Apple's App Store services, and other technical providers.

Third-party services may have their own terms, privacy policies, and limitations.

We are not responsible for the availability, accuracy, security, or policies of third-party services.

14. Availability of the App

We aim to keep WineGuide | Taste available and functional, but we do not guarantee that the App will always be available, uninterrupted, or error-free.

The App may occasionally be unavailable because of:

• Maintenance

• Updates

• Technical problems

• Third-party service outages

• Network issues

• Device or operating-system limitations

• Circumstances beyond our reasonable control

We may modify or discontinue parts of the App at any time.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, VineGuide | Taste is provided on an "as is" and "as available" basis.

We do not guarantee that:

• The App will always function without interruption

• Wine identification will always be accurate

• Wine information will always be complete or current

• AI-generated answers will always be correct

• Pairing recommendations will be suitable for every user

• The App will be compatible with every device or operating system

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

16. Limitation of Liability

To the maximum extent permitted by law, Kello Solutions will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.

This includes, without limitation, damages resulting from reliance on wine information, AI-generated recommendations, wine identification results, loss of locally stored data, or interruptions to third-party services.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Kello Solutions from claims, liabilities, damages, losses, and expenses arising from your unlawful use of the App, violation of these Terms, or infringement of another person's rights.

18. Termination

You may stop using the App at any time by deleting it from your device.

We may suspend or discontinue access to the App or specific features if necessary for security, legal, technical, or operational reasons.

Termination does not affect provisions that by their nature should continue after termination, including intellectual property, disclaimers, limitations of liability, and applicable legal provisions.

19. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how information is handled.

The Privacy Policy is available through the App and describes the use of camera/photos, AI services, analytics, subscriptions, and other applicable data processing.

20. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the Effective Date at the top of this document.

Your continued use of the App after updated Terms become effective means that you accept the revised Terms, to the extent permitted by applicable law.

21. Governing Law

These Terms are governed by the laws applicable to Kello Solutions, except where mandatory consumer-protection laws provide otherwise.

Nothing in these Terms is intended to remove or limit any mandatory rights you may have under the laws of your country or region.
