VGT - Terms of Service

By downloading or using Video Game Tracker - VGT, you agree to be bound by:

The Apple Standard End User License Agreement (EULA), available at:
https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
And the following supplemental Terms of Use, which apply specifically to Video Game Tracker - VGT.

If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA controls to the extent required by Apple or applicable law.

If you do not agree to these Terms, do not use VGT.

1. The Service

VGT helps users discover video games and privately maintain a game library, wishlist, progress history, play-session information, notes, and related insights.

Some VGT features are available without payment. Other features require an active VGT Pro subscription or verified legacy access.

The App does not create or operate a separate VGT user account.

2. Eligibility

You must be legally permitted to use the App and agree to these Terms.

If you are not old enough to enter into a binding agreement where you live, you may use the App only with the permission and supervision of a parent or legal guardian.

3. Licence and Permitted Use

Subject to these Terms and the Apple Standard EULA, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to use VGT for personal, non-commercial purposes on Apple devices that you own or control.

You may not:

Copy, sell, rent, sublicense, or redistribute the App except where applicable law expressly allows it
Reverse engineer or attempt to extract the App’s source code except where applicable law expressly permits it
Interfere with the App, its server, security protections, or rate limits
Use automated systems to scrape or overload the App or its services
Attempt to obtain unauthorized access to our server, Firebase configuration, IGDB services, or another user’s information
Use the App for unlawful, abusive, or fraudulent purposes
Circumvent limitations applied to free or subscription features

4. Free Access

The free version of VGT may impose limits on the number of saved games and may exclude features such as iCloud Sync or advanced insights.

Current limits and included features are described within the App.

We may adjust free features for future use, provided that changes comply with applicable law.

5. VGT Pro Subscriptions

VGT may offer monthly and annual auto-renewable subscriptions under the name “VGT Pro.”

An active VGT Pro subscription may provide features including:

Unlimited game tracking
iCloud Sync across eligible devices
Completion insights
Platform insights
Other Pro features identified within the App

The exact subscription duration, localized price, trial or introductory offer, and included features are displayed before you confirm a purchase.

6. Billing and Automatic Renewal

VGT Pro subscriptions are processed through Apple’s App Store.

Payment is charged to your Apple Account when you confirm the purchase.

The subscription automatically renews for another period of the same duration unless you cancel it before the renewal is processed.

Apple controls billing, renewal timing, taxes, currency conversion, and payment methods.

We do not receive or store your complete payment details.

You can manage or cancel your subscription through your Apple Account subscription settings.

Deleting VGT does not automatically cancel an active subscription.

Cancelling prevents future renewals. Unless required by law or Apple’s policies, cancellation does not provide a retroactive refund and you will generally retain access until the end of the paid subscription period.

7. Trials and Introductory Offers

Apple may make a free trial or introductory offer available to eligible users.

The duration and price after the offer are displayed before purchase.

Unless cancelled before the trial or offer ends, the subscription automatically converts to a paid subscription at the displayed price.

Eligibility for trials and introductory offers is determined by Apple.

Offers may be changed or withdrawn where permitted by Apple and applicable law.

8. Subscription Management and Restoration

VGT provides a Restore Purchases function and may provide access to a subscription-management interface.

You may also manage the subscription through your Apple Account settings.

If subscription access does not appear after purchase, use Restore Purchases and confirm that the device is signed in to the Apple Account used for the purchase.

9. Refunds

Apple processes all VGT Pro payments and refund requests.

Refund eligibility is determined by Apple under its policies and applicable law.

You can request a refund through Apple at:

Nothing in these Terms limits mandatory refund or consumer-protection rights that apply where you live.

10. Legacy Access

Users whose original verified App Store version predates the introduction of subscriptions may receive legacy access to features identified by VGT.

Legacy eligibility is determined using Apple’s verified app transaction information.

Legacy access does not create a VGT account, cannot be sold or transferred separately, and may depend on continued verification through the relevant Apple Account.

Legacy access does not include a right to every future paid product or service unless we expressly state otherwise.

11. User Data and iCloud

Information you create in VGT is stored locally unless you enable iCloud Sync or choose to export or share it.

When iCloud Sync is enabled, eligible VGT data is stored in the private CloudKit database associated with your Apple Account.

Apple operates iCloud, and its availability and operation are subject to Apple’s terms.

You are responsible for maintaining access to your device, Apple Account, and iCloud configuration.

You should maintain appropriate backups.

Although VGT includes synchronization and recovery safeguards, we cannot guarantee that data will never be lost, corrupted, or unavailable.

12. Notes and User Content

You retain ownership of notes and other content you enter into VGT.

You are responsible for that content and must not use VGT to store or export information unlawfully or in a way that violates another person’s rights.

VGT is not intended to store:

Passwords
Payment-card information
Government identifiers
Medical records
Other highly sensitive information

13. Exported Data

If you export data from VGT, you are responsible for the exported file after it leaves the App, including:

Where it is stored
Who it is shared with
How it is deleted

We are not responsible for the practices of another app or service that receives an exported file at your direction.

14. Third-Party Services and Content

VGT relies on third-party services that may include:

Apple
iCloud
The App Store
RevenueCat
Google Firebase
IGDB
Twitch
YouTube

Game titles, artwork, descriptions, ratings, trailers, and other third-party content belong to their respective owners and are provided for identification and informational purposes.

Third-party content may be inaccurate, incomplete, delayed, removed, or unavailable.

We do not guarantee the accuracy or continued availability of third-party data or services.

Opening an external link makes your interaction subject to the third party’s terms and privacy policy.

15. Intellectual Property

VGT’s original software, design, branding, graphics, and functionality are owned by or licensed to us and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of VGT or third-party game content to you.

16. App and Service Changes

We may update VGT to:

Add, modify, or remove features
Address security, legal, or technical requirements
Maintain compatibility
Improve the service

We may discontinue a feature or service where reasonably necessary.

If a change materially affects an active paid subscription, we will handle it in accordance with applicable law and Apple’s requirements.

Updates may be required for continued operation.

17. Availability

VGT and its supporting services are provided on an “as available” basis.

Search, discovery, game metadata, artwork, subscriptions, iCloud Sync, and external content may be interrupted because of:

Network conditions
Maintenance
Service-provider changes
Events beyond our reasonable control

We do not guarantee uninterrupted or error-free availability.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, VGT is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.

We do not warrant that VGT will always be:

Available
Error-free
Secure
Accurate
Suitable for a particular purpose

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for:

Indirect damages
Incidental damages
Special damages
Consequential damages
Punitive damages
Loss of profits
Loss of opportunities
Loss of data
Service interruptions

arising from your use of VGT.

Where liability cannot be excluded, it is limited only to the extent permitted by applicable law.

These limitations do not apply where prohibited by law.

20. Suspension and Termination

You may stop using VGT at any time.

Stopping use or deleting the App does not automatically cancel an App Store subscription.

We may restrict access to our server or terminate your licence to use VGT if you:

Materially violate these Terms
Misuse the service
Attempt unauthorized access
Create a security or legal risk

Termination does not remove rights or obligations that by their nature should continue, including:

Intellectual-property rights
Disclaimers
Limitations of liability

21. Changes to These Terms

We may update these Terms to reflect changes to VGT, subscriptions, service providers, or legal requirements.

The latest version will be published at this URL with an updated effective date.

Continued use after updated Terms take effect constitutes acceptance where permitted by law.

Material changes will receive additional notice where appropriate.
