These Terms of Service ("Terms") govern your use of the EyeGuardian application ("the App") available for macOS, including both the Lite and Pro versions. By using EyeGuardian, you agree to these Terms. If you disagree with any part of the terms, you may not use our App.
EyeGuardian grants you a limited, non-transferable, non-exclusive license to download and use the App on any Mac device that you own or control and as permitted by the Mac App Store Terms of Service.
This license does not allow you to:
Modify, disassemble, decompile or reverse engineer the App
Remove, alter or obscure any proprietary notice or labels
Use the App in any way that violates applicable laws
Distribute or make the App available over a network where it could be used by multiple devices
EyeGuardian is available in two versions:
EyeGuardian Lite: Free version with basic timer functionality and limited features.
EyeGuardian Pro: Paid version with additional features, accessed through in-app purchase.
Access to Pro features requires payment of the applicable fee. Payment is processed through the Apple App Store, and all billing terms are governed by your agreement with Apple.
EyeGuardian is designed as a tool to help remind users to take eye breaks. The App:
Is not a medical device
Does not diagnose, treat, cure, or prevent any disease or health condition
Is not a substitute for professional medical advice or treatment
You should consult with a healthcare professional for any eye health concerns.
The App may automatically download and install updates from time to time. These updates are designed to improve, enhance, and further develop the App and may include bug fixes, enhanced functions, new software modules, and completely new versions. You agree to receive such updates as part of your use of the App.
The App, including all content, features, and functionality, is owned by EyeGuardian and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.
To the maximum extent permitted by applicable law, in no event shall EyeGuardian be liable for any indirect, punitive, incidental, special, consequential damages, or any damages whatsoever including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the App.
These Terms shall be governed by the laws of [Your Jurisdiction], without respect to its conflict of laws principles.
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
