These Terms of Service govern your use of the Uyarix mobile application (the “App”).
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree with them, you should not use the App.
Please also review the Uyarix Privacy Policy. These Terms and the Privacy Policy are available through the App’s Settings and online.
Uyarix is an educational application designed to help users practice basic English vocabulary through audio, images, review activities, games, and writing exercises.
The App is intended for lawful use consistent with its personal and educational purpose.
Subject to these Terms and the applicable Google Play terms, you may download and use the App for its intended purpose.
Downloading or using the App does not transfer ownership of its source code, logo, original texts, software implementation, content organization, or other protected elements to the user.
Nothing in these Terms limits any mandatory rights granted by applicable law or the Google Play terms.
The App includes original software and materials created for Uyarix, as well as third-party and open-source components used under their applicable licenses.
The developer owns or is authorized to use the materials included in the App and claims rights only to the extent permitted by applicable intellectual property law.
The developer-created portions of the App’s source code, logo, original instructional texts, original software implementation, original audio effects, and the protectable visual, textual, audio, and interactive elements created for Uyarix belong to or are licensed to the developer of Uyarix. Where protected by applicable law, this may also include the original selection, arrangement, and presentation of its vocabulary, categories, activities, and related materials.
Some visual materials and vocabulary audio included in the App were created or edited with the assistance of artificial intelligence tools and are used in accordance with the applicable provider terms. Other audio effects were created by the developer using audio production software.
To the extent permitted by applicable law, the developer may hold rights in the human-created elements, original audio effects, and original edits made to those materials.
Third-party and open-source software libraries, services, trademarks, and other third-party materials remain governed by the rights and licenses of their respective owners.
Except as permitted by applicable law or applicable third-party and open-source licenses, you may not:
Copy, modify, reproduce, sell, sublicense, or commercially distribute the developer-owned portions of the App, including its original source code, logo, original texts, original software implementation, or other protected elements.
Extract, copy, compile, or redistribute substantial protected portions of the App’s developer-created source code, images, audio, original texts, original screen layouts and compositions, or other protected assets.
Combine or reproduce substantial protected elements of the App to create a replica or substantially similar copy of Uyarix.
Use the Uyarix name, logo, screenshots, or visual identity in a way that falsely suggests affiliation with or authorization by Uyarix.
Remove or alter any ownership, copyright, license, or attribution notice included in the App.
These Terms do not claim exclusive ownership over individual English words, translations, common categories, common interface elements, general educational ideas, learning methods, or other elements that are not protected by applicable intellectual property law.
You agree not to:
Use the App for unlawful, fraudulent, abusive, or harmful purposes.
Decompile, disassemble, reverse engineer, or attempt to obtain the source code of the developer-owned portions of the App, except as permitted by applicable law or applicable third-party and open-source licenses.
Attempt to gain unauthorized access to user accounts, Firebase databases, servers, networks, or systems connected to the App.
Interfere with the security, availability, or normal operation of the App.
Use bots, scripts, modified versions, or automated systems to manipulate stars, streaks, progress, purchases, or statistics.
Bypass or interfere with advertising, authentication, purchase validation, or security features.
Access or attempt to access another user’s account without authorization.
Users are responsible for taking reasonable steps to protect access to their accounts and login credentials.
You may request deletion of your Uyarix account through the option available within the App or through the public account-deletion page available online.
Deleting an account may permanently remove synchronized progress, stars, streak information, and other account data, as explained in the Privacy Policy.
The free version of Uyarix may display advertisements provided through third-party advertising services.
The App may offer an optional one-time purchase to remove advertisements. Purchases are processed and managed through Google Play and are subject to Google Play’s payment, restoration, and refund rules, as well as applicable consumer law.
The purchase may be associated with the Google Play account used to complete it.
Deleting a Uyarix account, uninstalling the App, or clearing local App data does not by itself refund the purchase.
Access to the ad-removal purchase may be restored using the Google Play account originally used to complete it, subject to Google Play’s applicable rules and technical availability.
Uyarix is an educational support tool.
The App does not guarantee language fluency, specific academic or professional results, employment outcomes, or success in an official language examination.
Learning results may vary depending on practice frequency, prior knowledge, individual circumstances, and how the App is used.
The App is provided on an “AS IS” and “AS AVAILABLE” basis.
There is no guarantee that the App will always be uninterrupted, completely secure, error-free, or compatible with every device.
Internet interruptions, device failures, synchronization errors, software updates, technical problems, or third-party service outages may affect the App, its features, or stored progress.
To the maximum extent permitted by applicable law, the developer of Uyarix will not be liable for indirect, incidental, special, or consequential damages arising from the use of or inability to use the App.
Nothing in these Terms excludes or limits any consumer right, warranty, or liability that cannot legally be excluded or limited.
The App uses third-party services that may include Google Firebase, Google AdMob, Google Play services, Google Play Billing, and the User Messaging Platform.
These services are governed by their own terms, policies, and technical conditions. Their availability and operation may be outside the reasonable control of the developer of Uyarix.

The developer may take reasonable measures, including restricting or suspending access to an account where technically available, when there is a reasonable belief that the user has:
Violated these Terms.
Attempted to compromise the security or operation of the App.
Manipulated progress, advertising, authentication, or purchase systems.
Engaged in fraudulent or unlawful activity.
Reasonable action may be taken when necessary to protect users, accounts, the App, its systems, or third-party services.
Uyarix is intended for adolescents and adults aged 13 and older and is not directed to children under 13.
Users aged 13 or older who are not legally able to accept these Terms independently in their country should use the App with the authorization of a parent or legal guardian where required by applicable law.
The App, its features, and these Terms may be updated from time to time for maintenance, security, technical changes, legal compliance, or service improvements.
Updated Terms will be published online with a revised Effective Date.
Where required by applicable law, material changes will be communicated through the App or another appropriate method.
If you do not agree with an updated version of these Terms, you should stop using the App and may request deletion of your account.
These Terms are governed by the laws of Peru.
This provision does not remove or limit any mandatory consumer protection that may apply under the laws of the user’s country of residence.
