These Terms & Conditions ("Terms") govern your use of Uppercut (the "App"), an iOS boxing training application. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
By accessing or using Uppercut, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated into these Terms by reference. We may update these Terms from time to time as described in Section 12; continued use of the App after changes take effect constitutes acceptance of the revised Terms.
Uppercut is intended for users aged 13 and older. By using the App, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you should review these Terms with a parent or guardian.
Uppercut is a training tool, not medical advice. Consult a physician before beginning any exercise program, especially if you have a pre-existing health condition, injury, or concern about your ability to engage in physical activity.
Uppercut guides you through punching and movement drills using your device's camera for motion detection. Participating in these drills involves physical exertion and carries inherent risks, including but not limited to muscle strain, joint injury, falls, or collision with objects or people near you.
You are solely responsible for ensuring you have adequate space, a clear and safe environment, and appropriate physical condition before and while using the App.
The App does not provide medical advice, diagnosis, or treatment, and its punch-detection and coaching features are for training and entertainment purposes only - they are not a substitute for guidance from a licensed coach, trainer, or medical professional.
You use the App and perform any exercises, drills, or movements it suggests entirely at your own risk. You assume full responsibility for any injury, loss, or damage resulting from your use of the App.
Stop using the App immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptom during use.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Uppercut on Apple devices that you own or control, solely for your personal, non-commercial use, in accordance with the Apple Media Services Terms and Conditions and the App Store's usage rules.
You agree not to:
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where permitted by applicable law.
Modify, adapt, translate, or create derivative works based on the App.
Copy, distribute, sell, lease, rent, or sublicense the App or any part of it.
Remove, obscure, or alter any proprietary notices on the App.
Use the App in any way that violates applicable local, national, or international law.
Use the App to harm, harass, or endanger yourself or others, or in a manner inconsistent with its intended training purpose.
The App allows you to create custom combos, set a display name, and configure training preferences ("Your Content"). Your Content is stored locally on your device, as described in our Privacy Policy. You retain ownership of Your Content. Because Your Content is not transmitted to us, we do not host, access, or claim any rights to it.
The App, including its design, graphics, animations, audio, text, features, and underlying code (excluding open-source components licensed separately, such as the Lottie animation library), is owned by the developer of Uppercut and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you beyond the limited license granted in Section 4.
Uppercut may offer optional in-app purchases or subscriptions, now or in the future, to unlock additional features or content. Where offered:
All purchases are processed exclusively through Apple's App Store in-app purchase system, subject to Apple's own terms and payment processing.
Prices, billing frequency, and auto-renewal terms (if applicable) will be clearly disclosed at the point of purchase within the App.
Subscriptions, where offered, automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage or cancel subscriptions at any time in your Apple ID account settings.
Refunds are handled by Apple in accordance with Apple's refund policies. We do not process payments or refunds directly and cannot override Apple's decisions on refund requests.
Certain features of the App require access to your device's camera to function, as described in our Privacy Policy. You may grant or revoke this permission at any time through your device settings; doing so may limit or disable core features of the App.
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted, error-free, or free of harmful components. Motion and punch detection are based on camera analysis and may not always be perfectly accurate; you should not rely on the App's detection or feedback as a substitute for careful judgment about your own safety and technique.
To the fullest extent permitted by applicable law, in no event shall the developer of Uppercut be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the App, (b) any physical injury or health-related issue arising from participation in exercises or drills suggested by the App, or (c) unauthorized access to or alteration of your data, even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
We may modify, suspend, or discontinue the App, or any feature of it, at any time without liability to you. We may also update these Terms from time to time to reflect changes in the App's functionality or for legal reasons. Material changes will be reflected by updating the effective date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
You may stop using the App at any time by deleting it from your device. We reserve the right to suspend or terminate your access to the App if you violate these Terms. Provisions of these Terms that by their nature should survive termination (including Sections 7, 10, 11, and 14) will continue to apply.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to its conflict of law principles, except where superseded by applicable App Store terms or mandatory local consumer protection law.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
