Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Twik ("we," "our," or "us") regarding your use of the Twik iOS application and keyboard extension (collectively, the "App" or "Service").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have obtained consent from your parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

Account Registration and Security

Creating an Account

To use the App, you must create an account using one of the following methods:

• Google Sign-In

• Apple Sign-In

You agree to:

• Provide accurate, current, and complete information during registration

• Maintain and update your information to keep it accurate and current

• Maintain the security of your account credentials

• Accept responsibility for all activities that occur under your account

Account Security

You are responsible for:

• Safeguarding your account access

• Any activities or actions under your account, whether or not authorized by you

• Notifying us immediately of any unauthorized use

We are not liable for any loss or damage arising from your failure to maintain account security.

Subscription Terms

Free Tier

The App offers a free tier with limited daily usage:

• Limited AI processing requests per day

• Access to basic writing modes

• Standard features

Premium Subscription

Premium subscriptions are available through Apple's In-App Purchase system and include:

• Unlimited AI processing requests

• Access to all writing modes and tones

• Priority support

• Future premium features

Payment and Billing

• All purchases are processed through Apple's App Store

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period

• Your Apple account will be charged within 24 hours prior to the end of the current period

• You can manage or cancel subscriptions in your Apple Account Settings

• Prices are displayed in your local currency and may include applicable taxes

Refunds

• Refund requests must be made through Apple, not through us

• We do not have access to or control over Apple's refund policies

• Refunds are subject to Apple's standard refund policies

Subscription Changes

We reserve the right to:

• Modify subscription pricing with 30 days' notice to existing subscribers

• Change features included in subscription tiers

• Discontinue subscription tiers (existing subscribers will be grandfathered)

Use of the Service

Permitted Use

You may use the App for:

• Personal, non-commercial use

• Writing assistance, grammar correction, and text enhancement

• Adjusting tone and style of your written content

Prohibited Use

You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws

• Submit content that is defamatory, obscene, harassing, threatening, or hateful

• Attempt to reverse engineer, decompile, or disassemble the App

• Use automated systems (bots, scrapers) to access the Service

• Circumvent usage limits or security measures

• Share your account credentials with others

• Resell, redistribute, or sublicense the Service

• Use the App to generate spam, phishing content, or malicious content

• Interfere with or disrupt the Service or servers

• Attempt to gain unauthorized access to any part of the Service

• Use the App in a manner that could damage, disable, or impair the Service

Content Restrictions

When submitting text for processing, you agree not to submit:

• Content that violates intellectual property rights

• Personal information of others without consent

• Confidential or proprietary information you don't have rights to

• Content that violates any applicable law or regulation

• Malicious code, viruses, or harmful content

Intellectual Property Rights

Our IP

The App, including all content, features, functionality, software, code, designs, graphics, and trademarks, is owned by Twik and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the App on devices you own or control

• Access and use the Service in accordance with these Terms

You may NOT:

• Copy, modify, distribute, sell, or lease any part of the App

• Create derivative works based on the App

• Remove or alter any copyright, trademark, or proprietary notices

Your Content

You retain all rights to the text you submit for processing. By using the Service, you grant us a limited, worldwide, royalty-free license to:

• Process your text to provide AI suggestions

• Temporarily cache results for performance optimization

• Use anonymized, aggregated data to improve the Service

We do not claim ownership of your content and will not use it for purposes other than providing the Service.

AI-Generated Suggestions

AI-generated suggestions provided by the App are offered "as is" for your use. While we strive for accuracy, we make no guarantees about :

• Grammatical correctness

• Appropriateness for your specific use case

• Originality or uniqueness

• Freedom from errors or omissions

You are responsible for reviewing and approving all AI suggestions before using them.

Keyboard Extension

Full Access Permission

The Twik keyboard extension requires "Full Access" permission to:

• Connect to our servers for AI processing

• Provide real-time writing suggestions

• Sync your authentication and subscription status

By granting Full Access, you acknowledge that:

• Only text you explicitly submit for processing is sent to our servers

• We do not collect or store other text typed using the keyboard

• You can revoke Full Access at any time in iOS Settings

Keyboard Behavior

We strive to ensure the keyboard functions properly, but we cannot guarantee:

• Compatibility with all apps and text fields

• Uninterrupted service in all network conditions

• Real-time performance in all scenarios

Third-Party Services

The App integrates with third-party services:

• Firebase: Authentication and security

• Supabase: Backend and AI processing

• RevenueCat: Subscription management

• Google Sign-In: Authentication

• Apple Sign-In: Authentication

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of these third-party services.

Privacy and Data Collection

Your use of the App is also governed by our Privacy Policy, available at https://sites.google.com/view/twik-ai-writing-companion-pp/home By using the App, you consent to the data practices described in our Privacy Policy.

Service Availability and Modifications

Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted or error-free access

• Freedom from viruses or harmful components

• Availability during maintenance, updates, or outages

• Compatibility with future iOS versions

We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part thereof) at any time

• Impose limits on features or restrict access to parts of the Service

• Perform maintenance and updates without notice

Updates

We may release updates to improve functionality, security, or performance. You are responsible for:

• Installing updates to maintain optimal functionality

• Ensuring your device meets minimum system requirements

Disclaimers and Limitation of Liability

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY OR COMPLETENESS

• SECURITY OR FREEDOM FROM ERRORS

We do not warrant that:

• The Service will meet your requirements

• AI suggestions will be accurate, complete, or suitable for your purposes

• The Service will be uninterrupted, timely, secure, or error-free

• Results obtained from the Service will be reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWIK SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES

• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE

• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT

• STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Twik and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service

• Your violation of these Terms

• Your violation of any rights of another party

• Your content submitted through the Service

Termination

By You

You may terminate your account at any time by:

• Using the "Delete Account" feature in the App

• Uninstalling the App (though your account will remain active)

Active subscriptions will be canceled but are subject to Apple's refund policies.

By Us

We may suspend or terminate your account if:

• You violate these Terms

• You engage in fraudulent or illegal activity

• Your account has been inactive for an extended period

• We discontinue the Service

We reserve the right to terminate accounts at our discretion with or without notice.

Effect of Termination

Upon termination:

• Your right to access the Service immediately ceases

• Your data will be deleted in accordance with our Privacy Policy

• Subscription charges will cease (no refunds for partial periods)

• Provisions that should survive termination will remain in effect

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App

• Updating the "Last Updated" date

• Sending an in-app notification

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at contact.twikapp@gmail.com to attempt to resolve the dispute informally.

Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India, rather than in court, except that you may assert claims in small claims court if they qualify.

Class Action Waiver: You agree to resolve disputes on an individual basis only, and not as part of any class, consolidated, or representative action.

Exceptions

Notwithstanding the above, either party may seek equitable relief in court for:

• Intellectual property infringement

• Unauthorized access to the Service

• Violations that cannot be adequately remedied through arbitration

Apple-Specific Terms

Because the App is distributed through the Apple App Store, the following terms apply:

Apple as Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms and may enforce them against you.

Scope of License

The license granted to you is limited to a non-transferable license to use the App on Apple-branded products you own or control.

Maintenance and Support

We, not Apple, are responsible for providing maintenance and support services. Apple has no obligation to furnish maintenance or support.

Warranty

We, not Apple, are responsible for product warranties to the extent not disclaimed.

Product Claims

We, not  Apple, are responsible for addressing claims relating to:

• Product liability

• Failure to conform to legal or regulatory requirements

• Consumer protection laws

Intellectual Property

In the event of third-party claims that the App infringes intellectual property rights, we, not Apple, are responsible for investigation and defense.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Twik regarding the Service.

Severability

If any provision is found to be unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
