Welcome to True Heritage Origin Ancestry, an innovative application that harnesses cutting-edge artificial intelligence technology to create engaging, entertaining, and imaginative explorations of your ancestral heritage. By downloading, accessing, installing, or utilizing the True Heritage Origin Ancestry mobile application and all associated services (collectively referred to as the "App"), you explicitly acknowledge that you have thoroughly read, completely understood, and unequivocally agree to be legally bound by these comprehensive Terms of Service and End User License Agreement ("Terms"). Your utilization of the App is further governed by our accompanying Privacy Policy, which is fully incorporated herein by reference. If you do not unconditionally accept all provisions outlined in these Terms, you must immediately cease all access and use of the App.
For clarity throughout this document, the following terms shall have these specific meanings:"App": Refers to the complete True Heritage Origin Ancestry mobile application ecosystem, including all its features, generated content, and services."User" or "You": Means any individual who downloads, installs, accesses, or interacts with the App."Content": Encompasses all information, data, text, graphics, images, and other media generated, displayed, or transmitted through the App, including user-uploaded photographs and all AI-generated outputs."AI Services": Refers to third-party artificial intelligence systems, including OpenAI API, that power the core functionality of the App."Service Provider": Refers to the developers and operators of True Heritage Origin Ancestry.
This End User License Agreement establishes the legal relationship between you and the Service Provider regarding your use of the App.
You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
You agree not to:
Copy, reproduce, distribute, or create derivative works of the App
Decompile, reverse-engineer, disassemble, or attempt to derive the source code
Modify, adapt, translate, or alter the App in any way
Remove, alter, or obscure any proprietary notices or labels
Use the App for any unlawful, harmful, or unauthorized purpose
Sublicense, rent, lease, or lend the App to third parties
Use the Service Provider's trademarks, logos, or intellectual property without written consent
All copyrights, trademarks, patents, and other intellectual property rights in the App remain the exclusive property of the Service Provider.
This license does not allow you to use the App on any device that you do not own or control. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time.
This license is effective until terminated by you or the Service Provider. Your rights under this license will terminate automatically without notice if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
You agree that the Service Provider may collect and use technical data and related information—including but not limited to technical information about your device, system, and application software—to facilitate the provision of software updates, product support, and other services related to the App.
Your use of the App may be subject to additional third-party terms and conditions, including:
Your wireless data service agreement with your carrier
Apple Media Services Terms and Conditions
Third-party AI service providers' terms (including OpenAI)
The App integrates with third-party AI services (including OpenAI API) to generate Content. By using these features, you agree to comply with the respective service providers' Terms of Use and Privacy Policies. The Service Provider maintains no control over the underlying processes or output quality of these external AI services.
The Service Provider is not responsible for examining or evaluating the content or accuracy of third-party services. The Service Provider does not warrant and will not have any liability for any third-party materials, services, or websites.
You acknowledge that these Terms are between you and the Service Provider only, not with Apple Inc. ("Apple"). The Service Provider, not Apple, is solely responsible for the App and its content.
The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
The Service Provider is solely responsible for providing any maintenance and support services for the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
The Service Provider is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
The Service Provider, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:
Product liability claims
Any claim that the App fails to conform to any applicable legal or regulatory requirement
Claims arising under consumer protection, privacy, or similar legislation
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Service Provider, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

True Heritage Origin Ancestry is designed and operated exclusively for entertainment, creative inspiration, and personal reflection purposes.
You expressly acknowledge and agree that the App is NOT:
A professional genealogical research service
A historical documentation or verification tool
A DNA testing or genetic analysis methodology
A scientifically validated ancestry platform
An empirically proven method for partner selection or relationship compatibility
All ancestral portraits, historical narratives, and compatibility insights generated by the App represent fictional artistic interpretations and creative simulations produced through artificial intelligence algorithms.
The App does not guarantee the historical accuracy, biological precision, genealogical validity, or factual authenticity of any generated Content. All outputs constitute imaginative simulations based on algorithmic processing and are not derived from factual historical records, genetic data, or scientifically recognized genealogical methodologies.
You agree to utilize the App in a lawful and responsible manner. You are strictly prohibited from:
Generating, distributing, or sharing Content that is illegal, threatening, harassing, defamatory, constitutes hate speech, promotes violence, or encourages discrimination
Uploading photographs of individuals without their explicit consent, particularly for malicious or inappropriate purposes
Using the App for activities that infringe upon privacy, intellectual property, or other legal rights of third parties
Interfering with or disrupting the integrity or performance of the App
Attempting to gain unauthorized access to any portion of the App
Any violation of these terms may result in immediate termination of your access to the App.
The App, including its design elements, user interface, features, and all associated intellectual property, is the exclusive property of the Service Provider and is protected by international copyright, trademark, and intellectual property laws.
You retain ownership of photographs you upload to the App. By uploading content, you grant us a limited, non-exclusive, royalty-free license to process said content through AI Services exclusively for generating your requested Content.
Content generated through AI Services is provided for your personal, non-commercial entertainment use only. You may not commercially exploit or redistribute this Content without explicit written permission.
The App may store or process personal data as described in our Privacy Policy, which is incorporated into these Terms by reference.
You are responsible for maintaining the security of your device. Actions such as jailbreaking or rooting your device may impair functionality and security.
Some features require an active internet connection. You are responsible for any associated carrier or data charges.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.The Service Provider shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from:
Your use of or inability to use the App
Reliance on any Content generated by the App
Misinterpretation of AI-generated information as factual truth
Personal, professional, or relational decisions based on App suggestions
Service interruptions, technical errors, or performance issues
Unauthorized access to your data or transmissions
Errors or inaccuracies in any Content
You agree to indemnify, defend, and hold harmless the Service Provider, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
The App is designed for a general audience aged 4 years and older. All users (or their legal guardians for minors) must operate the App responsibly and in compliance with all applicable laws and regulations.
The App may require updates to continue functioning properly. You agree to install such updates when available. The Service Provider may modify, update, suspend, or discontinue the App at any time.
We reserve the right to modify these Terms at any time. Changes will be communicated through app notifications and by updating the "Effective Date." Your continued use of the App following changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the App and supersede all prior agreements and understandings.
