Terms of Service

These Terms of Service ("Terms") govern your use of the mobile application Trip Planner AI Planner (the "App"), provided by Kello Solutions ("Company," "we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, then you may not access the App.

1. The App and Service

The Trip Planner AI Planner is a mobile application designed to assist users in creating, planning, and refining travel itineraries using artificial intelligence (AI) technology.

• AI Generated Content: The itineraries, suggestions, and information provided by the AI engine are for informational and planning purposes only. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. You are solely responsible for verifying the accuracy of any trip details (e.g., operating hours, pricing, safety) before relying on them.

• No Professional Advice: The App does not provide professional travel, legal, financial, or other advice.

2. User Accounts

While the current version of the App may not require registration, we may offer account features in the future.

• Account Creation: If accounts are required, you agree to provide accurate and complete information during the registration process.

• Account Security: You are responsible for safeguarding the password and for any activities or actions under your password. Kello Solutions cannot and will not be liable for any loss or damage arising from your failure to maintain the security of your account and password.

• Termination: We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

3. User Input and Content (Trip Data)

• Your Data: Any data, text, or information you input into the App for the purpose of generating trip plans (e.g., destinations, preferences, notes) ("Trip Data") remains yours.

• License to Kello Solutions: By submitting Trip Data, you grant Kello Solutions a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the Trip Data solely for the purpose of operating, improving, and providing the App's services to you, including sharing it with AI service providers as described in the Privacy Policy.

• No Infringement: You warrant that your Trip Data does not violate any third-party rights, including copyright or privacy rights.

4. Use Restrictions and Prohibited Activities

You agree not to use the App for any purpose that is prohibited by these Terms or by law. Specifically, you agree not to:

• Use the App in any manner that could disable, overburden, damage, or impair the App or interfere with any other party's use of the App.

• Use the App to generate any content that is illegal, defamatory, harassing, discriminatory, or harmful.

• Attempt to gain unauthorized access to any parts of the App or the systems or networks connected to the App.

• Reverse engineer, disassemble, or decompile any part of the App.

• Use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the App in a manner that sends more request messages to our servers than a human can reasonably produce in the same period by using a conventional web browser.

5. Intellectual Property

The App, its original content, features, and functionality (excluding your Trip Data) are and will remain the exclusive property of Kello Solutions and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Kello Solutions.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the App is at your sole risk. Kello Solutions expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Kello Solutions and its subsidiaries, affiliates, and licensors do not warrant that:

• The App will function uninterrupted, secure, or available at any particular time or location.

• Any errors or defects will be corrected.

• The content generated by the AI is free of viruses or other harmful components.

• The results of using the App will meet your requirements.

7. Limitation of Liability

In no event shall Kello Solutions, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the App.

• Any conduct or content of any third party on the App.

• Any content obtained from the App, including AI-generated itineraries.

• Unauthorized access, use, or alteration of your Trip Data, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice before any new terms take effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
