These Terms of Service apply to the mobile application Trigrid (“Application”), operated by Clumsy Cube (represented by Bennet Kurmann, [Deine Adresse in Deutschland]). By downloading or using the Application, you agree to be bound by these terms.

1. Acceptance of Terms

By using the Application, you agree to these terms. If you do not agree, please uninstall the Application immediately. The Application is provided for your personal, non-commercial use.

2. Intellectual Property Rights

All intellectual property rights, including trademarks and copyrights related to the Application, remain the exclusive property of Clumsy Cube. You may not copy, modify, reverse engineer, or create derivative works of the Application or its source code. Unauthorized use of branding or assets is prohibited.

3. Service Usage and Third-Party Services

• Functionality: The Application requires an active internet connection for certain features (e.g., advertisement loading). You are responsible for any data charges incurred from your network provider.

• Third-Party Providers: The Application integrates third-party advertising services (e.g., Google AdMob, Unity Ads, ironSource, AppLovin). These services are governed by their own terms and privacy policies. The Service Provider is not responsible for the content or availability of third-party advertisements.

4. User Responsibilities

You are responsible for the security of your device. We advise against using the Application on "jailbroken" or "rooted" devices, as these may compromise security and functionality. The Service Provider is not responsible for any malfunctions arising from such device modifications.

5. Limitation of Liability

The Application is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by German law:

• The Service Provider is not liable for indirect damages or loss of data resulting from the use of the Application.

• The Service Provider is not liable for technical interruptions, service downtime, or issues beyond our control (e.g., hardware failure or lack of internet connectivity).

• This does not limit liability for damages resulting from gross negligence or intentional misconduct by the Service Provider.

6. Updates and Termination

• Updates: We may release updates to improve performance or compatibility. You agree to install these updates to continue using the service.

• Termination: We reserve the right to discontinue the Application or restrict access at any time without prior notice. Upon termination, your right to use the Application ends, and you must delete it from your device.

7. Changes to These Terms

We may update these terms periodically. Continued use of the Application following such changes constitutes your acceptance of the updated terms. Please review this page regularly.

8. Governing Law and Dispute Resolution

These terms are governed by the laws of Germany. Any disputes arising in connection with these terms shall be subject to the jurisdiction of the competent courts in Germany.
