PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE TRACKIVE APPLICATION. BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS.
1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the developer of Trackive ("we," "us," or "our") regarding your use of the Trackive mobile application ("App").
If you do not agree to these Terms, do not download, install, or use the App.
2. DESCRIPTION OF THE APP
Trackive is a personal health and wellness application that provides:
• BMI Calculator: A tool to calculate Body Mass Index using metric or imperial measurements.
• Workout Plans: Structured training programs for men and women across three access tiers (Free, Intermediate, Pro).
• Workout Log Calendar: A personal workout tracking system with streak monitoring and progress logging.
• Period / Cycle Tracker: A menstrual cycle prediction tool that estimates future period dates, fertile windows, and ovulation days based on user-provided data.
• Push Notifications: Optional local reminders for workouts, BMI checks, and cycle phase alerts.
The App is supported by advertising provided by Google AdMob.
3. ELIGIBILITY AND AGE REQUIREMENTS
3.1 You must be at least 13 years of age to use this App. If you are under 18, you must have parental or guardian consent.
3.2 The period tracking and reproductive health features are intended for individuals who menstruate and are seeking general wellness information. These features are not appropriate for children.
3.3 By using the App, you represent and warrant that you meet the above age requirements.
4. HEALTH INFORMATION DISCLAIMER
4.1 NOT MEDICAL ADVICE
THE INFORMATION PROVIDED BY TRACKIVE IS FOR GENERAL INFORMATIONAL AND WELLNESS PURPOSES ONLY. THE APP DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR PROFESSIONAL HEALTHCARE SERVICES.
4.2 BMI Limitations
BMI is a general screening tool and does not directly measure body fat or overall health. BMI results should not be used as the sole indicator of your health status. Factors including muscle mass, bone density, age, ethnicity, and overall fitness are not reflected in BMI calculations. Always consult a qualified healthcare professional for personalised health assessments.
4.3 Period and Fertility Predictions
The cycle predictions provided by Trackive (including next period date, ovulation day, and fertile window) are ESTIMATES based on averages. These predictions:
• Are based solely on data you enter and standard calendar-based algorithms
• Do NOT account for hormonal conditions, irregular cycles, PCOS, perimenopause, or other health factors
• Are NOT a reliable method of contraception or fertility planning
• Should NOT be relied upon for family planning decisions
For reproductive health decisions, family planning, or concerns about irregular cycles, please consult a qualified gynaecologist or healthcare provider.
4.4 Workout and Exercise Plans
The workout plans provided in Trackive are general fitness programs designed for informational purposes. Before beginning any new exercise program:
• Consult a physician, especially if you have any pre-existing medical conditions, injuries, or are pregnant
• Stop exercising immediately if you experience pain, dizziness, shortness of breath, or discomfort
• The exercises described may not be appropriate for all fitness levels
We are not responsible for any injury, illness, or health complications arising from use of the workout plans.
4.5 Emergency Situations
Trackive is not an emergency service. If you are experiencing a medical emergency, call your local emergency services immediately.
5. ADVERTISING AND IN-APP PURCHASES
5.1 Free-to-Use Model
Trackive is available free of charge and is supported by advertising provided by Google AdMob. By using the App, you agree to receive advertisements as described in our Privacy Policy.
5.2 Rewarded Advertisements
Certain premium workout plans (Intermediate and Pro tiers) require watching optional video advertisements to unlock temporary access:
• Intermediate Plans: Unlocked for 1 hour by watching a Rewarded Interstitial advertisement.
• Pro Plans: Unlocked for 15 minutes by watching a Rewarded advertisement.
These unlocks are temporary and time-limited. No monetary payment is required to access any content.
5.3 Ad Viewing Requirements
To watch unlock advertisements, an active internet connection is required. We are not responsible for ads failing to load due to connectivity issues, ad blockers, or Google AdMob service disruptions.
5.4 No Refunds
Since Trackive does not charge monetary fees for any content, no refund policy applies.
6. INTELLECTUAL PROPERTY
6.1 App Ownership
The App, including its original content (excluding user data), features, functionality, design, logos, and code, is and shall remain the exclusive property of the developer and is protected by copyright, trademark, and other intellectual property laws.
6.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial wellness purposes in accordance with these Terms.
6.3 Restrictions
You may not:
• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code of the App
• Use the App for any commercial purpose without our written consent
• Remove any copyright, trademark, or proprietary notices from the App
7. USER DATA AND PRIVACY
7.1 All personal data you enter into the App (BMI measurements, period dates, workout logs) is stored locally on your device only. We do not collect, store, or process this data on any server.
7.2 Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7.3 You are responsible for maintaining the security of your device and ensuring that your health data is appropriately protected.
8. NOTIFICATIONS
8.1 If you enable push notifications, you grant the App permission to deliver local notifications to your device.
8.2 You may disable notifications at any time through the App's Settings or through your device's notification settings.
8.3 We are not responsible for missed reminders resulting from device settings, battery optimisation, or operating system restrictions.
9. THIRD-PARTY SERVICES
9.1 The App uses Google AdMob for advertising. Your use of the App is subject to Google's Terms of Service (https://policies.google.com/terms) in addition to these Terms.
9.2 We are not responsible for the content, privacy practices, or terms of any third-party services, websites, or applications linked to or from the App.
10. DISCLAIMERS AND LIMITATIONS OF LIABILITY
10.1 THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 WE DO NOT WARRANT THAT:
• The App will be uninterrupted, error-free, or secure
• Any defects or errors will be corrected
• The cycle predictions or BMI calculations will be accurate for your specific circumstances
• The App will meet your specific requirements
10.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR:
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, goodwill, or other intangible losses
• Any damages arising from your reliance on health information provided by the App
• Any personal injury or health complications arising from use of workout plans
• Any pregnancy resulting from reliance on cycle tracking predictions
10.4 Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid for the App (which is zero, as the App is free).
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the developer and its officers, employees, and agents from any claims, liabilities, damages, judgments, costs, and expenses (including legal fees) arising from:
• Your use of the App in violation of these Terms
• Your violation of any third-party rights
• Any health decisions made in reliance on App content
12. MODIFICATIONS TO THE APP AND TERMS
12.1 We reserve the right to modify, suspend, or discontinue the App at any time without notice.
12.2 We may revise these Terms at any time by updating this document within the App. By continuing to use the App after changes are made, you accept the revised Terms.
12.3 We will indicate the date of the most recent revision at the top of this document.
13. TERMINATION
13.1 These Terms remain in effect while you use the App.
13.2 We may terminate or suspend your access to the App at any time, without prior notice, if you violate these Terms or applicable law.
13.3 Upon termination, your right to use the App ceases immediately. All data stored locally on your device will remain until you uninstall the App or clear its data.
14. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the developer is registered, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.

16. ENTIRE AGREEMENT
