TopPocket Terms of Service

These Terms of Service explain the rules for using TopPocket.

By creating an account, browsing, listing cards, messaging users, verifying your phone number, or using TopPocket, you agree to these Terms.

If you do not agree, do not use TopPocket.

TopPocket is operated by the developer and publisher of the TopPocket app.

What TopPocket does

TopPocket is an Australian peer-to-peer trading-card marketplace app.

TopPocket helps users discover trading cards, buyers, sellers, wishlists, and local matches.

TopPocket supports cards such as Pokémon, One Piece, Magic: The Gathering, Riftbound, Dragon Ball and other trading cards.

TopPocket is a local-discovery layer. We help users find each other.

Availability

TopPocket is currently intended for users in Australia.

Some features, including local discovery, nearby matching, meetups, listings, card pricing, and marketplace safety guidance, are designed around Australian users and Australian trading-card communities.

TopPocket may not be available, supported, or suitable for use outside Australia.

What TopPocket does not do

TopPocket does not sell cards directly.

TopPocket does not buy cards from users.

TopPocket does not process payments for card trades.

TopPocket does not hold funds.

TopPocket does not provide escrow.

TopPocket does not inspect, grade, verify, or authenticate cards.

TopPocket does not guarantee card condition, value, legality, ownership, authenticity, delivery, payment, or user behaviour.

TopPocket does not mediate private transactions between users.

Any trade, sale, purchase, meetup, payment, delivery, or exchange is arranged directly between users at their own risk.

Accounts

You may need an account to use some TopPocket features.

You must provide accurate information and keep your account secure.

You are responsible for activity on your account.

Do not share your login details with others.

Tell us if you believe your account has been accessed without permission.

Phone verification and Verified badges

TopPocket may offer optional phone verification.

If you choose to verify your phone number, you may receive a one-time SMS confirmation code through Firebase Authentication, a Google service.

Phone verification may allow your profile to show a Verified badge.

A Verified badge only means that a phone number has been verified for that account. It does not mean that TopPocket has confirmed the user’s identity, legal name, address, trustworthiness, trading history, card ownership, card authenticity, or safety.

Other users should not rely only on a Verified badge when deciding whether to trade, buy, sell, meet, or communicate with someone.

You must not verify using a phone number you do not own or have permission to use.

You must not use phone verification to mislead users, create fake trust, bypass restrictions, create duplicate accounts, avoid moderation, or impersonate another person.

TopPocket may remove a Verified badge, require re-verification, restrict features, suspend an account, or ban an account if we believe phone verification has been misused or the account creates risk for other users.

Phone verification is optional unless a specific feature clearly says verification is required. If you do not verify your phone number, you may not receive the Verified badge or related trust features.

Our Privacy Policy explains how phone verification information is handled.

Eligibility

You must be old enough to use TopPocket in your location.

If you are under 18, you must have permission from a parent or guardian to use TopPocket.

If you are under 18, you should not arrange in-person trades without adult supervision.

User listings and content

You are responsible for the listings, messages, photos, prices, notes, profile information, and other content you add to TopPocket.

You must make sure your listings are accurate and not misleading.

You must only list cards you own or are authorised to trade or sell.

You must clearly describe card condition, language, finish, grading status, damage, alterations, proxies, reproductions, or any other important details.

You must not list counterfeit, stolen, illegal, unsafe, misleading, or infringing items.

You keep ownership of your content, but you give TopPocket permission to host, store, copy, display, process, moderate, and use it as needed to operate and improve the app.

Marketplace conduct

You agree not to:

• Post fake, misleading, stolen, counterfeit, or scam listings.
• Misrepresent card condition, value, authenticity, rarity, language, finish, or grading status.
• Harass, threaten, abuse, impersonate, or deceive other users.
• Send spam, scams, phishing links, malware, or unsafe payment links.
• Pressure users to meet in unsafe locations.
• Use TopPocket for illegal activity.
• Scrape, copy, reverse engineer, overload, or interfere with the app.
• Create multiple accounts to avoid moderation, bans, limits, reports, phone verification rules, or other restrictions.
• Use someone else’s phone number or false information to verify an account.
• Post offensive, sexual, hateful, violent, discriminatory, or objectionable content.
• Infringe another person’s copyright, trademark, privacy, publicity, or other rights.

Safety and meetups

TopPocket helps users discover local trading opportunities, but users are responsible for their own safety.

Meet in public places.

Do not meet strangers alone if you are uncomfortable.

Tell someone where you are going.

Check cards carefully before handing over money or other cards.

Use payment methods you trust.

Be cautious with shipping, deposits, holds, bank transfers, and off-platform arrangements.

Do not share your home address, exact live location, private financial details, identity documents, or private phone number unless you fully understand the risk.

A Verified badge is not a safety guarantee. You should still use safe trading practices even when dealing with a verified user.

If something feels unsafe, leave the trade and report the user.

Reports, blocking, and moderation

TopPocket may provide tools to report listings, messages, profiles, or users.

TopPocket may provide tools to block users.

TopPocket may use in-app moderation tools, automated checks, phone verification signals, manual review, user reports, and account restrictions to help reduce spam, scams, unsafe behaviour, counterfeit listings, abusive messages, fake listings, duplicate accounts, and other misuse of the app.

We may review reports and take action where we believe it is appropriate.

Actions may include warning users, removing listings, removing content, removing Verified badges, requiring re-verification, restricting features, suspending accounts, banning accounts, or reporting serious issues to authorities.

We are not required to monitor every listing, message, trade, or user interaction.

Moderation actions are taken at our discretion and do not make TopPocket responsible for user transactions or disputes.

Disputes between users

TopPocket is not a party to trades, sales, purchases, swaps, meetups, or payment arrangements between users.

Users are responsible for resolving private transaction issues themselves.

You can report scams, unsafe behaviour, fake listings, or abusive users to TopPocket.

TopPocket may choose to review reports for platform safety, but we do not guarantee that we will recover money, recover cards, reverse trades, verify facts, or resolve private disputes.

Card prices and information

TopPocket may show card data, set information, search results, estimated prices, sold-comparable links, user prices, or other market information.

This information is provided for convenience only.

TopPocket does not guarantee that pricing, card details, rarity, images, variants, finishes, or market data are complete, current, or accurate.

Users should do their own checks before buying, selling, trading, grading, or valuing cards.

No authentication or grading guarantee

TopPocket does not authenticate cards.

TopPocket does not grade cards.

TopPocket does not guarantee that a raw card, graded card, slab, label, signature, stamp, serial number, or sealed product is genuine.

Users are responsible for inspecting cards and deciding whether to proceed with a trade.

Payments

TopPocket does not currently process payments for trading-card transactions between users.

If users choose to pay each other outside TopPocket, that arrangement is solely between those users.

TopPocket is not responsible for payment failures, chargebacks, refunds, scams, non-delivery, or payment disputes.

If TopPocket introduces paid digital features in the future, the price, renewal terms, cancellation terms, and payment provider details will be shown before purchase.

Intellectual property

TopPocket owns or licenses the TopPocket app, name, logo, design, software, features, text, and related materials.

You must not copy, modify, distribute, sell, reverse engineer, or misuse TopPocket’s intellectual property unless we give written permission.

Trading card names, brands, logos, artwork, and trademarks belong to their respective owners.

TopPocket is not affiliated with, endorsed by, sponsored by, or officially connected to The Pokémon Company, Nintendo, Creatures, Game Freak, Bandai, Shueisha, Toei Animation, Wizards of the Coast, Hasbro, or any other trading-card rights holder unless clearly stated.

User feedback

If you send us ideas, suggestions, bug reports, designs, feature requests, or other feedback, you allow us to use that feedback without payment or obligation to you.

Account suspension or termination

We may suspend, restrict, or terminate your account if we believe you have breached these Terms, created risk for other users, abused the platform, misused phone verification, posted prohibited content, or used TopPocket in a harmful way.

You may stop using TopPocket at any time.

You may request account deletion through the app or by contacting toppocketapp@gmail.com.

App availability

We aim to keep TopPocket available and working well, but we do not guarantee uninterrupted access.

The app may be unavailable because of maintenance, updates, bugs, outages, third-party services, SMS verification issues, network issues, or events outside our control.

We may add, remove, test, limit, or change features at any time.

Third-party services and links

TopPocket may include links or integrations with third-party services, websites, maps, authentication providers, SMS verification services, analytics tools, card databases, pricing sources, or app stores.

We are not responsible for third-party services, content, data, prices, policies, or availability.

Your use of third-party services may be subject to their own terms and privacy policies.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or other laws that cannot be excluded.

Subject to those non-excludable rights, TopPocket is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we exclude warranties, guarantees, representations, and conditions not expressly stated in these Terms.

Limitation of liability

To the maximum extent permitted by law, TopPocket and its operators are not liable for loss or damage arising from:

• User listings, messages, trades, purchases, sales, swaps, payments, refunds, meetups, shipping, or delivery.
• Fake, counterfeit, stolen, damaged, misdescribed, overpriced, underpriced, or unavailable cards.
• User conduct, scams, fraud, harassment, threats, or unsafe behaviour.
• Incorrect card data, pricing data, search results, matching results, images, or market information.
• A user relying on a Verified badge as proof of identity, safety, trustworthiness, card ownership, or transaction reliability.
• App downtime, bugs, data loss, unauthorised access, phone verification issues, SMS delivery issues, or third-party service issues.

Where liability cannot be excluded, our liability is limited to the maximum extent allowed by law.

Indemnity

You agree to be responsible for losses, claims, costs, or expenses arising from your breach of these Terms, your listings, your messages, your transactions, your misuse of TopPocket, your misuse of phone verification, or your violation of another person’s rights.

Changes to these Terms

We may update these Terms from time to time.

If changes are significant, we may notify users in the app, by email, or by updating the date at the top of this page.

If you keep using TopPocket after changes take effect, you accept the updated Terms.

Governing law

These Terms are governed by the laws of Australia.

You agree that courts in Australia may hear disputes relating to these Terms.
