Tonayt – Terms and Conditions

These Terms and Conditions (also referred to as "Terms of Service" or "ToS") govern your use of the Tonayt mobile application ("Service") provided by Tonayt Technology UG (haftungsbeschränkt).
By accessing or using the Tonayt app, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By accessing or using the Tonayt app ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service.

2. Overview of the Service

Tonayt is a mobile application that enables:

• Users to discover real-time and upcoming DJ performances in their area.
  
  

• DJs and event organizers to promote gigs, manage profiles, and connect with followers.
  
  

• DJs and event organizers to access performance analytics such as gig impressions and click data (subject to subscription).
  
  

The Service is provided “as-is” and may be modified, updated, or expanded at any time without prior notice.

3. User Eligibility & Account

• You must be at least 18 years of age to register.
  
  

• You are responsible for maintaining the security of your account credentials.
  
  

• You agree to provide accurate, complete, and up-to-date information.
  
  

• Creating multiple accounts, abusing trials, or fraudulent behavior may result in suspension or termination.
  
  

4. Subscriptions & Payments

The Tonayt app is free to download and use for general users.

However, certain premium features are available only to DJs and event organizers through paid subscriptions, including but not limited to:

• Gig performance analytics (impressions, clicks, engagement data)
  
  

• Visibility insights metrics
  
  

Subscription Details:

• Subscriptions are offered on a monthly basis via in-app purchases.
  
  

• Payments are processed through the Apple App Store and/or Google Play Store.
  
  

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  
  

• Pricing and plan details are clearly displayed within the app before purchase.
  
  

Tonayt reserves the right to modify subscription pricing, features, or availability with prior notice where required by law.

5. Refund Policy

Refunds are handled in accordance with the policies of the platform through which the purchase was made (Apple App Store or Google Play Store).

• Tonayt does not directly process refunds for in-app purchases.
  
  

• Users must request refunds through their respective app store.
  
  

• No refunds are provided for partial subscription periods unless required by applicable law.
  
  

6. Event Content & Accuracy

DJs and event organizers are solely responsible for the accuracy of event details, including:

• Time and date
  
  

• Venue/location
  
  

• Music genre and DJ profile
  
  

Misleading, false, or inappropriate content may be removed without notice.
Repeated violations may result in account suspension or termination.

7. Data Privacy & Handling

We are committed to protecting your privacy.

• We collect only data necessary to provide and improve the Service.
  
  

• Data may include email address, location (for event discovery), usage data, and connected social media handles.
  
  

• Analytics data related to gigs is visible only to the respective DJ or organizer.
  
  

• All data is handled in accordance with the EU General Data Protection Regulation (GDPR).

8. Community Guidelines

We aim to foster a respectful and inclusive community:

• No hate speech, harassment, or discrimination of any kind.
  
  

• DJs must not impersonate others or post fraudulent event listings.
  
  

• Users must interact respectfully with DJs, organizers, and other users.
  
  

Violations may result in warnings, suspension, or permanent bans.

9. Intellectual Property

All app content, code, design, branding, and features are the property of Tonayt Technology UG or its licensors.

User-uploaded content (e.g., DJ photos, videos, event details) remains the property of the user.
By uploading content, you grant Tonayt a non-exclusive, royalty-free license to use, display, and promote such content within the app.

You may not copy, distribute, modify, or exploit any part of the app without prior written consent.

10. Termination

We reserve the right to suspend or terminate accounts if:

• These Terms are violated
  
  

• Fraudulent, abusive, or illegal activity is detected
  
  

• The account remains inactive for an extended period
  
  

Users may delete their account at any time via the app or by contacting support.

11. Disclaimers

• Tonayt does not guarantee the availability, accuracy, or success of any event or promotion.
  
  

• Analytics and performance data are provided for informational purposes only and do not guarantee outcomes.
  
  

• Tonayt is not responsible for cancellations, ticketing disputes, or conflicts between users and venues.
  
  

• The Service may be temporarily unavailable due to maintenance or technical issues.
  
  

12. Limitation of Liability

To the maximum extent permitted by law, Tonayt is not liable for:

• Indirect or incidental damages
  
  

• Loss of data, revenue, or profits
  
  

• Service interruptions or technical errors
  
  

Use of the app is at your own risk.

13. Modifications to Terms

These Terms may be updated from time to time.
Users will be notified of significant changes via the app or email. Continued use of the Service constitutes acceptance of the revised Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Germany.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Munich, Germany.

15. Legal Notice – Intellectual Property and Protection Statement

Tonayt™ is a trademark of Tonayt Technology UG & Elvis Duah Sackey.
All rights are reserved under German, EU, and international law.

Unauthorized reproduction, imitation, reverse engineering, or exploitation of the Tonayt application or its components may result in legal action.
