These Terms and Conditions (also referred to as "Terms of Service" or "ToS") govern your use of the Tonayt mobile application ("Service") provided by Tonayt Technology UG (haftungsbeschränkt). By accessing or using the Tonayt app, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms
By accessing or using the Tonayt app ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service.

2. Overview of the Service
Tonayt is a mobile application that enables:
- Users to discover real-time and upcoming performances by DJs in their area.
- DJs and event organizers to promote gigs, share profiles, and connect with followers.
The Service is provided "as-is" and may be modified or updated at any time without prior notice.

3. User Eligibility & Account
You must be at least 18 years of age to register.
You are responsible for the security of your account credentials.
You agree to provide accurate and complete information.

4. Subscriptions & Payments
The Tonayt app is completely free to download and use. During this initial launch phase, all features and functionalities are accessible to users at no cost.
There are no subscriptions, fees, or payment requirements of any kind at this stage.
Tonayt reserves the right to introduce optional paid features in the future, which will be clearly communicated to users in advance.Attempting to create multiple new accounts or using fraudulent methods may lead to account suspension or termination.

5. Refund Policy
As the Tonayt app is currently completely free to use during  this initial launch phase, no payments are being collected and therefore no refunds are applicable.
Should paid features be introduced in the future, a clear refund policy will be established and communicated to all users in advance.

6. Event Content & Accuracy
DJs and event organizers are solely responsible for the accuracy of event details, including:
- Time and date
- Venue/location
- Music genre and DJ profile
Misleading, false, or inappropriate content may be removed without notice.
Repeated violations may result in account termination.

7. Data Privacy & Handling
We are committed to protecting your privacy.
We collect only the data necessary to provide and improve the Service.
Personal data may include email, location (for event suggestions), usage data, and social media handles if connected.
Data is handled in accordance with the EU General Data Protection Regulation (GDPR).

8. Community Guidelines
We aim to foster a respectful and inclusive community:
- No hate speech, harassment, or discrimination of any kind.
- DJs must not impersonate others or post fraudulent event listings.
- Users must engage respectfully with DJs and other community members.
Violations may result in warnings, suspension, or permanent bans.

9. Intellectual Property
All app content, code, design, and branding is the property of Tonayt Technlogy UG or its licensors.
User-uploaded content (e.g. DJ photos,video, event details) remains the property of the user, but by uploading it, you grant Tonayt a non-exclusive, royalty-free license to use, display, and promote it within the app.
You may not copy, distribute, or modify any content from the app without written permission.

10. Termination
We reserve the right to suspend or terminate any account if:
- There is a breach of these Terms.
- Fraudulent or illegal activity is detected.
- The account is inactive for an extended period.
You may also delete your account at any time via the app or by contacting support.

11. Disclaimers
We do not guarantee the availability, accuracy, or quality of events listed on the platform.
Tonayt is not liable for cancellations, ticketing issues, or disputes between users and DJs/venues.
The Service may occasionally be unavailable due to maintenance or technical issues.

12. Limitation of Liability
To the maximum extent permitted by law, Tonayt is not liable for:
- Indirect or incidental damages
- Data loss
- Revenue or profit loss
- Technical errors or service interruptions
Your use of the app is at your own risk.

13. Modifications to Terms
These Terms may be updated from time to time. We will notify users via the app or email when major changes occur. Continued use of the app means you accept the revised Terms.

14. Governing Law & Jurisdiction
These Terms are governed by the laws of Germany.
Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Munich.

15. Legal Notice – Intellectual Property and Protection Statement
Trademark and Ownership Notice:
Tonayt™ is a trademark of Tonayt Technology UG & Elvis Duah Sackey. All rights are reserved.
The Tonayt application, including its design, logos, branding, source code, business concept, algorithms, user interface, and all associated intellectual properties, are the exclusive property of Tonayt Technolgy UG & Elvis Duah Sackey , based in Munich, Germany.

Copyright Protection:
All elements of the Tonayt application are protected under German, EU, and international copyright and intellectual property laws. Any unauthorized reproduction, copying, reverse engineering, or imitation of the app’s features, structure, functionalities, or design will constitute an infringement and may result in immediate legal action.

IP Registrations and Legal Enforcement:
Intellectual property rights associated with Tonayt, including trademarks and copyrights, have been secured or are pending formal registration with relevant national and international authorities. Elvis Sackey & Tonayt Technolgy UG actively monitors any unauthorized use, reproduction, or attempted imitation of Tonayt and will pursue all available legal remedies to enforce his rights.

Prohibition of Use:
It is strictly prohibited to reproduce, duplicate, distribute, modify, sell, or exploit the Tonayt app or any portion thereof without explicit prior written consent from  Technolgy UG & Elvis Duah Sackey.

Warning of Legal Consequences:
Any violation of these rights will be pursued under applicable civil and criminal law. This may include injunctions, monetary damages, seizure of infringing goods, and any additional remedies available under German and international law.

Governing Law and Jurisdiction:
This statement, and any dispute or claim relating to the Tonayt application, shall be governed by the laws of Germany. The competent courts of Munich, Germany shall have exclusive jurisdiction over any disputes arising hereunder.
