1. Acceptance of Terms By downloading, accessing, or using the TickTrack mobile application (“App”), developed by Lukas Lutz, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App. PLEASE NOTE: This is an example document. It MUST be reviewed and adapted by a legal professional to be legally sound and compliant.
2. Description of the Service The App provides users with tools to track time spent on various projects and activities. Features may include creating projects, defining activities, logging time entries, viewing statistics, and managing user accounts. We reserve the right to modify, suspend, or discontinue any part of the App or its features at any time with or without notice.
3. User Accounts
Eligibility: You must be at least 13 years old (or the minimum age required in your jurisdiction to consent to data processing) to create an account and use the App.
Account Responsibility: You are responsible for all activities that occur under your account. You agree to maintain the confidentiality of your login credentials (password) and to notify us immediately at lukaslutzz0@gmail.com if you suspect any unauthorized access to or use of your account.
Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. User Conduct You agree not to use the App for any purpose that is illegal or prohibited by these Terms. You agree not to:
Use the App in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.
Attempt to gain unauthorized access to any part of the App, other accounts, computer systems, or networks connected to the App.
Upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the App.
Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
Submit false or misleading information.
5. Intellectual Property All rights, title, and interest in and to the App (excluding user-provided content such as project names and time entry descriptions, but including the App's design, text, graphics, logos, and code) are and will remain the exclusive property of Lukas Lutz and its licensors. The App is protected by copyright, trademark, and other laws of Switzerland and foreign countries. You may not reproduce, modify, create derivative works from, distribute, sell, transfer, publicly display, publicly perform, transmit, or otherwise use the App or any of its content without our prior written permission.
6. User Content You retain ownership of any intellectual property rights that you hold in the content you create and store within the App (e.g., project names, activity names, time entry descriptions, milestones). By using the App, you grant us a limited license to use, store, and process this content solely for the purpose of providing and improving the App services to you.
7. Disclaimer of Warranties THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUKAS LUTZ (OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE AMOUNT, IF ANY, PAID BY YOU TO US FOR USE OF THE APP.
9. Account Termination We may terminate or suspend your access to and use of the App, with or without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. If you wish to terminate your account, you may do so by following the instructions within the App (e.g., in the Settings). All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Changes to the Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
11. Governing Law These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. (Your legal counsel should verify this clause based on your specific situation and user base).
