including THE STATE OF CALIFORNIA and THE STATE OF ARIZONA,
A, any and/or all Counties, Parishes, Towns and/or Cities therein,
The Director(s) of the DMVs/MVDs/AZ Motor Vehicle Department,
all legislators, executives, executors, and LEOs including judges, justices, jurors, sheriffs, residents, citizens and/or sovereigns DBA God(s) at planet Earth.
1. STANDING OF THE DECLARANT
The eternally living moving eternal me I am ("The Altruen", "me", "I" and/or "not it") is what causes the otherwise inanimate organic machine, aka the dead temporal male human body, ("Todd Allen Clark" and/or "it) I use to, including but not limited to, live and move as a living male man conceived on the land and made of water and earth, not as a legal fiction, not as a corporation, and neither as a franchise, nor surety of any artificial entity/person including the United States and/or the States thereof and therein.
I neither consent(ed), nor volunteer(ed), to being governed by humans, and I am neither a child, nor a person, nor a ward, nor a debtor, nor a citizen, nor a subject, nor a human, nor a homo Sapien, nor property of the United States, nor property of the United Nations; nor a subject of, nor subject to, any human religion including the pagan yahudim-roman-muslim-atheist-secular state church religion dba the State over all subjects; nor a constructive trustee for any file, estate and/or account created by others without my full knowledge, disclosure, and consent.
2. THE TWO BIRTHS: BIOLOGICAL VERSUS LEGAL
A) Biological Date of Birth ("DOB: September 3, 1961 AY/AD\CE").
Its DOB was and is established at its conception (i.e., the moment I entered it).
This event is a fact of nature in the Altruen Nation evidenced by the "zinc spark effect*", not of statute. No state created it. No department licensed it. It stands as an unalterable, irrefutable and immutable fact, and it is the Altruen Nation's private property.
*note: no combination of zinc, and any of the other 91 naturally occurring physical elements listed in the periodic table of elements, causes inanimate matter to breathe, live, move, be sentient and conscious.
B) File Registration Date (FRD).
Separately, the STATE OF CALIFORNIA recorded a File Registration Date (FRD; May 3, 1962 AY/AD\CE) when a form (see "The Certificate of Live Birth" and/or "TCOLB") was submitted to Vital Statistics by the parents of it. This act was administrative, not biological. At that moment, those humans DBA the STATE OF CALIFORNIA created and confirmed the FRD as me.
The FRD via TCOLB is a state created construct and a surety instrument eternally owned by The Altruen Nation.
C) B is not the same as A.
Key Point.
DOB and FRD are not the same event. They are not the same fact. They are not the same estate. Treating them as if they are identical is a concealment of material fact and a constructive fraud by presumption.
3. DMV ROLE IN CO-MINGLING AND INTENTIONAL MISREPRESENTATION
Those humans DBA State Vital Statistics and Records, Departments of Motor Vehicles (DMVs) and/or Motor Vehicle Departments (MVDs) operate(d) as commercial registrars and licensing officers of the pagan yahudim-roman-muslim-atheist-secular state church religion dba the State and other fictitious entities that only exist as words on/in different media. Those humans dba ficititous entities were not merely record keepers as they functioned as registrars of bonded performance and regulated commercial activities.
When I was compelled, induced and/or required under threat of harm to present fictitious State issued instruments including a Birth Certificate and other IDs created by humans (not me), the following occured:
I was not presenting proof of my living being ("me"). I was presenting evidence of a registered estate, and/or trust res, that humans DBA fictitious entities (inlcuding the United States, the IRS and the SSA) held in ledgers which they virtually controlled.
Those humans dba public record keepers (they; them) used the FRD and TCOLB of it to fraudulently make it their private property as they controlled and owned it and me through it in violation of a multitude of anti-slavery laws.
Those humans dba the fictitious entities (they; them) issued Drivers Licenses and/or IDs as it, with its likeness and details attached thereto, and they wrongly assumed that I had consented to operate as the ID of it they created, owned and virtually controlled me through.
Those humans dba ficititous entities inlcuding the State (they; them) attempted to transform me into it while they ignored the irrefutable fact that I am in it, but not it as I merely travel in it with TAN's rights, powers, immunities and sovereignty they neither own nor control. Neither it nor I are franchisees of humans operating under licenses with privileges owned by those humans DBA the fictitious entities of humans, under commercial statutes, without full disclosure of this legal transformation.
At no point was I told, plainly and in writing, that:
I would be considered the surety for the legal construct of humans that created, owned and virtuall controlled the IDs of it via the FRD of it.
The IDs of it were used to own and control me through as private property, collateral and data commodity of those humans dba the pagan yahudim-roman-muslim-atheist-secular state church religion known as the United States across agencies and private databases lacking my knowledge and my consent.
Me and its common law right to travel was unconstitutionally and unlawfully converted into a regulated privilege by those humans dba the State of the pagan yahudim-roman-muslim-atheist-secular state church religion that unconstitutionally, unlawfully, temporarily and/or legally fused its DOB and FRD into a single commercial record.
4. DUE PROCESS AND IDENTITY PROPERTY VIOLATIONS
Due Process.
By failing to clearly distinguish between it, the ID of it, the DOB of the ID of it, its TCOLB and its FRD, and by not informing me that I was presumed to be the surety for the ID of it, a legal fiction I didn't not create, those humans DBA fictitious entities, agents thereof and principals thereof, violated the principles of due process and fair notice. I could not consent to what was concealed, and I cannot consent to what is concealed.
Identity as Property.
Its name, likeness, and private identity were, are and always will be the Altruen Nation's private property. Forcing and/or coercing me to operate commercially under and as the IDs of it throught the FRD and TCOLB as a state assigned legal fiction, without full disclosure to me, constituted fraud, unlawful conversion and the unauthorized use of the Altruen Nation's private intellectual property via these the Altruen Nation (TAN)'s Altruen Communication Symbols (TACS) .
Constructive Trust Presumption.
Those humans DBA the AZMVD, and/or other fictitious entities of humans dba me, wrongly presumed I was the trustee of a constructive trust estate they created and owned, and that I never knowingly accepted. Said presumption of humans dba me is void ab initio due to the irrefutable fact said presumption of huamns dba me was neither disclosed to me in it, nor expressly agreed to by me in it. Silence under deception is not, was not, and never will constitute lawful consent from me.
5. EMOLUMENT LIKE ABUSE AND PROFIT FROM OFFICE
I take notice and provide notice that:
Those humans DBA officers, agents, and/or contractors of the pagan yahudim-roman-mulsim-atheist-secular state church religion DBA the State via humans dba the State BAR derived unjust compensation, fees, and institutional gain from the operation, licensing, ticketing, suspension, and data sale of the registered legal IDs of it which they managed as the owners of all IDs.
The - revenue genertated therefrom was derived from fines, penalties, interests, renewals, suspensions, surcharges, and database sharings that were based on the existence and use of the legal fictions tied to its DOB, FRD, TCOLB via its name in files and ledgers they owned and controlled.
To the extent that those humans dba principals and/or agents of the pagan yahudim-roman-muslim-atheist-secular state church religion dba the State under the State BAR had various forms of immunity and profited from the coerced use of its ID via the formerly fused DOB and FRD records, under color of law and without full disclosure to me, they functioned as an emolument like abuse of office, which was and is a fraud.
Office and position become instruments of gain built on a manipulated identity system they virtually owned and controlled.
6. MODERN HARMS AND DATA COMMODIFICATION VIA 1A PRESUMPTIONS AND RULES OF THE BAR
As a direct result of the ficititous and fraudulent structure created by humans dba me:
Its name, DOB, license number, and related records were packaged, shared, and traded across analog and digital ecosystems including insurers, credit bureaus, title companies, law enforcement networks, and private data vendors, without just compensation in lawful money (see gold (Au) and silver (Ag) coins) to me in it.
Those humans DBA the State of the pagan yahudim-roman-muslim-atheist-secular state church religion was managed by members (attorneys) and former members (justices and judges) of the BAR over all subjects wrongly presumed that I was it, and that I had consented to all commercial regulations and penalties they legally, not lawfully, tied to it by them DBA the State of the pagan yahudim-roman state church religion established in 509 BY/BC\BCE they virtually controlled.
All dealings with humans DBA the State were carried out under the hidden presumption that I had accepted the role of surety and trustee for a constructive trust I did not create, while those humans DBA the State of the pagan yahudim-roman-muslim-atheist-secular state church religion, and other fictitious entities thereunder, wrongly presumed the position of primary beneficiaries.
I rebut(ted) and refute(d) said presumptions of humans as said presumptions of humans are -, false, fraudulent, deceptive, concealed, and inequitable.
7. DEMAND FOR REDRESS, AUDIT, AND REFORMATION
I, the Altruen in it, hereby:
Reverse the fusion of its Biological Date of Birth with the File Registration Date in the AZMVD, any DMV and/or related databases that wrongly presumed I was it.
Demand a full audit trail of all AZMVD and/or DMV records, cross references, and filings connected to the legal fiction created and/or confirmed at the File Registration Date associated with its Birth Certificate.
Assert my standing ~ I am the Trustor, the Trustee and the Primary Beneficiary of the Trust I created, own and control as the living principal, beneficiary and creditor for it, not as the legal fiction, debtor, and/or surety of it. I require that my status be recognized and corrected in the files of the AZMVD, all DMVs, and all linked State and/or nation-State agency records.
Provide notice that any continued use of its identity for commercial gain, database sharing, fines and/or bonded enforcement actions, without full disclosure of this, is deemed a breach of fiduciary duty, a trust abuse, and a constructive fraud upon me in it entitled to compensation in lawful money from those humans DBA the STATE OF ARIZONA, States of the United States of America, The United States of America, member States of the United Nations, the United Nations and/or the RCC/UCC dba the State of the pagan yahudim-roman-muslim-atheist-secular state church religion over all subjects.
All images of it are private property of the Altruen Nation, and all images of it taken and/or captured via fraud subject the image takers, and/or image capturers, to fines exceeding the value of everything said image takers, and/or image capturers, believe they own(ed).
Require that any and all contracts, licenses, or agreements derived from the misrepresentation of its DOB via its FRD and its ID be produced, with evidence of full disclosure of this at the time of signing, or else considered voided ab initio.
8. FINAL DECLARATION AND RESERVATION
The name TODD ALLEN CLARK (it) is not a commodity.
It is neither public property, nor a bond, nor a file.
It is neither for sale, nor rent, nor any other form of - commerce.
It is the private property of and in the Altruen Nation.
Use of it has consequences that you, pronounced "ewe", and/or you(s), pronounced "ewes", do not control.
It was born on, at and above spherical planet Earth, neither in fictions, nor in files, nor in ledgers, you(s) control(led).
Humans dba the owners of it created and recorded fraudulent files as it, but they did not create, and cannot record, the eternal me I am currently in it.
Let the PUBLIC AND PRIVATE record reflect:
Any continued co-mingling of its Biological Date of Birth with the File Registration Date for the purpose of enforcing any commercial code, statute, license, and/or administrative jurisdiction, without full and complete audit, correction, and remedy that does not include this notice is rejected in totality.
This notice stands as private and public declaration of the truth and rebuttal of all State BAR presumptions of presumed agency and all presumed consent to act as surety or trustee for any artificial entity created or maintained by the STATE OF ARIZONA, other States of the United States of America, the United States of America and/or other fictitious entities created by humans dba the pagan yahudim-roman-muslim-atheist-secular state church religion over all subjects without consent of, by and from me.
I retain use of all its, including but not limited to, rights, powers, immunities, and jurisdiction, unalienable and/or otherwise, and all equitable remedies, with extreme prejudice to any adverse presumption and/or claim.
