Terms of Service
What do you get?
Drafts/mockups that you must decide which one I should continue with (depending on the complexity of the commission there might be fewer or more drafts)
Sketch and/or final sketches that you must approve before I continue the work
Full-resolution file of the final drawing and a smaller web-friendly version for internet upload (provided through WeTransfer).
Simplified Terms
By purchasing a commission from me, Chaotic SpellKasper (the artist), you confirm that you have read and agreed to the Terms of Service and acknowledge that if broken, will result in the loss of all of your rights to the commissioned artwork, and that I will have full rights to profit from it further the commissioned artwork in any way I see fit.
If you have a problem with any of these terms, they may be changed if discussed with me prior to paying for your commissioned piece.
Please read the terms carefully:
I, Chaotic SpellKasper (the artist), reserve the rights to;
Cancel* the order at any time for any reason. (see details in category 7. Refund Policy below)
Add a small watermark on the artwork that may NOT be removed.
Post the commissioned artwork online, in my portfolio as well as in any promotions and publications such as art books.
I retain all copyrights over the commissioned artwork.
I will NOT claim the intellectual property (IP) of the commissioned artwork. (if applicable)
I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
Once I have started on the commission, you lose the right for a refund.
Payments are done through BuyMeACoffee, this can be paid directly via card or bank, no sign up is required.
Payments are done upfront and in full, commissions over 100$ may be split into 50% up front, and 50% after a sketch has been approved.
Payment fees are not included and are covered by the buyer, usually around 5% + card fees.
The finished artwork will be sent directly to the same email the payment was made from.
You (the customer/commissioner):
May upload the commissioned artwork on any website and social channels.
May NOT make profits from the commissioned piece (reselling, redistributing, etc).
May NOT alter the commissioned artwork without my (the artist's) consent.
Retain the rights to the intellectual property (IP). (if applicable)
May NOT claim ownership or the rights to the artwork itself.
May NOT use the artwork for A.I in any way, training or otherwise.
May NOT use the commissioned artwork for commercial purposes. The commercial license for commissioned artwork may be purchased at any point - contact me for more info.
If you request a chargeback at any point when you were not allowed a refund, you will lose all rights to the commissioned piece and I will have full rights to profit from it further in any way I see fit.
I will decline the chargeback and supply the payment processors with our conversations where we talk about the commission as evidence that I have completed work for you.

1. General Terms
All drawings may or will include a subtle watermark that you may not remove.
I might record the drawing process and post it on my social media.
Prices are subject to change based on demand, and additional fees for revisions, changes, complexity, etc. may apply.
I reserve the right to cancel* any order that I do not feel comfortable drawing or do not wish to draw at any time for any reason. (see details in category 7. Refund Policy below)
2. Payment

3. Process & Delivery
I will notify you when I have started on your commission and you, therefore, lose the right to a refund. (see details in category 7. Refund Policy below)
While I'm working on your commission, I will send you previews for approval to make sure it's just right for you!
The time it takes to finish your commission varies between 5-30 days depending on factors such as health, the complexity of the piece, etc. Feel free to check in with me on the progress every now and then, but please don't spam me.
If anything comes up that will slow the progress of the initially estimated delivery time I will notify you as soon as possible.
Once the piece is finished, you will be sent a full-resolution image along with a web-friendly version directly to the same email the payment was made from.
4. Revisions
A Fee will be added if you want something changed in the final drawing - unless a misunderstanding from my side has been made.
If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it.
The amount of the extra charge depends on the change you want me to make.If your reference is unclear to start with, changes will come at an extra charge.
5. Copyright / Usage Policy
I, Chaotic SpellKasper (the artist), claim all the rights to the produced drawing, not the buyer.
Therefore I am allowed to use the copyrighted artwork to:
Promote myself with it everywhere.
Publish books with it (artbooks, etc.)
Display it everywhere to my liking (website, social media, etc.)
Post it wherever I want.
I will NOT claim the intellectual property (IP) of the commissioned artwork. (if applicable)
I will NOT profit further from the commissioned artwork unless you (the customer), break any of the terms.
The customer/commissioner is allowed to:
Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, etc.)
Print the artwork and claim the intellectual property (IP) as their own (if applicable), but not the artwork itself.
Use the artwork to promote themselves. You are not forced to give me credit when you post it but it is very appreciated.
Use the artwork on their YouTube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially, and making profits from the commissioned piece in any way (reselling, redistributing, uploading to POD-services, adopts, prints, etc).
Using the artwork in A.I in any way (training, or otherwise).
Claiming the artwork as your own.
Removing my signature/watermark from the artwork.
Altering the artwork without my consent.
I reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal/commercial use may be purchased at any time).
6. Customer Satisfaction
Transparent and quick communication is a very core part in producing piece that you would be happy with, so, if you are comfortable with it, you may add me on discord (Chaotic SpellKasper#8442) to discuss your artwork in more detail and a faster reply to time to make sure I capture all the details correctly!
If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together, revisions and changes to things you have approved previously will cost you fees and a longer wait time so it's best to be honest about what you think! :>
I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.
7. Refund / Cancellation Policy
Once I've started working on the commission, you lose the right to a refund. If you would like a refund before I start working on the commission, please do not request a chargeback unless asked. I will refund you myself.
If I were to cancel the commission, meaning I had started working on it but refuse to work on it further for any reason, you will not be provided a refund.
If you are suspected or proven to be a scammer, I reserve the right to cancel your order without providing you with a refund, you will lose all rights to the commissioned piece and I will have full rights to profit from it further in any way I see fit.
If you request a chargeback at any point when you were not allowed a refund, you will lose all rights to the commissioned piece and I will have full rights to profit from it further in any way I see fit.

If the buyer breaks any of the points stated above they will lose all the beforementioned rights to the artwork commissioned by me, Chaotic SpellKasper (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit.
Terms & Conditions for Commercial Use
These terms apply to private commissions only; This information is NOT applicable for commercial work, therefore the art can only be used for the client’s personal purposes, otherwise, it would be copyright infringement and I can and will take legal action.
If you wish to acquire rights to the image for your own non-personal/commercial use, you may contact me to purchase them at any time.
