The use of the "Tessel Pets" application (hereinafter "App") implies full acceptance of these terms. 1. Description of Services

The App provides a private digital archiving module:

Tessel Pets: A technical tool for creating a private digital archive of the life of one’s pets.

The App is provided without any preloaded database of logos or trademarks.

Every image or logo is inserted exclusively by the user through photographic acquisition.

2. Intellectual Property and Lack of Affiliation (Exclusion Clause)

Ownership of Trademarks: 

All product names, logos, trademarks, and brand images that may appear within the App belong to their respective registered owners. Tessel Pets does not claim any ownership, license, or title over such trademarks.

No Affiliation: 

This application is an independent project and is not in any way affiliated, associated, authorized, sponsored, or officially connected with any of the brands, companies, or commercial entities displayed or uploaded by the user. The use of logos or names occurs solely for identification and descriptive purposes, and to assist the user in the personal organization of their items (private copy).

3. “Zero-Knowledge” Architecture and Confidentiality

The Author adopts a policy of total absence of access to user data:

Local Residency: 

Tessel Pets data resides exclusively in the physical memory of the user’s device.

The Author guarantees that no data leaves the device toward external servers managed by the Author or third parties.

Pseudonymized Identity: 

The user is identified only by a randomly generated unique code.

This code does not allow the Author to trace the user’s real identity, contacts, or location.

4. User Responsibility

The user is the sole and exclusive responsible party for the legality and content of the stored data:

Ownership: 

The user declares to be the legitimate owner of the documents and information digitized.

5. Warranty Disclaimer and Limitation of Liability (Software “As-Is”)

The App is provided “as-is” and “as available,” without any explicit or implicit warranty of any kind (functionality, absence of bugs, suitability for specific purposes):

Bugs and Errors: 

The Author does not guarantee that the software is completely free of bugs, programming errors, or technical interruptions.

Data Loss: 

The Author assumes no responsibility for accidental data loss resulting from hardware failures, device theft, or App uninstallation.

Backup Responsibility: 

Since data resides only on the device, the responsibility for performing periodic backups (Export) lies entirely with the user.

The Author has no technical means to recover lost data.

Limitation of Damages: 

In no case shall the Author be held liable for direct or indirect damages, incidental or consequential, financial (such as loss of assets or missed profits) or non-financial (emotional or personal impact), including but not limited to: data loss, loss of time, lost profits, stress, or reputational damage resulting from the use or malfunction of the App.

7. Intellectual Property and License Agreement (EULA)

7.1 Ownership and Copyright:

 The “Tessel Pets” application—including but not limited to the software, graphic design, user interface, data architecture, badges, and documentation templates—is an intellectual work protected by applicable copyright and intellectual property laws.

All intellectual and industrial property rights belong exclusively to the Author.

7.2 License of Use:

 Access to the application and any subscription purchase grants the user a personal, non-exclusive, non-transferable, and revocable license.

This license does not constitute a sale or transfer of the software, but only a limited right to use the functionalities provided by the service.

7.3 Strict Prohibitions:

The user is expressly prohibited—under penalty of immediate license revocation and compensation for damages—from:

Copying, reproducing, distributing, publicly communicating, or publishing, even partially or in derivative form, the contents and functionalities of the application.

Performing reverse engineering, decompilation, disassembly, or any attempt to extract the source code.

Using data scraping techniques, robots, or other automated tools to monitor or copy the application or its contents.

Sublicensing, renting, selling, or transferring to third parties the rights granted by this license.

7.4 Legal Protection:

Any violation of copyright or license terms will be pursued civilly and criminally in the competent courts, with full recovery of legal costs and damages.

8. Modifications and Jurisdiction

The Author reserves the right to modify these terms at any time.

For any legal dispute, the exclusively competent court is that of Rome, Italy.

9. Changes to These Terms

The Author reserves the right to modify these terms at any time.

Continued use of the App after such changes constitutes acceptance of the new terms.

• Tessel Pets: A technical tool for creating a private digital archive of the life of one’s pets. The App is provided without any preloaded database of logos or trademarks. Every image or logo is inserted exclusively by the user through photographic acquisition.

3. User Responsibility and “As‑Is” Software

• Use:  The user is solely responsible for the legality of the data they enter. The user declares that they use the App because they consider it suitable for their needs and appropriate for their purposes.

• Acceptance:  Acceptance of the digital format is entirely at the discretion of the third party (merchant/authority). The Author is not responsible for refusals or missed benefits.

• Warranty:  The software is provided “as‑is”. The Author does not guarantee the absence of bugs or technical errors and is not responsible for accidental data loss (documents or cards) due to hardware failure, theft, uninstallation, or malfunction. The responsibility for backups (via the Export function) lies solely with the user; the provisions of point 5 of the EULA/T&C apply.

4. Reporting and Transparency

• Since the Author has no access to the data stored locally on users’ devices, there is no technical possibility to monitor or remove privately inserted content. However, the Author remains available for reports concerning the functionality of the App:

Privacy Policy

Tessel Pets (“the Author”, “we”, or “us”) operates the Tessel Pets mobile application (the “Service”).

This policy describes our privacy protection principles, with emphasis on the exclusively local and pseudonymized nature of the data handled.

1. Privacy Principle and Local Data Storage:

The fundamental principle of Tessel Pets is the absence of data collection.The App is designed to function without requesting or transmitting your real identity.

• No Direct Personal Data: We do not collect, request, or store identifying information such as name, surname, email address, or phone number.

• Local Storage:   All data entered by the user (names, documents, images, codes, notes, and more specifically all elements that make up saved Events and Documents) are stored exclusively in the physical memory of the user’s device. No content is uploaded to external servers or databases managed by the Author, except for the legal_consents registry, which records the acceptance of the Terms of Use/EULA/T&C, Legal Notes, and Privacy Policy at the very first launch of the App. These consents are stored on external Supabase servers together with the anonymous unique technical identifier described in section 2 below, and with the date and time of acceptance. However, this registration does not allow the Author to trace the user’s identity through the technical identifier, as further clarified in section 2.

• Impossibility of Identification:   The Author has no technical ability to access the data contained in the App, nor to identify the user or track their activities.

2. Technical Identifier  (vUserOwnerID) :

In accordance with the Terms of Use, the App generates a random, anonymous, unique technical identifier on the device.

• This code is used exclusively for technical purposes related to the acceptance of the Terms of Use/EULA/T&C, Legal Notes, and Privacy Policy associated with the license.

• The unique identifier is not linked to any real identity and is not visible to the user in any section of the App. The Author does not maintain any central database in which this key is associated with real individuals.

3. Diagnostic Data and Third‑Party Collection:

We collect only minimal aggregated data provided by distribution platforms:

• Store Statistics:  Information provided by Apple App Store or Google Play Store (number of downloads, device models, anonymous crash statistics) for the sole purpose of technical improvement.

4. User Control and Data Deletion:

• Right to Removal:  The user has full and total control over their data. Deleting an event, a document, or any record within the App instantly and permanently removes the data from the device’s memory. 

• Uninstallation:  Since data resides only on the device, uninstalling the App results in the complete deletion of the entire archive. The Author does not retain any backup copy on their systems.

• Premium Backup and Restore Option:  Premium users may perform a full backup of their data archive, saving it to external storage or third‑party cloud services of their choice. The user is solely responsible for the backup procedure and any subsequent restoration.

• User Responsibility:  It is the user’s exclusive responsibility to periodically back up their data archive to prevent loss. This notice is provided in a dedicated informational section within the App; the provisions of point 5 of the EULA/T&C apply.

5. Diritti dell'Interessato (GDPR)

In conformità con il Regolamento UE 2016/679 (GDPR), l'utente può esercitare i propri diritti scrivendo a: optima.apps.lab@gmail.com. Tuttavia, non conservando l'Autore alcun dato personale o identificativo sui propri server, la maggior parte delle richieste di accesso o cancellazione si risolvono autonomamente tramite l'uso delle funzioni interne all'App (Cancellazione/Disinstallazione).

6. Data Deletion Requests:

• Data Deletion Request:  Because Tessel Pets uses a local‑storage architecture, the Author does not hold or manage centralized databases containing users’ files or personal information.

• User Autonomy:  Each user can delete their data entirely and immediately by removing individual records/documents within the App or by uninstalling the App from their device.These actions permanently remove all data from physical memory, with no copy retained by the Author.

Richiesta Cancellazione dei dati

Data Deletion Request

Since Tessel Pets adopts a local storage architecture, the Author does not hold or manage centralized databases containing users' personal files or information.

1. User Autonomy: Every user can proceed with the full and immediate deletion of their data simply by deleting individual cards/documents within the App or by uninstalling the application from their device. These actions permanently remove all traces of data from the physical memory, with no copy remaining with the Author.

2. Technical Support: For assistance or to check the pseudonymization status of their license, the user can write to: optima.apps.lab@gmail.com. However, it is reiterated that the aforementioned unique identifier is the only existing technical identifier, which does not allow the Author to trace the user connected to it, and that the Author has no access to the private contents stored on the user's device.
