Terms of Use

These Terms of Use ("Terms") describe the conditions for using the 608 Ready iPhone application (the "App"), provided by Dmitrii Iakovenko under the Cyber Sparrow Games name ("we," "us," or "our"). Please read them before using the App or purchasing paid access.

Independent study for EPA Section 608. 608 Ready is not affiliated with, approved by, or endorsed by the U.S. Environmental Protection Agency (EPA). The App does not administer the official certification exam, issue a certification, or guarantee a passing score.

1. Educational purpose

The App provides practice questions, answer explanations, source links, study history, and mock exams for independent preparation. Core, Type I, Type II, Type III, and Universal references describe study areas or practice profiles; using those names does not make the App an official certification program.

Practice results and any practice benchmarks are learning aids. They do not establish competence, authorize regulated work, or predict your result on an official exam. Confirm certification requirements and exam arrangements with an appropriate testing organization and the EPA's Section 608 certification information.

The App is not a substitute for applicable regulations, equipment instructions, required training, or safe workplace procedures. It does not provide individualized technical, legal, or safety advice. Educational material may contain errors or become outdated. Consult current authoritative sources before making regulatory or operational decisions.

2. Accounts and eligibility

No separate Cyber Sparrow Games account or registration is required. Purchases and restoration use the Apple Account associated with the App Store. You must be authorized to use that account and its payment method. Where required by applicable law, a parent or legal guardian must authorize a minor's use and purchases.

3. App license and Apple terms

The license for the App is governed by the Apple Standard Licensed Application End User License Agreement (Standard EULA). Apple's applicable store terms and Usage Rules also apply.

These Terms explain the App's educational content and paid services. They supplement the Standard EULA and do not replace it or reduce rights granted under it. The Standard EULA controls any conflict on a matter it governs, subject to mandatory applicable law.

4. Free features and paid access

The App includes a free selection of study questions across Core and Types I, II, and III. You may practice the free selection repeatedly, read its explanations, save questions, and keep local study progress without a purchase.

Optional Monthly Pro and Full Access unlock the same full study library and related practice and review tools available in the App, including the Universal mock-exam profile. The purchase screen describes the features included before you pay.

Monthly Pro provides access while the subscription entitlement is active. Full Access is a non-consumable, one-time purchase for this App with no recurring charge. Full Access does not include unrelated apps, future separate products, certification services, or a promise of perpetual service or support.

After a subscription ends, you may continue using free content. Saved completed-session results and their explanations remain readable on the device unless you remove them. New practice sessions involving paid content require an active entitlement. A paid session that has already started may be completed.

5. Prices and payment

Available products, localized prices, currency, and billing terms are shown in the App and Apple's purchase confirmation before you authorize a purchase. The displayed monthly price is charged for each monthly subscription period; the Full Access price is a single charge. Taxes and local pricing are handled by the App Store as applicable.

Payment is processed by Apple using the payment method associated with your Apple Account. We do not directly process your card details. There is no free trial for Monthly Pro. The App's free study selection is available independently of any purchase.

6. Monthly Pro renewal and cancellation

Monthly Pro is an auto-renewable subscription. It renews each month until you cancel renewal through Apple. The renewal price and billing date are available in your Apple subscription settings. Price changes are handled under Apple's applicable notice and consent procedures and applicable law.

You can manage or cancel in iPhone Settings → your name → Subscriptions → 608 Ready, or use the App's subscription-management control. Cancel before the renewal date to avoid the next charge. After cancellation, access normally continues until the paid period ends, subject to Apple's rules and any applicable refund or regional cancellation provisions.

Deleting the App, resetting progress, disabling reminders, or ceasing to use the App does not cancel a subscription. See Apple's cancellation instructions.

7. Full Access and existing subscriptions

Full Access has no automatic renewal. Buying Full Access does not automatically cancel a Monthly Pro subscription associated with your Apple Account. If you hold both, manage the monthly subscription separately through Apple to prevent further renewal charges.

Paid access depends on a valid purchase entitlement. A refunded or revoked purchase may no longer provide access. Availability remains subject to compatibility, the offer made at purchase, Apple's rules, and your statutory rights.

8. Restoring purchases and offline use

Use Settings → Restore purchases or Restore on the purchase screen while signed into the Apple Account used for the original purchase. Restoration checks eligible existing purchases and does not initiate a second purchase.

The study library is included in the App and can be used offline with the access already available on your device. An internet connection may be required to purchase, restore or refresh access, and to open external references. A subscription is not extended merely because the device is offline.

Study progress is stored locally and is not synchronized by us between devices. Restoring a purchase restores eligible access, not local study history. Keep any device backups you need through your chosen backup service.

9. Refunds and consumer rights

For purchases billed by Apple, request a refund through reportaproblem.apple.com. Eligibility is determined under Apple's policies, the circumstances of the purchase, and applicable law. See Apple's refund instructions.

Cancellation and a refund are separate actions; cancelling renewal does not automatically request or guarantee a refund. Nothing in these Terms excludes mandatory cancellation rights, refunds, warranties, or other consumer protections.

10. Privacy and local data

Our Privacy Policy explains local study storage, optional reminders, Apple purchases, external links, and information you choose to send to support. The App has no account requirement, advertising, or analytics SDK.

You control your device and local progress. Resetting the current library's progress clears its answers, bookmarks, and sessions. Removing the App may remove local study data. Purchase cancellation must be handled separately through Apple.

11. Intellectual property and acceptable use

Rights in the App's software, design, graphics, and other protected material belong to their respective rights holders. No ownership of referenced government publications, third-party materials, trademarks, or examination content is asserted merely because they are cited or discussed. A source link does not imply endorsement or transfer a license to third-party material.

Use the App within the scope of the Standard EULA and applicable law. Do not unlawfully redistribute protected material, misrepresent the App as an official certification provider, bypass purchase controls, or interfere with the App's security or operation. These restrictions do not remove uses or rights permitted by applicable law or an applicable license.

12. Updates and availability

We may update the App and study material to correct information, fix problems, improve accessibility, or support compatible systems. Content wording, organization, and individual questions may change. External websites and Apple services may also change or become temporarily unavailable.

Changes to paid features remain subject to the offer made at purchase, Apple's rules, and applicable consumer rights. These Terms do not permit us to disregard obligations for a paid subscription period or a one-time purchase.

13. Disclaimers and liability

We do not guarantee that all educational material is complete, current, or error-free, that the App will be uninterrupted, or that using it will produce a particular exam result. Where legally permitted, the warranty and liability provisions of the Apple Standard EULA apply.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or overrides mandatory consumer guarantees. Your rights under applicable law remain unaffected.

14. Ending use and changes to these Terms

You may stop using and uninstall the App at any time. Cancellation of an active subscription is a separate step. Termination of the App license is governed by the Standard EULA, subject to applicable law. Rights and obligations already accrued are not automatically erased when you stop using the App.

We may update these Terms to reflect changes in the App, store requirements, or applicable law. The current version will be posted at the 608 Ready Terms of Use page with an updated date. We will provide additional notice or obtain consent where required. Changes will not retroactively remove rights you have already acquired where prohibited by law. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
