These Terms of Service (“Terms”) govern your use of services provided by ScaleX Prime, operated by Malay Kanyal.
By engaging our services, you agree to these Terms.

ScaleX Prime offers:
Digital marketing campaigns (e.g., Meta Ads)
Client communication services via SMS, email, and other digital channels
SMS notifications to clients with new lead details
Confirmation and transactional messages to leads after form submissions
Optional marketing campaigns such as customer reactivation or review requests (only with recipient consent)
3. Compliance with Messaging Regulations
Marketing SMS messages are only sent to recipients who have explicitly opted in.
All opt-ins are collected via approved methods such as lead forms, landing pages, and direct consent.
Recipients can opt out by replying STOP to any SMS or text HELP for assistance.
Message frequency may vary; message and data rates may apply.
4. Responsibilities of Clients
Clients agree to:
Provide accurate business and contact information for registration purposes (including A2P 10DLC brand registration, if applicable)
Ensure any contact lists provided have the required consent for messaging
Comply with applicable laws such as TCPA, CTIA, GDPR, and local marketing regulations
5. Use of Client Business Information
When registering phone numbers for A2P 10DLC or local use, ScaleX Prime may use the client’s legal business name, EIN, and address for compliance purposes.
This ensures registration details match the business that owns the messaging use case.
6. Prohibited Uses
Clients may not use our services for:
Sending unsolicited marketing messages (“spam”)
Fraudulent, deceptive, or misleading activities
Messages containing illegal or prohibited content under applicable laws or carrier guidelines
7. Privacy and Data Use
Our collection, use, and protection of data is outlined in our Privacy Policy.
We do not sell, rent, or lease personal data to third parties for marketing purposes.
8. Limitation of Liability
ScaleX Prime is not liable for:
Carrier filtering or message delivery delays
Incorrect contact information provided by clients
Damages resulting from misuse of the services by the client
9. Changes to Terms
We may update these Terms from time to time. The “Last Updated” date reflects the latest changes.
