Terms of Use — Armenian Everyday

These Terms of Use (“Terms”) govern your use of Armenian Everyday (the “App”), provided by Dmitrii Iakovenko under the Cyber Sparrow Games name (“Cyber Sparrow Games,” “we,” “us,” or “our”).

These Terms apply to the Android, iOS, and iPadOS versions of the App when available. Platform-specific provisions apply only to the version and store concerned.

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App. Nothing in these Terms limits rights that cannot lawfully be limited, including mandatory consumer rights available in your country or region.

1. Educational purpose

Armenian Everyday is an independent educational application for learning and practising modern conversational Eastern Armenian through words, phrases, dialogues, alphabet exercises, review activities, cultural material, and locally bundled educational speech playback.

The App is not an accredited language school, examination provider, translation service, immigration service, or government service. It does not guarantee fluency, examination results, employment, admission, immigration status, or any other particular outcome.

Armenian usage can vary by speaker, region, context, register, and dialect. Translations, explanations, and pronunciation hints are provided for learning purposes and may be approximate. Pronunciation hints are not an official transcription standard and are not a substitute for listening to or working with a qualified native speaker or teacher.

Examples involving pharmacies, healthcare, banking, employment, travel, documents, law, emergencies, or similar situations are language-learning examples only. They are not medical, financial, legal, safety, or other professional advice. Although we work to improve the content, educational material may contain mistakes or become outdated. You should not rely on the App for decisions that could significantly affect your health, safety, finances, legal position, or rights.

2. Eligibility and minors

The App is intended for a general audience, primarily teenagers and adults. It is not specifically directed to children under 13.

If you are below the age at which you may enter into a binding agreement in your country, a parent or legal guardian must review and accept these Terms on your behalf. A parent or guardian must authorise purchases made by a minor. Product Insights and other processing are described in the Privacy Policy.

3. Accounts

No separate Armenian Everyday or Cyber Sparrow Games account is required. Purchasing, managing, or restoring paid content may require the Apple Account or Google Account associated with the relevant app store. Those store accounts are provided and controlled by Apple or Google, not by Cyber Sparrow Games. You must be authorised to use the relevant store account and payment method.

4. App licence and platform terms

iOS and iPadOS

For the App obtained through Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement governs the software licence. These Terms provide additional terms concerning the App’s educational content, paid functionality, privacy, and services. They do not replace or reduce rights granted under Apple’s Standard EULA or mandatory law. Apple’s applicable Media Services Terms and Conditions and App Store Usage Rules also apply.

Android

Subject to these Terms and the applicable Google Play Terms of Service, we grant you a limited, revocable, non-exclusive, non-transferable licence to install and use the App for personal, non-commercial purposes on compatible devices that you own or are authorised to use. The App is licensed, not sold. No ownership of the App, its software, or protected educational content is transferred to you.

5. Free functionality and paid content

The App includes free functionality and may offer optional paid content. The current free offering may include Level 1 learning material, a limited number of new lessons per local day, a limited number of mistake-review items per local day, the Armenian alphabet, learned words, saved items, ordinary review, basic progress information, and the current Culture card.

Core Premium subscription access may include unlimited new lessons, Level 2 and higher learning material, unlimited mistake review, detailed history, accuracy and weekly comparisons, and access to the complete Culture archive.

Where displayed in the App and store, we may also offer one-time purchases: Core access for life, individual advanced courses, and an All 6 Courses bundle. A one-time purchase does not renew automatically. Advanced courses are sold separately from Core Premium unless a store listing or purchase screen expressly says otherwise.

The purchase screen describes the benefits included in the version of the App available to you. Store listing text and the in-App purchase screen take precedence if the available offer has changed. We may correct, reorganise, add, replace, or remove individual lessons, words, phrases, translations, exercises, illustrations, or cultural cards. We will not intentionally remove the essential substance of an active paid offering except where reasonably necessary for legal, security, quality, or technical reasons and subject to applicable consumer law.

All paid access depends on a valid store entitlement and may require an internet connection for purchase, restoration, or verification.

6. Subscription plans, one-time purchases, prices, and renewal

Where Core Premium subscriptions are available, they may be offered through monthly and annual auto-renewable subscriptions. The exact plan name, billing period, price, currency, taxes, included benefits, and any introductory offer are displayed before purchase. The amount displayed by the store for a plan is the charge for the stated billing period unless the purchase screen expressly states otherwise.

Subscriptions renew automatically until cancelled through the store used for purchase. Any price change is handled under the relevant store’s notification, consent, and consumer-protection procedures. If a free trial or introductory offer is available, its duration, eligibility conditions, subsequent price, and renewal terms will be displayed before confirmation. No trial or discount exists unless it is expressly shown by the store.

One-time purchases, including Core access for life and separate advanced courses where offered, are charged once and do not renew automatically. Their exact price, currency, included content, and any bundle terms are displayed before purchase. Deleting the App, resetting progress, ceasing to use the App, or turning Product Insights off does not cancel an active subscription.

7. Apple App Store purchases

Purchases made on iOS or iPadOS are processed by Apple and charged to the payment method associated with your Apple Account. Apple manages subscriptions, one-time purchases, refunds, and store entitlements under its applicable terms.

A subscription renews for the selected billing period unless it is cancelled. Apple may process the renewal charge shortly before the next subscription period begins. You can manage or cancel an Apple subscription through Apple subscription management. Cancel before renewal to avoid the next charge. Apple recommends cancelling a free or discounted trial at least 24 hours before the trial ends. After cancellation, subscription access normally remains available until the end of the period already paid for, unless Apple, applicable law, or the relevant offer provides otherwise.

8. Google Play purchases

Android purchases are processed through Google Play and charged to the payment method associated with your Google Account. Google Play manages subscriptions, one-time purchases, refunds, and store entitlements under its applicable terms.

A subscription renews for the selected billing period unless cancelled. You can manage a Google Play subscription through Google Play subscription management. Cancellation normally prevents future renewal charges while allowing subscription access to continue until the end of the period already paid for, unless Google Play, applicable law, or the relevant offer provides otherwise.

9. Restoring purchases and multiple devices

Eligible subscriptions and one-time purchases may be restored by using the same store account used for the original purchase and the App’s Restore Purchases function where available. Restoring checks existing purchase entitlements; it does not create a new subscription or charge you again.

Access may be unavailable if an entitlement has expired, been refunded, revoked, cancelled with immediate effect, or cannot currently be verified. App Store and Google Play purchases are managed separately. Because the App has no cross-platform account system, a purchase through one store does not automatically unlock content through the other store. Learning progress is stored locally and does not currently synchronise between devices. Restoring a purchase therefore does not necessarily restore lesson progress, saved words, preferences, or learning history.

10. Refunds

Cancelling a subscription does not automatically request or guarantee a refund. For purchases billed by Apple, submit eligible refund requests through Apple’s Report a Problem service. For Google Play purchases, refund eligibility and requests are governed by Google Play’s refund policies. Nothing in these Terms excludes mandatory refund, cancellation, warranty, or consumer-protection rights.

11. Privacy, Product Insights, and permissions

Our Privacy Policy explains how information is processed.

On production iOS and iPadOS App Store installations, the App may use Google Analytics for Firebase for first-party Product Insights. This use is enabled by default in that production environment and can be turned off at any time at Home → Settings → About → Product Insights. Firebase Analytics is blocked in Xcode, TestFlight, StoreKit Sandbox, and other non-production iOS environments. On Android, analytics remains disabled until enabled through Settings.

The App does not display third-party advertising, use App Tracking Transparency, use IDFA, or track users across apps or websites. It does not use the microphone, record your voice, or access speech-recognition services. Optional practice reminders use device notification functionality. You may refuse or revoke notification permission without losing access to lessons or paid content.

12. Local data and no cloud synchronisation

Learning progress, lesson history, weekly plans, preferences, and related information are primarily stored locally on your device. The App does not currently provide account-based cloud synchronisation. Uninstalling the App, clearing App storage, changing devices, or losing a device may therefore result in loss of learning progress. Your operating system or device backup service may separately back up App data according to your Apple or Google account and device settings. Those backup services are controlled by the relevant platform provider.

13. Intellectual property

Rights in the App’s original software, design, graphics, illustrations, translations, explanations, exercise structure, selection, arrangement, and original educational material belong to Cyber Sparrow Games or the relevant rights holders. We do not claim ownership over the Armenian language, common words or phrases, historical facts, or public-domain material merely because they appear in the App.

Except where permitted by applicable law or an applicable open-source licence, you must not copy, redistribute, sell, sublicense, or commercially exploit the App or substantial parts of its protected content; systematically extract, scrape, reproduce, or republish the lesson database; bypass paid-access controls or interfere with purchase verification; reverse engineer, disassemble, or modify the App in violation of applicable law or licence terms; remove proprietary notices; impersonate Cyber Sparrow Games or misrepresent the source of the App; introduce malware or interfere with the App’s security or operation; or use the App unlawfully. These restrictions do not override mandatory rights or rights granted by applicable open-source licences.

14. Cultural sources and third-party links

Culture cards and other educational material may include links to museums, cultural institutions, public authorities, tourism resources, Apple, Google, or other third-party websites. Third-party websites are controlled by their respective operators. We do not control their availability, accuracy, security, or privacy practices. Visiting them is subject to their own terms and privacy policies. A link does not necessarily mean that the third party sponsors or endorses Armenian Everyday.

15. Updates and availability

We may release updates to improve lessons, correct translations, add content, improve accessibility, address security issues, or adapt the App to operating-system and store requirements. Some updates may require a supported operating system, compatible device, internet connection, or newer App version. The App or particular features may occasionally be unavailable because of maintenance, network problems, store interruptions, verification failures, or circumstances beyond our reasonable control. We may discontinue the App or a feature, subject to applicable law and obligations relating to active paid subscriptions or one-time purchases.

16. Disclaimer of warranties

The App is provided as an educational tool on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee that all material is complete, accurate, current, or error-free; translations or pronunciation hints will be suitable for every speaker or context; the App will operate without interruption on every device; every feature will remain available indefinitely; or using the App will produce a particular learning outcome. Nothing in this section excludes warranties, consumer guarantees, or remedies that cannot lawfully be excluded. For the iOS and iPadOS versions, applicable warranty provisions in Apple’s Standard EULA remain in effect.

17. Limitation of liability

To the maximum extent permitted by applicable law, we are not responsible for indirect, incidental, special, or consequential loss arising from use of the App, inability to use it, loss of locally stored progress, or reliance on educational content. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, or mandatory consumer guarantees.

18. Misuse and termination

We may restrict access where reasonably necessary to address fraud, unlawful activity, material misuse, payment reversal, unauthorised paid access, or interference with security. Any action affecting paid access remains subject to the applicable store rules, the status of the purchase, mandatory law, and rights already acquired for the paid period or purchase. You may stop using and uninstall the App at any time. Subscription cancellation must be completed separately through the store used for purchase; one-time purchases do not require cancellation.

19. Governing law and disputes

To the extent that a choice of law is permitted, these Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles. This choice does not deprive you of mandatory consumer protections or rights to bring a claim before a court or dispute-resolution body available under the law of your habitual residence. Before commencing formal proceedings, you may contact us so that we can attempt to resolve the issue informally.

20. Changes to these Terms

We may update these Terms to reflect changes to the App, paid offering, platform requirements, or applicable law. The current version will be published at the Armenian Everyday Terms URL with an updated date. Where required, we will provide additional notice or request acceptance before a material change takes effect. Changes will not retroactively reduce rights already acquired for a paid subscription period or one-time purchase where prohibited by law. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
