These Terms and Conditions ("Terms") govern your access to and use of TechNova’s mobile and web applications, including the Assembly Tracking App and the Pricing App and any related services provided by TechNova.
1. Acceptance of Terms By accessing, using, or registering for any part of the Apps or services, you agree to be bound by these Terms and all other policies referenced herein, including our Privacy Policy. If you do not agree to these Terms, you may not access or use the Apps.
2. License to Use We grant you a non-exclusive, non-transferable, revocable, limited license to access and use the Apps solely for your internal business purposes, subject to your compliance with these Terms.
3. User Responsibilities You agree to:
Provide accurate, current, and complete information when prompted by the Apps or when communicating with TechNova.
Use the Apps solely for lawful purposes and in compliance with these Terms.
Not misuse the Apps for any unlawful, harmful, or fraudulent activities.
Not attempt to reverse-engineer, decompile, hack, modify, or otherwise interfere with the proper working of our software or Apps.
Maintain the confidentiality of your account credentials and be responsible for all activities that occur under your account.
4. Communication Consent By providing your phone number and/or email address to TechNova through the Apps or any associated forms, you expressly consent to receive essential transactional notifications and updates from us. These communications may include, but are not limited to, order status updates, service notifications, and billing information.
SMS Notifications: You understand that message frequency will vary based on your account activity and that standard message and data rates may apply. You may opt out of SMS notifications at any time by replying STOP to any message you receive from us. Replying HELP will provide contact information for assistance.
5. Subscription & Payment (If applicable) Access to certain features or services within the Apps may be subject to a monthly or one-time setup fee. All applicable payment terms, conditions, and pricing will be clearly communicated and agreed upon before service begins.
6. Intellectual Property All code, designs, graphics, text, content, features, and functionality within the Apps are and will remain the exclusive property of TechNova and its licensors. You may not copy, distribute, reproduce, sell, or create derivative works from any part of the Apps without our express written permission.
7. Data & Confidentiality Your privacy is important to us. We handle your data responsibly and do not sell, trade, or rent your personal information to third parties. You retain ownership of any business data you input into the Apps. 8. Disclaimer of Warranties The Apps and all related services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Apps will be free from bugs, errors, or uninterrupted service.
9. Limitation of Liability In no event shall TechNova, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Apps; (ii) any conduct or content of any third party on the Apps; (iii) any content obtained from the Apps; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
10. Termination We reserve the right to suspend or terminate your access to the Apps and services immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Apps will immediately cease.
11. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
12. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Apps after those revisions become effective, you agree to be bound by the revised terms.
