TERMS OF SERVICE — TEA & COFFEE

These Terms of Service ("Terms") govern your use of the Tea & Coffee mobile application ("App") published by ATA Forge ("we", "us", "our"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. THE APP
Tea & Coffee is a beverage-encyclopedia App that provides educational information about teas, coffees, their history, origins, and traditional preparation methods. The App offers:
• A free tier supported by advertising.
• A Premium subscription that removes ads and unlocks additional content.
2. LICENSE
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for non-commercial purposes on any device you own or control, in compliance with these Terms and the rules of the App Store / Google Play.
You may not:
• Copy, modify, decompile, reverse-engineer or create derivative works of the App.
• Sell, rent, sublicense, distribute or transfer the App or your access to it.
• Use the App to violate any law, regulation or third-party right.
• Attempt to bypass security, ads, or paywalls.
• Use automated means (bots, scrapers) to access the App.
3. AGE REQUIREMENT
The App is intended for users aged 13 and over (or the equivalent minimum age in your jurisdiction). If you are below that age, do not use the App.
4. SUBSCRIPTIONS (PREMIUM)
4.1 Pricing and plans
Premium is offered as auto-renewing subscriptions (Monthly, Yearly) and a one-time non-consumable Lifetime purchase. Current prices are displayed inside the App at the moment of purchase. We use USD as the base currency; the App Store / Google Play converts to your local currency at their published rates.
4.2 Billing
Payment is charged to your Apple ID or Google Play account at the moment of confirmation. Auto-renewing subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the renewal date.
4.3 Managing or cancelling
iOS: Settings → [Your Name] → Subscriptions
Android: Google Play app → profile → Payments & subscriptions → Subscriptions
4.4 Refunds
Refund requests are handled by Apple or Google under their respective policies. We do not directly process refunds, but we will assist where reasonable. Contact us at hello@ataforge.com.
5. ADVERTISING
The free tier shows advertisements via Google Mobile Ads. Ad personalization depends on the consent you provide in the in-App consent dialog (and, on iOS 14.5+, in the App Tracking Transparency prompt). You can change your consent at any time in Settings → Privacy.
6. INTELLECTUAL PROPERTY
The App, its design, code, trademarks, illustrations, photographs (or their licenses) and aggregated content are owned by ATA Forge or its licensors and are protected by copyright, trademark and other laws.
7. THIRD-PARTY CONTENT AND SERVICES
The App references and links to third-party content (videos, brands, websites). We are not responsible for third-party content. Your interaction with third parties (e.g. Apple, Google, RevenueCat) is governed by their terms and privacy policies.
8. DISCLAIMER OF WARRANTIES
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied or statutory, including without limitation merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the App will be uninterrupted, error-free, secure, or free of viruses.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, in no event will ATA Forge, its officers, employees, agents or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the App.
In any case, our total liability for any claim arising out of or relating to the App is limited to the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) USD 50.
10. INDEMNITY
You agree to indemnify and hold ATA Forge harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your violation of these Terms, your misuse of the App, or your violation of any law or third-party right.
11. TERMINATION
We may suspend or terminate your access to the App at any time, with or without notice, for any reason including breach of these Terms. You may stop using the App at any time by uninstalling it.
12. CHANGES TO THE APP AND TERMS
We may update the App and these Terms from time to time. Material changes will be announced inside the App or via the store listing. Continued use of the App after a change constitutes acceptance.
13. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Disputes shall be brought before the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts, unless mandatory consumer-protection law of your country of residence grants you the right to a different forum.
Nothing in this section affects mandatory consumer rights under your local law.
