Terms and Conditions — Tapzy: Auto Clicker & Macro

These terms are the agreement between you and MD Developer Studio ("we", "us"), of Surat, Gujarat, India, covering your use of the Android application Tapzy: Auto Clicker & Macro (com.tapzy.app).

By installing or using Tapzy, you agree to them. If you do not agree, please uninstall the app.

1. WHAT TAPZY IS

Tapzy automates taps and swipes on your own device, at coordinates you choose, at a speed you choose. It does this through Android's Accessibility Service, which you enable yourself and can disable at any time.

Tapzy is a tool. What you point it at is your decision and your responsibility.

2. YOUR LICENCE

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Tapzy on devices you own or control, for your own use.

You may not:

- copy, redistribute, sell or sublicense the app;

- reverse-engineer, decompile or disassemble it, except where that right cannot lawfully be restricted;

- remove or obscure any notice of ownership;

- use the app to break the law.

We keep all rights not expressly granted here, including all rights in the Tapzy name, the mascot, the icon and the app's design.

3. ACCEPTABLE USE — PLEASE READ THIS ONE

You are responsible for complying with the rules of whatever you use Tapzy on.

Many games, apps and online services prohibit automation, macros or bots in their own terms of service. Using Tapzy with them may get your account warned, suspended or permanently banned, and may cause you to lose purchases, progress or items associated with that account.

We have no relationship with those services, no control over their enforcement, and no ability to recover an account you lose. Check their terms before you automate them. If you choose to proceed anyway, that consequence is yours alone.

You also agree not to use Tapzy:

- on a device that is not yours, or without the device owner's permission;

- to interfere with, overload or gain unauthorised access to any service;

- to commit fraud, manipulate votes, polls, ratings or rewards, or misrepresent automated activity as human as part of a scheme to deceive;

- for anything unlawful where you live.

4. THE ACCESSIBILITY PERMISSION

Tapzy asks for Android's Accessibility Service permission because it is the only mechanism Android provides for one app to tap on your behalf.

Tapzy's service is configured so that it cannot read your screen contents and cannot observe what you type. The technical detail is in our Privacy Policy. You grant this permission yourself, in Android's settings, and you can withdraw it at any time in the same place. Withdrawing it stops Tapzy from tapping; it does not delete your presets.

5. TAPZY PRO

Some features require Tapzy Pro, a one-time purchase.

Purchases are processed by Google Play Billing. We never see or handle your payment details.

"Lifetime" means for as long as Tapzy is available on Google Play and you keep the Google account you bought it with. It is not a promise that the app will exist forever.

Refunds are governed by Google Play's refund policy. We cannot issue refunds ourselves, because we do not take the payment. Please contact Google Play support for refund requests.

We may change which features sit behind Pro in future versions. Features you have already paid for will not be taken away from you.

6. ADVERTISING

The free version of Tapzy shows advertisements supplied by Google AdMob. We do not control which specific ads are shown and are not responsible for their content, or for anything you buy from an advertiser. Buying Pro removes the ads.

7. WHAT WE DO NOT PROMISE

Tapzy is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We specifically do not promise that:

- Tapzy will work with every app or game. Android blocks injected input in windows marked FLAG_SECURE, which includes banking apps and some video apps, and that is the operating system's decision rather than something we can override;

- Tapzy will defeat, or should be used against, any app's anti-automation measures;

- runs will never be interrupted. Some manufacturers' battery management terminates background work aggressively, and Android may stop a service at any time;

- the app will be free of bugs, or available without interruption.

Tap rates depend on your device. Android's accessibility pipeline combines gestures requested faster than it can deliver them, so the achievable rate is a property of your hardware and operating system, not a number we can guarantee.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, accounts, in-game items, progress, profits or opportunity, arising from your use of Tapzy. This includes any ban, suspension or penalty imposed by a third-party service.

Where liability cannot lawfully be excluded, our total liability to you is limited to the amount you actually paid us for Tapzy in the twelve months before the claim, which for free users is zero.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to you.

9. YOUR OWN DATA

Your presets, recordings and settings are stored on your device, not by us. Backing them up is your responsibility. Uninstalling the app deletes them, and we cannot restore them.

How the app handles information is described in our Privacy Policy, which forms part of these terms.

10. ENDING THIS AGREEMENT

You may end it at any time by uninstalling Tapzy.

We may suspend or end your licence if you materially breach these terms. Sections 7, 8 and 11 survive the end of this agreement.

11. GOVERNING LAW

These terms are governed by the laws of India. The courts at Surat, Gujarat have exclusive jurisdiction over any dispute, except where the law of your country of residence gives you the right to bring proceedings locally, which we do not seek to remove.

12. CHANGES TO THESE TERMS

We may update these terms. The effective date at the top will change, and material changes will be noted in the app's release notes on Google Play. Continuing to use Tapzy after an update means you accept the revised terms.
