Terms & Conditions:
1. DEFINITIONS
In these Terms and Conditions:
• “We/Us/Our” means Taio’s Softplay Hire, ABN: 35 843 059 484, operating in New South Wales.
• “You/Your/Hirer” means the person or entity hiring the Equipment.
• “Equipment” means all soft play equipment, foam blocks, ball pits, toddler slides, mats, plastic fence, foam board signs, plastic shoe rack, packing bags, EVA mats, ball pit balls, wooden backdrop, floral arrangement, Perspex plinth, ripple metal plinths, and all associated items and accessories designed primarily for children aged 0-6 years.
• “Hire Period” means the period specified in the Booking Confirmation.
• “Venue” means the location where equipment will be delivered and used.
• “Supervising Adult” means a responsible person aged 18 years or over designated to
supervise Equipment use.
2. BOOKING AND PAYMENT
2.1 Bookings are confirmed only upon receipt of:
• Completed booking form with all required details
• Our written confirmation
• Non-refundable deposit of $150 paid within 24 hours
• Acceptance of these Terms and Conditions
2.2 Quotes will only be provided once the booking form is fully completed and submitted.
2.3 Hire Period
All bookings include up to 4 hours of Equipment use, excluding delivery, setup, pack-down, cleaning, and collection time. Additional hire time may be arranged in advance and will incur additional charges.
The Hire Period, setup time, and pack-down/collection time must be finalised no later than 2 weeks before the event date. Any requests to change venue, date, times, or duration made less than 2 weeks before the event are subject to Our availability and other confirmed bookings. We may be unable to accommodate last-minute changes and are under no obligation to do so.
Whatever Hire Period, setup window, and pack-down window is agreed in writing, responsibility for ensuring the Venue is ready, accessible, and available strictly within those times rests with You.
2.4 Full payment (including a $200 security bond) is due 7 days before the hire date unless otherwise agreed in writing.
2.5 If the balance is not paid at least 7 days prior, the booking may be cancelled without refund of paid amounts.
2.6 For bookings within 7 days of the event, full payment is required within 24 hours.
2.7 All quoted totals are inclusive of GST. No additional GST will be added to the quoted amount.
2.8 We accept payments via bank transfers, debit/credit card and cash (or other agreed methods).
2.9 Late payment may result in cancellation without refund or refusal of delivery.
2.10 Security Bond
A refundable security bond of $200 is required for all hires. The bond will be refunded following collection and inspection of the Equipment, provided the Equipment is returned in its original condition with no damage, loss, contamination, or excessive cleaning required. Any costs associated with damage, loss, excessive cleaning, contamination, or breach of these Terms may be deducted from the bond. Where costs exceed the bond amount, You agree to pay the additional amount upon request.
Payment of the deposit constitutes Your acknowledgement that You have been provided with, have had the opportunity to read, and agree to be bound by these Terms and Conditions.
3. DELIVERY, SETUP AND COLLECTION – NSW REQUIREMENTS
3.1 We will deliver, install, and collect Equipment at the agreed time and Venue.
3.2 Setup and Pack-Down Time
The hire period relates only to the customer’s use of the Equipment. We reserve up to 1–2 hours before the event for delivery and setup, and up to 2 hours after the event for pack-down, cleaning, and collection.
3.3 Venue Access Requirements
The Venue must be accessible and available for the agreed delivery, setup, pack-down, and collection times
.
3.4 Extended Access Charges
Should setup, pack-down, or collection be delayed due to restricted access, guests remaining in the play area, venue restrictions, or any circumstance outside Our control, additional charges of $50 per half hour (or part thereof) will apply.
3.5 All hires are dry hire only — no water play, wet activities, or exposure to moisture is permitted. We strongly prefer indoor setups. Outdoor hires are only accepted in fully covered/sheltered areas (e.g., undercover patios, gazebos, or marquees) on hard, level surfaces such as concrete or sealed hard ground. Grass, dirt, sand, or any soft/unstable surfaces are strictly prohibited due to risk of damage, contamination, or safety issues. We reserve the right to refuse setup or cancel without refund if the venue does not meet these requirements.
Wet Weather Plan – Dry Outdoor Hires
For all dry outdoor hires, a written wet weather contingency plan is highly encouraged and must be sent to us no later than 2 weeks prior to the event. Without a satisfactory wet weather plan received by the required deadline, We reserve the right to refuse to proceed with the outdoor hire if weather conditions make setup, use, or pack-down unsafe or likely to cause damage to the Equipment. In such cases the booking may be treated as cancelled under Our cancellation policy.
3.6 You must provide:
• Clear, level access at least 1.2 metres wide (no stairs or steep inclines)
• Flat, clean, dry setup area free from rocks, sticks, sharp objects, moisture, or debris
• Minimum 2 metres clearance on all sides
• 4 metres overhead clearance (no trees, wires, or structures)
• Full shelter/shade for any outdoor use (as per 3.5)
3.7 A Supervising Adult must be present during delivery and collection.
3.8 You must not move or rearrange Equipment (this may cause injury or damage).
3.9 Equipment must be empty of users and items by collection time.
3.10 Additional Charges Apply For:
Difficult access requiring additional labour: $50 per half hour
Delays to setup, pack-down, or collection: $50 per half hour
Setup outside standard hours (10am–6pm): $70 surcharge (plus after-6pm surcharge where applicable)
Excessive cleaning: $100 minimum
Travel fees where applicable under Clause 3.11
3.11 Delivery Area
Free delivery is included within a 15km radius of postcode 2179 (Leppington/Austral area). Locations beyond 15km may incur a travel fee. Deliveries 30km or more from postcode 2179 will incur a delivery surcharge, which will be quoted at the time of booking.
4. AGE-SPECIFIC SUPERVISION REQUIREMENTS (0-6 YEARS)
4.1 Mandatory Supervision Ratios:
• Ages 0-2 years: 1 adult per 2 children (within arm’s reach)
• Ages 3-6 years: 1 adult per 4 children (active supervision)
• Mixed groups: Use ratio for youngest children
4.2 Supervising Adults must:
• Stay within direct sight of Equipment at all times
• Actively monitor behaviour and safety
• Separate age groups appropriately
• Prevent children over 6 from using Equipment
• Remove unsafe children
• Not be under the influence of alcohol
4.3 For toddlers (0-2 years):
• Close parent/guardian supervision required
• Separate crawlers from walkers
• No bottles, dummies, or hard toys on Equipment
5. HIRER’S RESPONSIBILITIES UNDER NSW LAW
5.1 You must ensure:
• No exposure of Equipment to water, moisture, or wet conditions at any time
• Children remove shoes, jewellery, hair clips, and sharp objects
• No high heels in play area
• No food, drinks, chewing gum, face paint, silly string, streamers, sand, or glitter near Equipment (we may cancel if present)
• No cartwheels, flips, or acrobatics near/inside Equipment
• Entrances/exits kept clear
• Children with runny noses, infections, or nappy rash excluded
• Nappies secure and covered
• Capacity limits not exceeded
• Equipment remains secure
• Weather monitored
• No alcohol, barbecues, smoking, or pets near Equipment
5.2 You must not:
• Allow over-6s to use Equipment
• Move or modify Equipment
• Permit rough play, wall climbing, or throwing items
• Use Equipment in rain, storms, or high winds
• Allow pets near Equipment
5.3 For public spaces, obtain relevant NSW council permits.
5.4 Equipment used only for intended purpose in suitable locations.
6. WEATHER AND ENVIRONMENTAL CONDITIONS
6.1 Equipment must not be used during rain, storms, lightning, temperatures over 38°C, or if wet/slippery. Outdoor use is only permitted in fully sheltered areas on hard surfaces (as per clause 3.3); any risk of moisture or wind exposure may result in immediate cancellation.
6.2 You must monitor Bureau of Meteorology updates.
6.3 We may cancel/remove Equipment for safety.
6.4 Rescheduling allowed with 24 hours’ notice for weather issues only.
7. DAMAGE, LIABILITY AND INDEMNITY
7.1 You are liable for any loss, theft, or damage to the Equipment beyond normal fair wear and tear occurring during the Hire Period. This includes (but is not limited to) the following:
Softplay items
• Tears, punctures, cuts, holes, or ripped seams
• Permanent stains, soiling, or contamination (including food, drink, urine, faeces, vomit, makeup, paint, or bodily fluids)
• Chewing, biting, or excessive compression/crushing of foam
• Broken or missing components, zips, or fastenings
• Burns, melting, or chemical damage
• Graffiti, writing, or adhesive residue
Plastic fence / barriers
• Cracks, breaks, bends, or snaps
• Missing panels, connectors, bases, or feet
• Deep scratches, gouges, or permanent discolouration
• Warping or structural failure
Foam board signs
• Dents, creases, tears, or edge damage
• Water damage, warping, or delamination
• Writing, stickers, or adhesive residue
• Broken or missing supports
Plastic shoe rack
• Cracks, breaks, or snapped shelves/supports
• Warping or missing components
Packing bags / storage bags
• Tears, holes, or rips
• Broken zippers, handles, or straps
• Permanent stains or contamination
EVA mats
• Cuts, tears, punctures, or edge damage
• Permanent stains or discolouration
• Warping, permanent compression, or missing pieces
• Heel marks and hard/permanent soiled shoe marks
Ball pit balls
• Missing balls (beyond a reasonable small number for normal use)
• Punctures, crushing, deformation, or contamination
• Staining, chewing, or soiling requiring replacement of significant quantities
Wooden backdrop
• Scratches, dents, gouges, or chips
• Breaks, cracks, or structural damage
• Water damage, warping, or paint/finish damage
• Missing or broken supports/stands
Floral arrangement
• Broken stems, crushed or missing flowers/foliage beyond normal handling
• Permanent staining or contamination
• Excessive damage caused by mishandling, heat, or improper placement
Perspex / acrylic plinth
• Scratches, scuffs, chips, cracks, or clouding
• Breaks or structural failure
Ripple metal plinths
• Dents, deep scratches, bends, or deformation
• Structural damage or compromised stability
General / other equipment
• Loss or theft of any item
• Damage from misuse, negligence, overload, improper use, chemicals, heat, fire, or unauthorised modifications
• Damage caused by guests, children, animals, or third parties under Your control
Indicative repair/replacement costs may include (but are not limited to): Tears/punctures $150–$500; Biohazard cleaning (vomit/faeces) $200 minimum; full replacement cost for loss or irreparable damage.
7.2 Our liability is limited to the hire fee paid (except where the Australian Consumer Law prohibits such limitation).
7.3 You indemnify Us against all claims arising from Your breach of these Terms, inadequate supervision, over-age use, negligence, or WHS breaches.
7.4 The indemnity survives termination of the agreement.
8. INSURANCE REQUIREMENTS UNDER NSW LAW
8.1 We hold $20 million public liability insurance (as required for NSW amusement device operators), but it excludes Your negligence/supervision failures.
8.2 You are advised to obtain Your own public liability insurance.
8.3 Mandatory for commercial/childcare events (evidence required).
8.4 Report incidents immediately.
9. NSW CIVIL LIABILITY ACT 2002 – RISK WARNING
9.1 Under the NSW Civil Liability Act 2002, You acknowledge recreational activities involve inherent risks, including unpredictable children, collisions, falls, and minor injuries despite supervision.
9.2 You voluntarily assume these risks for supervised children.
9.3 You warrant authority to accept risks for all users.
9.4 While We hold insurance, You accept responsibility for damage, injury, or death from misuse, negligence, or non-compliance with safety guidelines.
10. HYGIENE AND HEALTH REQUIREMENTS
10.1 In accordance with NSW health guidelines:
• Equipment is cleaned and sanitised between hires.
• You must not allow visibly unwell children to use Equipment.
• Hand sanitiser should be used before Equipment use.
• Any contamination (e.g., vomit, faeces, blood) must be reported immediately.
10.2 You agree to notify Us immediately (within 24-48 hours) during or after the hire period if any child who used the Equipment develops symptoms of gastrointestinal illness (e.g., vomiting, diarrhoea), or any other contagious illness. This helps Us take appropriate hygiene and sanitisation measures to protect future users and comply with public health obligations.
10.3 Failure to report such illnesses promptly may result in additional cleaning fees or forfeiture of the security bond if contamination is later discovered.
10.4 Notify Us if contagious illness develops within 48 hours post-use.
11. CANCELLATION AND REFUND POLICY
11.1 Cancellation by You
• More than 14 days’ notice before the hire date
Full refund of the hire fee (excluding the $150 non-refundable deposit). The $200 security bond will be refunded if already paid.
• 3–7 days’ notice before the hire date
50% refund of the total hire fee (excluding the $150 non-refundable deposit). The $200 security bond will be refunded if already paid.
• Less than 3 days’ notice before the hire date
No refund of the hire fee (you will be required to pay the full amount if not already paid). The $200 security bond will be refunded if already paid and no damage, loss, contamination or other chargeable issue has occurred.
Note: The $150 deposit is always non-refundable as it secures your booking dates and covers our preparation and reservation costs.
11.2 Cancellation by Us
• Equipment failure: Full refund or alternative arrangement.
• Safety or weather issues (including where we refuse an outdoor hire due to lack of a satisfactory wet weather plan): Credit for rebooking (terms vary).
11.3 Government restrictions
Full credit valid for 12 months.
12. PRIVACY AND PHOTOGRAPHS
12.1 We comply with Privacy Act 1988 (Cth) and NSW privacy laws.
12.2 Personal information used only for booking management.
12.3 Secure storage; access/correction requests accepted.
12.4 We may photograph for safety, insurance, or marketing (no identifiable children without consent).
12.5 Booking consents to promotional use; opt-out by written notice.
13. GENERAL TERMS
13.1 These Terms and Conditions constitute the entire agreement between the parties. Any variations must be agreed in writing.
13.2 If any clause is unenforceable, it does not affect the validity of the remaining clauses.
13.3 We retain title to all Equipment at all times.
13.4 All prices and quotes are inclusive of GST unless otherwise expressly stated in writing.
13.5 Harassment, Intimidation and Threats
Harassment, intimidation, threats, unreasonable demands, or abusive behaviour toward Our staff (in person, by phone, email, social media, or otherwise) will not be tolerated. We reserve the right to refuse or immediately terminate service, cancel the booking (with forfeiture of fees as applicable under these Terms), and/or refuse future bookings.
This includes any such conduct occurring after a bond or deposit decision (including where part or all of a bond is not returned due to damage, loss, or other legitimate claims under these Terms). We take such conduct seriously and may report it to relevant authorities where appropriate.
14. GOVERNING LAW AND JURISDICTION
14.1 These Terms are governed by the laws of New South Wales. The parties submit to the exclusive jurisdiction of the courts of New South Wales.
15. HEALTH AND SAFETY DECLARATION
15.1 Acceptance of Terms
Payment of the booking deposit constitutes acceptance of these Terms and Conditions.
15.2 Liability Waiver Requirement
A completed and signed Liability Waiver must be received by Taio’s Softplay Hire no later than 7 days prior to the event date, or immediately for bookings made within 7 days of the event. Failure to provide a signed Liability Waiver may result in cancellation of the booking without refund.
By signing the Liability Waiver, the Hirer acknowledges and accepts the risks associated with the use of the Equipment and agrees to comply with all supervision, safety, and operational requirements contained in these Terms and Conditions.
RULES OF PLAY
To ensure safety and enjoyment:
1. Age Restrictions: Only 0-6 years; no over-6s.
2. Supervision: Supervising Adult (18+) present with direct sight/active supervision at all times.
3. Safety and Behaviour: No pushing, rough play, cartwheels, flips, climbing walls, overcrowding, or throwing items. Keep entrances/exits clear.
4. Hygiene and Attire: Remove shoes/jewellery/sharp objects. No food/drinks/gum/face paint/silly string/streamers/sand/glitter. Exclude unwell children; cover nappies.
5. Equipment Integrity: Do not move/modify/rearrange. No throwing soft items. Keep secure.
6. Weather: No use in rain/storms/high winds/>38°C. Monitor and notify Us.
7. Prohibited: No alcohol/barbecues/smoking/pets/bottles/dummies/hard toys.
8. Compliance: Follow NSW WHS and these Terms. Non-compliance may end use without refund.c
9. Equipment is dry hire only — no water, wet play, or moisture exposure permitted.
10. Use preferably indoors; outdoor use only in fully covered/sheltered areas on hard/concrete surfaces.
11. Immediately notify Taio's Softplay Hire within 24-48 hours if any child develops gastrointestinal or contagious illness after using the Equipment.
