WESELLERS: TERMS OF USE/ TERMS OF SERVICES/ TERMS & CONDITIONS

Welcome to Wesellers.This document is an electronic record in terms of Information Technology Act, 2000 and published in accordance with the provisions of Rule 3 ) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of Wesellers marketplace platform - www.Wesellers.com | wesellers (company/wesellers company) (hereinafter referred to as "Platform")

The Platform is owned by Wesellers’s owner , (proprietor owner), having its registered office at Burari , Delhi 110084 India.

Your use of the Wesellers and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Wesellers including the applicable policies which are incorporated herein by way of reference. By mere use of the Wesellers, You shall be contracting with Wesellers’s owner (proprietor owner), the owner of the Platform. These terms and conditions including the policies constitute Your binding obligations, with Wesellers.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer of wesellers (or owner of wesellers) by any mode of sales channel, via online platform, sales done over call or on whatsapp {by any mode, if sales is done between You(customer) & Wesellers (us)} or by any mode of communication . The term "Wesellers","We","Us","Our" shall mean Wesellers / Wesellers’s owner , (proprietor owner),  and its affiliates or all employees of wesellers.

When You use any of the services provided by Us through the Platform / or by any mode of communication, including but not limited to, (e.g. Product Reviews, Seller Reviews), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of the Platform/or communication with us or sales team following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform / or wesellers (by any mode of communication). By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Wesellers Policies including but not limited to Privacy Policy as amended from time to time.

1. User Account, Password, and Security:

If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform.

You agree to

• immediately notify Wesellers of any unauthorized use / breach of your password or account and

• ensure that you exit from your account at the end of each session.

2. Services Offered:

Wesellers provides a number of Internet-based and offline services services through the Platform / and by other sources both offline and online (or by other modes of communication) . One such Service enables Users to purchase assorted Clothes such as Men / Women clothing, footwear and accessories from various fashion and lifestyle brands (collectively, "Products"). The Products can be purchased through the Platform or by any other modes of communication with us(whatsapp / phone call etc.), through various methods of payments offered. The sale/purchase of Products shall be additionally governed by specific policies of sale, like cancellation policy, exchange policy, return policy, etc. (which are found on the website (header or footer) on the Platform and all of which are incorporated here by reference). It is clarified that at the time of creating a return request, users are required to confirm (via a video or photo submitted to company member) that the product being returned is unused and has the original tags intact. If the product returned by the user is used, damaged or if the original tags are missing, the user’s return request shall be declined, and the said product shall be re-shipped back to the customer. In the event that the return request is declined, the user shall not be eligible for a refund, and Wesellers assumes no liability in this regard. Further, in the event that the user fails to accept the receipt of the said re-shipped product, the user shall continue to be not eligible for a refund, and Wesellers assumes no liability with respect to the return or refund for the said re-shipped product. In addition, these Terms of Use may be further supplemented by Product specific conditions, which may be displayed with that Product.

Wesellers does not warrant that Product description or other content on the Platform/(or in any modes of communication) is accurate, complete, reliable, current, or error-free and assumes no liability in this regard.

4. User Conduct and Rules on the Platform/or in any mode of communication (like whatsapp,call etc.) :

You agree, undertake and confirm that Your use of the Platform / and any interaction with wesellers shall be strictly governed by the following binding principles:

• You shall not host, display, upload, modify, publish, transmit, update or share any information which:

  • belongs to another person and to which You do not have any right to

  • is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever

  • is misleading in any way

  • involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming"

  • promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous

  • infringes upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity

  • contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page)

  • provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses

  • contains video, photographs, or images of another person (with a minor or an adult).

  • tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other users

  • interferes with another USER's use and enjoyment of the Platform or any other individual's User and enjoyment of similar services

  • infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products

  • violates any law for the time being in force

  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to thecommission of any cognizable offence or prevents investigation of any offence or is insulting any other nation

  • shall not be false, inaccurate or misleading

  • shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers

• A User may be considered fraudulent or loss to business due to fraudulent activity if any of the following scenarios are met:

  • Users fails to produce adequate documents during the payment details verification

  • Misuse of another Users's phone/email

  • Users uses invalid address, email and phone no.

  • Overuse of a voucher code

  • Use of a special voucher not tagged to the email ID/or users phone number, used.

  • Users returns the wrong product

  • Users refuses to pay for an order

  • Users involved in the snatch and run of any order

  • Miscellaneous activities conducted with the sole intention to cause loss to business/revenue to Wesellers

  • User with excessive returns

  • Repeated request for monetary compensation for fake/used order

• Wesellers may cancel any order that classify as 'Personal Orders'/'Fraud orders' under certain criteria at any stage of the product delivery. An order can be classified as 'Personal Order'/'Fraud Order' if it meets with the below mentioned criteria, and any additional criteria as defined by Wesellers:

  • Products ordered are for self-consumption but not for commercial resale

  • Single orders placed for same/or diffrent product at the same address, depending on the product category.

  • Single quantity of the product ordered

  • Invalid address given in order details

  • Any malpractice used to place the order

  • Any promotional voucher used for placing the 'Single Order' may not be refunded

  • Any order paced using a technological glitch/loophole.

  • Any Order which contains less than 15 to 20 pieces will be counted as for personal use/fraud order..

• You shall not use the Platform/or wesellers services(any offline or online services) for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of the company and interrupt or causes to interrupt, damages the use by other Users of Wesellers.

• You shall not use any false e-mail address, impersonates any person or entity, or otherwise misleads Wesellers by sharing multiple address and phone numbers or transacting with malafide intentions.

• We on certain landing page even allow our Users to experience free exchange of ideas and observations regarding interest in the field of fashion, including ‘viewing user generated content’ and/or ‘videos’ and ‘posting comments’. By accessing, viewing and/or posting any user generated content to any specific dedicated page on the Platform, you accept and consent to the practices described in these ‘Terms of Service’ and ‘Privacy Policies’, as well as any other terms of prescribed by the Wesellers on the Platform. You agree and undertake that when accessing, viewing and/or posting any user generated content on these pages You will not imitate, abuse, harass, any Customer/User or violate and exploit, any of these ‘Terms of Service’ of the Platform.

• You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform/wesellers services or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform/or by other modes of services & other mode of comuunication. We reserve Our right to bar any such activity.

• You shall not attempt to gain unauthorized access to any portion or feature of the Platform/or wesellers services, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, password "mining" or any other illegitimate means.

• You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity

• You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding Your use of Our service and Your listing, purchase, solicitation of offers to purchase, and sale of products or services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.

• From time to time, You shall be responsible for providing information relating to the products or services proposed to be sold by You. In this connection, You undertake that all such information shall be accurate in all respects. You shall not exaggerate or over emphasize the attributes of such products or services so as to mislead other Users in any manner.

• You shall not engage in advertising to, or solicitation of, other Users of the Platform to buy or sell any products or services, including, but not limited to, products or services related to that being displayed on the Platform or related to us.

• The Content posted does not necessarily reflect Wesellers views. In no event shall Wesellers assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Platform/or by show by any modes of communication. You hereby represent and warrant that You have all necessary rights in and to all Content which You provide and all information it contains and that such Content shall not infringe any proprietary or other rights of third parties or contain any libellous, tortious, or otherwise unlawful information.

• Wesellers hereby disclaims any guarantees of exactness as to the finish, appearance, size, color etc., of the final Product as ordered by the User. Wesellers Return & Exchange Policy offers you the option to return or exchange items purchased on or from Wesellers/or by any modes of communication purchased from wesellers employee, within the return/exchange period (Please read the refund policy Page to see the number of days upto which products can be returned/exchanged, post-delivery). In case of return or exchange of the purchased items, please refer to the "Return and Exchange Policy" available on https://www.Wesellers.com/faqs#returns any grievances will not be accepted if return & refund policy have not been read, further doing business with us(means purchasing products from us) means you agree & accept our all policies / terms of services (t&c) .

• Please note that you can only use Wesellers Credits to buy products from your registered mobile number with the Wesellers employee or website. Wesellers Credits cannot be:

  • Used for payment of orders placed with other Wesellers accounts/or with other registered mobile number with employee.

  • Transferred to any other Wesellers user's account/mobile number, bank account, or wallets, etc.

+Wesellers may unilaterally terminate Your account on any event as mentioned in the Terms Of Use under the point no. 4. User Conduct and Rules on the Platform. Any Wesellers credits earned as goodwill compensation, earned via loyalty or referral program or promotional campaigns or earned through gift cards purchased on other platforms will be forfeited in such cases.

5. Contents Posted on Platform/or shared by wesellers/wesellers employee :

All text, graphics, user interfaces, visual interfaces, photographs/ catalogs, trademarks, logos, sounds, music and artwork (collectively, "Content"), is a third party user generated content and Wesellers has no control over such third party user generated content as Wesellers is merely an intermediary for the purposes of this Terms of Use. Such Content will become Our property and You grant Us the worldwide, perpetual and transferable rights in such Content. We shall be entitled to, consistent with Our Privacy Policy as adopted in accordance with applicable law, use the Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include the Content You provide.

You may use information on the products and services purposely made available on the Platform/or by wesellers employee by any modes of communication for downloading, provided that You

• do not remove any proprietary notice language in all copies of such documents,

• use such information only for your personal purchasing,  non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media without asking,

• make no modifications to any such information, and

• do not make any additional representations or warranties relating to such documents,

• In the event of return/cancellation of any products in the order placed with an offer, thereby falling below the minimum required threshold as required by the offer, the user shall be deemed ineligible for the offer. Any cashback already credited would be void & be deducted from the value of the item being returned/canceled & the remaining balance would be processed as a credit refund.

6. Disclaimer of Warranties and Liability:

All the materials and products (including but not limited to software) and services, included on or otherwise made available to You through Platform/or by any modes of communication are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, Wesellers does not warrant that: Platform will be constantly available, or available at all or The information on Platform is complete, true, accurate or non-misleading.

8. Payment

While availing any of the payment method/s available on the Platform/or payment method made available by company employee by any modes of communication, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:

• Lack of authorization for any transaction/s, or

• Exceeding the preset limit mutually agreed by You and between 'Bank/s', or

• Any payment issues arising out of the transaction, or

• Decline of transaction for any other reason/s

All payments made against the purchases/services on Platform/ (or by payment method made available by company employee by any modes of communication) by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Platform will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Platform/or by wesellers by other payment method provided to you.

Before shipping / delivering your order to you, wesellers (employee) may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users.

-          Further Refund Term & Conditions :

We have 2 types of Refund terms & conditions , One for the Samples of products and Other for Bulk ( or Wholesale Order) –

• You can purchase samples of the products for quality check, but samples products price must not be above ₹9000, any order above price  ₹9000 will be marked as wholesale order & will be considered as wholesale or bulk order. Every samples order/s will be governed by samples refund t&c/samples refund policy.

• You can place wholesale or bulk order for reselling, any order above ₹9000 will be marked as wholesale order, any order below ₹9000 will be marked as samples order. Every Wholesale order/s will be governed by wholesale refund t&c / wholesale refund policy.

• You understand & agree to refund t&c which is if you buys/purchases samples of products from us, your refund will be given in credits, you can use these credits in purchasing new products, if you further feel not satisfied so you can request us to show you, our live current stock on video call(whatsapp video call could be the best option)to buy other products, you understand & agree due to less margin in wholesale dealing(samples order) order/s, you will not not ask for refund for samples order/s (worth less than ₹9000)  as in hard or soft money for eg: bank transfer , UPI transfer, cash etc. Store credit will be given to you, in the form of refund, for samples order/s. Only wholesale/bulk order/s (worth more than ₹9000) can be refunded in terms of money e.g. : via bank transfer / UPI transfer etc. for more information on refund policy you can visit : https://sites.google.com/view/surplusclothinglife/refund-policy?authuser=0 any grievances will not be accepted if return & refund policy have not been read, further doing business with us(means purchasing products from us) means you agree & accept our all policies / terms of services (t&c).

• Except for Cash On Delivery transaction, refund, if any, shall be made at the same Issuing Bank from where Transaction Price was received, or through any other method available on the Platform/or available at wesellers, as chosen by You.

  • For Cash On Delivery transactions, refunds, if any, will be made via electronic payment transfers.

• Refund shall be made in Indian Rupees only and shall be equivalent to the Transaction Price received in Indian Rupees. Sipping price will not be included in refund price.

• For electronics payments, refund shall be made through payment facility using NEFT / RTGS or any other online banking / electronic funds transfer system approved by Reserve Bank India (RBI).

• Refunds may be supported for select banks. Where a bank is not supported for processing refunds, You will be required to share alternate bank account details with us for processing the refund.

• Refund shall be conditional and shall be with recourse available to Wesellers in case of any misuse by Buyer.

  • We may also request you for additional documents for verification.

• Refund shall be subject to Buyer complying with Policies.

  • Wesellers reserves the right to impose limits on the number of Transactions or Transaction Price which Wesellers may receive from on an individual Valid Credit/Debit/ Cash Card / Valid Bank Account/ and such other infrastructure or any other financial instrument directly or indirectly through payment aggregator or through any such facility authorized by Reserve Bank of India to provide enabling support facility for collection and remittance of payment or by an individual Buyer during any time period, and reserves the right to refuse to process Transactions exceeding such limit.

• Wesellers reserves the right to refuse to process Transactions by Buyers with a prior history of questionable charges including without limitation breach of any agreements by Buyer with Wesellers or breach/violation of any law or any charges imposed by Issuing Bank or breach of any policy.

• Wesellers may do such checks as it deems fit before approving the receipt of/Buyers commitment to pay (for Cash On Delivery transactions) Transaction Price from the Buyer for security or other reasons at the discretion of Wesellers. As a result of such check if Wesellers is not satisfied with the creditability of the Buyer or genuineness of the Transaction or other reasons at its sole discretion, Wesellers shall have the right to reject the receipt of / Buyers commitment to pay Transaction Price. For avoidance of doubt, it is hereby clarified that the ‘Cash on Delivery’ feature for payment, may be disabled for certain account users, at the sole discretion of Wesellers.

• The Buyer acknowledge that Wesellers will not be liable for any damages, interests or claims etc. resulting from not processing a Transaction/Transaction Price or any delay in processing a Transaction/Transaction Price which is beyond control of Wesellers.

Compliance with Laws:

• As required by applicable law, if the Customer makes a purchase of an amount equal to or above INR 2 00 000.00, the Customer will be required to upload a scanned copy of his/her PAN card on the Platform/or must submit to company employee, within 4 days of making the purchase, failing which, the purchase made by the Customer will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Customer, it need not be submitted again. The order of the Customer shall stand cancelled if there is a discrepancy between the name of the Customer and the name on the PAN Card.

Buyer shall comply with all the applicable laws (including without limitation Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Customs Act, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made there under, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, Export Import Policy of government of India) applicable to them respectively for using Payment Facility and Wesellers Platform.

Buyer's arrangement with Issuing Bank:

• All Valid Credit / Debit/ Cash Card/ and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank and payment instrument issuing company.

All Online Bank Transfers from Valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank which support Payment Facility to provide these services to the Users. All such Online Bank Transfers on Payment Facility are also governed by the terms and conditions agreed to between Buyer and the respective Issuing Bank.

12. Limitation of Liability:

In no event shall Wesellers be liable for any indirect, punitive, incidental, special, consequential damages or any other damages resulting from:

• the use or the inability to use the Services or Products

• unauthorized access to or alteration of the user's transmissions or data

• breach of condition, representations or warranties by the manufacturer/dealer/wholesaler of the Products

• any other matter relating to the services including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Platform or Service. Wesellers shall not be held responsible for non-availability of the Wesellers during periodic maintenance operations or any unplanned suspension of access to the Wesellers. The User understands and agrees that any material and/or data downloaded at Wesellers is done entirely at Users own discretion and risk and they will be solely responsible for any damage to their mobile or loss of data that results from the download of such material and/or data. To the maximum extend that is permissible under law, Wesellers’s liability shall be limited to an amount equal to the Products purchased value bought by You(this is applicable to only bulk order/s and not applicable for samples order/s as mentioned above in refund terms). Wesellers shall not be liable for any dispute or disagreement between Users

13. Termination:

Wesellers may suspend or terminate your use of the Wesellers or any Service if it believes, in its sole and absolute discretion that you have infringed, breached, violated, abused, or unethically manipulated or exploited any term of these Terms of Service or anyway otherwise acted unethically. Notwithstanding anything in this clause, these Terms of Service will survive indefinitely unless and until Wesellers chooses to terminate them.

• If You or Wesellers terminates your use of the Platform or any Service, Wesellers may delete any content or other materials relating to your use of the Service and Wesellers will have no liability to you or any third party for doing so. However, your transactions details may be preserved by Wesellers for purposes of tax or regulatory compliance.

• Wesellers may unilaterally terminate Your account on any event as mentioned in the Terms Of Use under the point no. 4. User Conduct and Rules on the Platform/or rules for using wesellers services as per point no. 4.  Any Wesellers credits earned as goodwill compensation, earned via loyalty or referral program or promotional campaigns or earned through gift cards purchased on other platforms will be forfeited in such cases. Returns/Refund for such Users shall be at the sole discretion of Wesellers.

• If You use any false e-mail address or use the portal/or services for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of the company or mislead Wesellers by sharing multiple address and phone numbers or transacting with malafide intentions then Wesellers reserves the right to refuse access to the portal, terminate accounts including any linked accounts without notice to you.

Dispute Resolution -

Any dispute, controversy, or claim arising out of or relating to this agreement, including its formation, interpretation, performance, breach, termination, or validity, shall be settled by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

The arbitration proceedings shall be conducted by a single arbitrator appointed by mutual agreement between the parties. In regards to potential disagreements regarding the appointment of an arbitrator. In such cases, the matter will be referred to the competent court within the jurisdiction of the seat and venue or arbitration center in New Delhi, India. The court shall have the authority to appoint an arbitrator to resolve any dispute between the parties.

We would like to emphasize that resolving potential disputes through arbitration is much more efficient and cost-effective than through litigation. We hope you can agree with us on this matter.

The seat and venue of arbitration shall be New Delhi, India. The language of the arbitration shall be English/Hindi.

The arbitrator's decision shall be final and binding upon the parties. The parties agree to abide by and comply with any award rendered by the arbitrator. The parties further agree that the arbitration proceedings and any related documents, including the award, shall be kept confidential, except as may be required by law or for the purpose of enforcing or challenging the award.

Notwithstanding the above, either party may seek interim relief, including injunctive relief, from any court of competent jurisdiction in order to protect its rights or prevent irreparable harm pending the outcome of the arbitration.

Any arbitration award will include costs of the arbitration, reasonable attorneys’ fees, and reasonable costs for witnesses. You and the company may enter arbitration awards in any court with jurisdiction.

This dispute resolution clause shall survive the termination or expiration of this agreement.

If the dispute is not resolved through arbitration -

If any dispute, controversy, or claim arising out of or relating to this agreement, including its formation, interpretation, performance, breach, termination, or validity, is not resolved through arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, the parties agree to refer the matter to Online Dispute Resolution (ODR).

The ODR process shall be conducted through an online platform or service provider agreed upon by both parties. The selection of the ODR platform or service provider shall be made within 60 Days from the date the arbitration proceedings conclude without resolution. If the parties fail to agree on the selection of an ODR platform or service provider within the specified timeframe, either party may apply to a court of competent jurisdiction to appoint or recommend an appropriate ODR platform or service provider.

The parties shall cooperate in good faith with the selected ODR platform or service provider and comply with their rules, procedures, and requirements. The ODR process shall be conducted in a fair, impartial, and efficient manner, with a focus on resolving the dispute in a just and equitable manner.

The decision or resolution reached through the ODR process shall be final and binding upon the parties. The parties agree to abide by and comply with any decision or resolution rendered by the ODR platform or service provider.

The provisions of confidentiality, language, and enforcement stated in the arbitration clause shall also apply to the ODR process.

This clause shall survive the termination or expiration of this agreement.

Delivery Related - User agrees and acknowledges that any claims regarding order delivery (including non-receipt/ non- delivery of order or signature verification) shall be notified to Wesellers within 5 days from the alleged date of delivery of product reflecting on the Wesellers shipping portal. Non notification by You of non-receipt or non-delivery within the time period specified shall be construed as a deemed delivery in respect of that transaction. Wesellers disclaims any liability or responsibility for claims regarding non-delivery, non-receipt of order (including signature verification in Proof of delivery) after 5 days from the alleged date of delivery of product reflecting on the Wesellers shipping portal.
