These terms are an agreement between you and Olga Afanaseva ("we", "us") about your use of the Straighter iOS app. By downloading or using Straighter you agree to them and to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If you do not agree, do not use the app.
Read this section even if you skip the rest.
Straighter is a posture and habit app for general wellness. It is not a medical device, and it does not diagnose, treat, cure or prevent any condition.
Nothing in Straighter is medical or physiotherapy advice.
The posture score, grade and findings (such as "forward head" or "rounded upper back") are visual estimates made from a single photo. They are not a clinical measurement or diagnosis, and they can change with lighting, camera angle, clothing and how you stand.
Timelines, goal scores, projections and "visual height" figures are rough estimates. Results vary from person to person and are not guaranteed.
Talk to a doctor or physiotherapist before starting any exercise program, particularly if you have back or neck pain, an injury, scoliosis or another spinal condition, have recently had surgery, are pregnant, or are under 18. Move gently and stop immediately if anything hurts or you feel dizzy, numb or short of breath. If pain continues, seek medical help. Do not delay or disregard medical advice because of something in this app. You take part in the exercises voluntarily and at your own risk, to the extent the law allows.
You must be at least 13 years old, and old enough to enter a binding contract where you live. If you are under 18, you may use Straighter only with the involvement of a parent or guardian, who also agrees to these terms and is responsible for any purchases.
We give you a personal, non-exclusive, non-transferable, revocable licence to use Straighter on Apple devices you own or control, for your own personal, non-commercial use, under the App Store Terms of Service.
You agree not to: copy, modify or create derivative works of the app; reverse engineer or attempt to extract its source code except where the law expressly allows it; sell, rent, sublicense or redistribute it; use it to break the law; take or analyze photos of other people without their permission; or interfere with its operation, security or subscription system.
Straighter requires a paid subscription ("Straighter Pro") to use its program.
Plans and prices are shown in the app before you buy, in your local currency. Current plans are a weekly subscription and an annual subscription. A discounted annual plan may be offered once.
Payment is charged to your Apple ID account at confirmation of purchase.
Auto-renewal: subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours prior to the end of the period, at the price of the plan you chose.
Cancelling: manage or cancel in iOS Settings → your name → Subscriptions, or in the app under Profile → Manage subscription. Deleting the app does not cancel your subscription.
Free trial, if one is offered: any unused portion of a free trial is forfeited when you buy a subscription.
Refunds are handled by Apple, under Apple's policies, not by us. Requests go to https://reportaproblem.apple.com
Price changes: if we change the price, Apple will notify you and ask for your consent before the new price takes effect, as required by the App Store rules.
Restoring: "Restore" in the app restores a subscription bought with the same Apple ID. Your subscription is also recognised automatically on your other devices signed in to the same iCloud account.
Straighter works without an account. Your photos are analyzed on your device, and your photos, scans and progress are stored on your device and, if enabled, in your own private iCloud. What Straighter does with information is described in our Privacy Policy at https://sites.google.com/view/straighterapp/privacy-policy, which forms part of these terms.
You are responsible for your own backups. If you turn off iCloud and then delete the app, lose your device, or use "Delete all data", we cannot recover your history.
Your photos, your name and your progress stay yours. We claim no ownership of them, and since they are stored on your device and in your iCloud, we do not have access to them.
The Straighter name, logo and posture figure, the app's design, text, exercise photos and instructions, the posture analysis and the 12-month program, and the software itself are owned by us or our licensors and protected by copyright and trade mark law.
We may update, change or discontinue features, exercises or the program. We try not to break things, but we do not promise that Straighter will always be available, uninterrupted or error-free, or that posture analysis will work with every photo. iCloud sync depends on Apple's services and your iCloud settings.
We may update these terms. If a change is material, we will make it visible in the app or on this page before it takes effect. Continuing to use Straighter after that means you accept the updated terms.
You may stop using Straighter at any time by deleting it, and cancel your subscription through Apple. We may suspend or end your access if you materially breach these terms — for example by trying to circumvent payment or attack the service.
To the fullest extent the law allows, Straighter is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that posture scores, grades, findings, timelines or projections are accurate or suitable for you, or that you will achieve any particular result. They are estimates made from a photo.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any injury, loss of data, profits or goodwill, arising from your use of Straighter or the exercises in it.
Our total liability for any claim relating to Straighter is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
These terms are between you and us, not with Apple. Apple is not responsible for Straighter or its content and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you. If Straighter fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Straighter.
These terms are governed by the laws of Tajikistan, without regard to its conflict of law rules. Courts of Tajikistan have exclusive jurisdiction, except that if you are a consumer you keep the protections and the right to bring proceedings in the country where you live.
If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. These terms, plus the Privacy Policy and Apple's Licensed Application End User License Agreement, are the entire agreement between us about Straighter.
