In 2009, a man was found guilty of a horrific murder in Laurel, MD. Upon further investigation, attorney Russell Butler from the MCVRC, discovered that man, Lawrence Banks, was released before he had served half of his time on a violent crime (the mandate for parole eligibility in MD), due to having credits from his previous incarceration being credited to his new “term of confinement” - the combination of sentences given for both the new conviction and for the back-up parole time from the previous conviction.
The legislation, SB654 of the 2009 Session was drafted, and ultimately passed into law, promising no fiscal impact.
