Terms of Service

These Terms of Service ("Terms") govern your access to and use of XEMINO — Speech Analysis | AI Coach("XEMINO", "the App"), developed and operated by Kello Solutions ("Kello Solutions", "we", "our", or "us").

By downloading, accessing, or using XEMINO, you agree to these Terms. If you do not agree with these Terms, please do not use the App.

1. About XEMINO

XEMINO is an AI-powered speech coaching application designed to help users understand and improve their communication skills.

The App may analyze aspects of your speech, including:

• Speech clarity;

• Speaking pace;

• Pauses;

• Filler words;

• Word usage;

• Vocabulary;

• Speaking style;

• Sentence structure;

• Confidence-related indicators;

• Overall speaking performance.

XEMINO provides automated feedback, scores, insights, and suggestions based on the information processed during your sessions.

2. Eligibility

You may use XEMINO only if you are legally permitted to enter into these Terms under the laws applicable to you.

If you are under the applicable age of consent or digital-service age in your jurisdiction, you may use XEMINO only with appropriate authorization from a parent or legal guardian where required.

3. Using XEMINO

You agree to use XEMINO only for lawful purposes and in accordance with these Terms.

You must not:

• Use the App for unlawful, fraudulent, or abusive purposes;

• Attempt to gain unauthorized access to the App or its systems;

• Interfere with the security or operation of the App;

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App except where permitted by applicable law;

• Copy, reproduce, modify, or redistribute the App or its content without authorization;

• Use automated systems to abuse or overload the App;

• Attempt to circumvent subscription, access, or usage restrictions;

• Use XEMINO to infringe the rights of another person.

We reserve the right to suspend or terminate access where we reasonably believe that these Terms have been violated.

4. Speech Analysis and AI Features

XEMINO uses automated speech-processing and artificial intelligence technologies to analyze your speech and provide feedback.

AI-generated results may not always be accurate or appropriate.

Scores, recommendations, classifications, and other feedback are intended as general communication coaching and self-improvement guidance. They should not be considered professional, medical, psychological, educational, legal, or other regulated advice.

You are responsible for deciding how you use information provided by XEMINO.

We do not guarantee that:

• Speech analysis will always be accurate;

• Transcriptions will be error-free;

• Scores will perfectly represent your communication ability;

• AI recommendations will always be appropriate;

• The App will identify every aspect of your speech;

• The App will always be available or operate without interruption.

5. Microphone and Speech Input

Certain XEMINO features require access to your device microphone.

By enabling microphone access and starting a speech analysis session, you authorize XEMINO to process the speech input necessary to provide the requested functionality.

You are responsible for ensuring that you have the appropriate rights and permissions to record or process any speech or other individuals that may be captured during your use of the App.

You should avoid recording other people without their knowledge or permission where such consent is required by applicable law.

6. Analysis History

XEMINO may provide functionality that stores previous analysis results so you can review your performance and monitor progress.

You may be able to delete your analysis history through the App.

Deletion of analysis history may be permanent and may not be reversible.

7. XEMINO Premium

XEMINO may offer optional paid subscription plans, including XEMINO Premium.

Premium features may include additional or expanded functionality, such as increased analysis access, advanced insights, AI coaching, or other features identified in the App.

The features included in a Premium subscription may change over time.

Subscription Billing

Subscriptions purchased through an applicable app store are billed through that store according to its terms and payment policies.

Subscription prices, billing periods, free trials, and available plans are displayed within the App before purchase.

If a subscription automatically renews, it will continue to renew unless cancelled in accordance with the applicable app store's cancellation procedures.

Deleting the App does not necessarily cancel an active subscription.

You are responsible for managing and cancelling your subscription through the applicable app store.

Free Trials

If XEMINO offers a free or discounted trial, the duration and applicable terms will be displayed at the time of signup.

Unless otherwise stated, a free trial may automatically convert into a paid subscription when the trial period ends.

You may cancel before the end of the trial period to avoid being charged where applicable.

8. Payments and Refunds

Payments for XEMINO subscriptions may be processed by the applicable platform, such as Apple App Store or Google Play.

Kello Solutions does not control the payment processing systems operated by those platforms.

Refund requests may be subject to the policies and procedures of the platform through which the purchase was made.

9. Intellectual Property

XEMINO, including its software, design, branding, logos, graphics, interfaces, text, features, and underlying technology, is owned by or licensed to Kello Solutions and is protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, you may not:

• Copy XEMINO;

• Modify or create derivative works;

• Distribute or commercially exploit the App;

• Reproduce its branding or visual identity;

• Attempt to extract proprietary technology;

• Use Kello Solutions trademarks without permission.

Your speech and personal information remain subject to the rights described in our Privacy Policy.

10. User Content

You retain applicable rights to content that you provide to XEMINO.

By using features that require your content to be processed, you grant Kello Solutions and its service providers the limited rights necessary to process that content to provide the requested App functionality.

We do not claim ownership of your personal speech content merely because you use XEMINO.

11. Third-Party Services

XEMINO may rely on third-party services to provide certain functionality, including:

• Cloud infrastructure;

• Speech recognition;

• Artificial intelligence processing;

• Analytics;

• Crash reporting;

• Subscription processing;

• Customer support.

Third-party services may have their own terms and privacy policies.

Kello Solutions is not responsible for the independent operation, availability, or policies of third-party services.

12. Availability and Changes to the App

We may modify, update, suspend, or discontinue parts of XEMINO at any time.

Features may be added, removed, changed, or replaced.

We do not guarantee that any particular feature will remain available indefinitely.

We may also perform maintenance, updates, or security improvements that temporarily affect availability.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, XEMINO is provided on an "as is" and "as available" basis.

We do not guarantee that:

• The App will always be available;

• The App will operate without errors;

• Analysis results will always be accurate;

• AI-generated recommendations will be suitable for every user;

• The App will meet every individual expectation;

• Any particular improvement in speaking performance will result from using XEMINO.

You use XEMINO at your own discretion and risk.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Kello Solutions and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to your use of XEMINO.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kello Solutions and its officers, employees, contractors, affiliates, and service providers from claims, damages, liabilities, costs, and expenses arising from:

• Your misuse of XEMINO;

• Your violation of these Terms;

• Your violation of applicable laws;

• Your infringement of another person's rights;

• Content you submit or process through the App.

16. Termination

You may stop using XEMINO at any time.

We may suspend or terminate your access to XEMINO if:

• You materially violate these Terms;

• Your use creates a security or legal risk;

• We are required to do so by law;

• We discontinue the App;

• Continued access is otherwise reasonably necessary to protect the App or its users.

Termination does not automatically cancel subscriptions purchased through an app store. You must manage subscriptions separately through the applicable platform.

17. Privacy

Your use of XEMINO is also governed by our Privacy Policy, which explains how we collect, use, process, and protect information.

Please review the XEMINO Privacy Policy before using the App.

18. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide notice through the App or other appropriate means.

Your continued use of XEMINO after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with applicable laws, without regard to conflict-of-law principles.

Nothing in these Terms is intended to remove or limit mandatory consumer rights that apply to you under the laws of your country or jurisdiction.
