AMATEUR ATHLETIC WAIVER AND RELEASE OF LIABILITY AND 

ASSUMPTION OF RISK AGREEMENT

READ BEFORE SIGNING

SK8Houston 2026 (the “Program”)

2026 WAIVER, All participants must sign

In consideration of being allowed to participate in any way in the SK8Houston athletic/sports Program, related events and activities, the intangible value that the undersigned will gain from participating in the Program and in recognition of SK8Houston 2026 and Space City Skaters’ reliance thereon, the undersigned agrees to all of the terms and conditions set forth herein (this “Release”) and acknowledges, appreciates and agrees that:

1. Your involvement in SK8Houston 2026, including but not limited to rollerblading, roller-skating or biking is an inherently dangerous activity and the  risk of injury from the activities involved in this Program is significant, including the potential for serious injuries, permanent paralysis death, and property damage.  I understand that while particular rules, equipment and personal discipline may reduce this risks, the risks of sustaining serious injuries does exist.

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, INCLUDING ANY OMISSIONS, EVEN IF ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASERS OR OTHERS, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS.  I ASSUME FULL RESPONSIBILITY FOR MY PARTICIPATION IN THE PROGRAM.

3. I willingly agree to comply with the stated and customary terms and conditions for participation in the Program and will take any and all actions to protect myself from bodily injury, including but not limited to the use of a helmet, knee, wrist, and elbow pads as well as reflective gear and lights during any Program events held at night.  If however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such attention of the nearest Program official or Releaser immediately.

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS, NOW KNOWN OR HEREAFTER KNOWN, AND HOLD HARMLESS SK8Houston and Space City Skaters, their officers, officials, agents, and or employees, whether paid or unpaid, other participants, sponsoring agencies, sponsors, advertisers and if applicable, owners and lessors of premises used to conduct the Program (“Releasers”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY,  WHETHER ARISING FROM ORDINARY NEGLIGENCE OF THE RELEASERS OR OTHERWISE.

5.  I COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST SK8HOUSTON 2026, SPACE CITY SKATERS OR ANY OTHER RELEASERS, AND FOREVER RELEASE AND DISCHARGE SK8HOUSTON 2026 AND SPACE CITY SKATERS AND ALL OTHER RELEASERS FROM LIABILITY UNDER SUCH CLAIMS. THIS WAIVER AND RELEASE DOES NOT EXTEND TO CLAIMS FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITIES THAT TEXAS LAW DOES NOT PERMIT TO BE RELEASED BY AGREEMENT.

6. I HAVE READ THIS AMATEUR ATHLETIC WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT INDUCEMENT OR COERCION. IF I DO NOT READ, WRITE, OR SPEAK ENGLISH, SOMEONE WHO UNDERSTANDS ENGLISH AND MY NATIVE LANGUAGE HAS READ ALL OF THE TERMS AND CONDITIONS OF THIS WAIVER AND RELEASE OF LIABILITY AND TRANSLATED SUCH TERMS TO ME, AND AFTER DOING SO, I FULLY UNDERSTAND ALL SUCH TERMS AND CONDITIONS.

7. This Amateur Athletic Waiver and Release of Liability and Assumption of Risk Agreement constitutes the sole and entire agreement of the SK8Houston 2026, Space City Skaters, and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Amateur Athletic Waiver and Release of Liability and Assumption of Risk Agreement or the application thereof to any party or circumstance is held invalid, illegal, or unenforceable to any extent in any jurisdiction, then the remaining terms and provisions of this Amateur Athletic Waiver and Release of Liability and Assumption of Risk Agreement and their application to other parties or circumstances shall not be affected thereby and shall be enforced to the greatest extent permitted by law. This Amateur Athletic Waiver and Release of Liability and Assumption of Risk Agreement is binding on and shall inure to the benefit of SK8Houston 2026, Space City Skaters, and me and their respective successors and assigns. All matters arising out of or relating to this Amateur Athletic Waiver and Release of Liability and Assumption of Risk Agreement shall be governed by and construed in accordance with the internal laws of the State of Texas, excluding any conflict-of-laws rule or principle that might refer the governance or the construction of this agreement to the laws of another jurisdiction. Any claim or cause of action arising under this Amateur Athletic Waiver and Release of Liability and Assumption of Risk Agreement may be brought only in the federal and state courts located in Harris County, Texas and I hereby consent to the exclusive jurisdiction of such courts.

For participant of minority age (under age 18 at time of registration)

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all Releasers, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasers from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASERS,  to the fullest extent permitted by Texas law.
