Welcome to SnapFox VPN. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "your," or "user"), and J CEVALLOS CONSTRUCTION, INC. ("we," "us," "our," or "Company"), concerning your access to and use of the SnapFox VPN mobile application (the "Application" or "Service").
By accessing or using the Application, you agree that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APPLICATION AND YOU MUST DISCONTINUE USE IMMEDIATELY.
By downloading and installing the Application, you represent and warrant that:
You have the legal capacity to enter into a binding agreement.
You are at least 13 years of age (or the minimum legal age in your jurisdiction). The Service is not intended for children under 13, in strict adherence to our Privacy Policy.
Your use of the Service does not violate any applicable local, state, national, or international law or regulation.
Unless otherwise indicated, the Application and all its source code, databases, functionality, software, mobile application designs, audio, video, text, photographs, and graphics (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us, and are protected by copyright, trademark, and unfair competition laws of the United States and international conventions.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application strictly for your personal, non-commercial purposes on an Android device owned or controlled by you, in accordance with the Google Play Terms of Service.
The Application functions solely as a utility and connection proxy tool. The Application does not contain any social feeds, comment sections, profile creation, chat rooms, or any features that allow users to submit, post, upload, display, or transmit content to other users or to our servers. Because there is no user-generated content, you are entirely responsible for the data and external websites you browse while utilizing our secure network tunnel.
You may use the Application only for lawful purposes. As a condition of your use of the Service, you agree not to use the VPN tunnel for any activity that is prohibited by these Terms or by law. Prohibited activities include, but are not limited to:
Violating any local, state, national, or international laws, including copyright laws and intellectual property rights.
Using the Service for hacking, cracking, distributing malware, viruses, or running denial-of-service (DoS/DDoS) attacks.
Engaging in any form of fraudulent activity, phishing, identity theft, or unauthorized scanning and probing of networks.
Attempting to interfere with, disrupt, or compromise the integrity or security of our server architecture or network paths.
Utilizing the Service to download, stream, or transmit illegally obtained content or copyrighted material without permission.
Any breach of this section will result in the immediate revocation of your license to use the Application.
The Application is an ad-supported service that incorporates third-party Software Development Kits (SDKs).
Google AdMob: We display advertisements delivered by Google AdMob within the app. These advertisements may be tailored based on non-personal device diagnostics or cookies, in compliance with the Google Advertising Policies.
Disclaimer: We do not endorse, guarantee, or assume responsibility for any product, service, or website advertised through third-party links or banners. Any interaction, correspondence, or business transaction you have with advertisers found within the Application is solely between you and the third party.
THE APPLICATION IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE APPLICATION AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE APPLICATION AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, SECURE ENCRYPTION INTEGRITY, OR COMPLETENESS OF THE APPLICATION’S VPN CONTEXTS, BACKEND SERVERS, OR OPERATIONAL UPTIME. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
IN NO EVENT WILL J CEVALLOS CONSTRUCTION, INC., OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APPLICATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE APPLICATION.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Application; (2) a breach of these Terms; or (3) your violation of the rights of a third party, including but not limited to intellectual property rights or local cyber-laws.
These Terms and your use of the Application are governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located within the United States, and you hereby consent to the personal jurisdiction and venue of such courts.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms. It is your responsibility to periodically review these Terms to stay informed of updates.
We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
